The Second Amendment And The Incorporation Conundrum: Towards A Workable Jurisprudence, Koren Wai Wong-Ervin Jan 1998

The Second Amendment And The Incorporation Conundrum: Towards A Workable Jurisprudence, Koren Wai Wong-Ervin

UC Law Journal

This Note begins by offering a new prospective to the ongoing debate about the nature of the right protected by the Second Amendment, and concludes by proposing two possible tests and applying them to two provisions of the California Penal Code, striking one and upholding the other, demonstrating that a judicially-enforced Second Amendment would not be "fatal in fact" to all gun control legislation. The Author also critiques the Court's current incorporation doctrine, namely the Court's failure to identify when the "fundamental right" inquiry is to be made, the Court's interchangeable use of "American scheme of liberty" and "Anglo-American scheme …

"March Madness": An Examination Of Dual-Use Trademark Terms And Reverse Confusion, David Y. Gan Jan 1998

"March Madness": An Examination Of Dual-Use Trademark Terms And Reverse Confusion, David Y. Gan

UC Law Journal

The Seventh Circuit's decision in Illinois High School Ass'n v. GTE Vantage, Inc. addressed a previously unrecognized category of trademark-the "dual-use" trademark term. "Dual-use" terms are marks that are associated by the public with two parties, where confusion would likely arise regarding which party the mark denotes. Writing for a three-judge panel, Chief Judge Posner held that dual-use terms should be treated similarly to generic terms and receive no protection under trademark law.

In this Note, the author examines the implications of the Seventh Circuit's decision in terms of the underlying goals of trademark law, the public's interest in effective …

Nitrogen Transformations In Coal During Pyrolysis, Simon R. Kelemen, Martin L. Gorbaty, P J. Kwiatek, Thomas H. Fletcher, Mathew Watt, Mark S. Solum, Ronald J. Pugmire Jan 1998

Nitrogen Transformations In Coal During Pyrolysis, Simon R. Kelemen, Martin L. Gorbaty, P J. Kwiatek, Thomas H. Fletcher, Mathew Watt, Mark S. Solum, Ronald J. Pugmire

Faculty Publications

X-ray photoelectron spectroscopy (XPS) was used to identify and quantify the changes in organically bound nitrogen forms present in the tars and chars of coals after pyrolysis. For fresh coal, pyrrolic nitrogen is the most abundant form of organically bound nitrogen, followed by pyridinic, quaternary, and amino types. Some of the quaternary nitrogen species initially present in coal are lost upon mild pyrolysis, prior to hydrocarbon devolatilization. These quaternary species are attributed to pyridinic or basic nitrogen species associated with hydroxyl groups from carboxylic acids or phenols. A portion of the quaternary nitrogen species is lost at the very earliest …

An Investigation Into The Development Of Engineering Students' Conceptual Understanding Of Mathematics, Wendy Mary Maull Jan 1998

An Investigation Into The Development Of Engineering Students' Conceptual Understanding Of Mathematics, Wendy Mary Maull

School of Engineering, Computing and Mathematics Theses

Following widespread concern over an apparent decline in the mathematical skills of engineering students, this study employed survey and observation methods to investigate the ways in which engineering students understand mathematical concepts, and to compare these with the concepts held-by students of mathematics. It was found that the engineering students employ a different vocabulary from mathematics students in discussing mathematics, and that their understanding of mathematical concepts develops differently from mathematics students both in response to teaching (which appears to be a transitory effect) and as their experience gives meaning to the ideas in life outside study. These findings are …

Supporting The Management Of Electronic Engineering Design Teams Through A Dynamic Contingency Approach, Richard David Parsons Jan 1998

Supporting The Management Of Electronic Engineering Design Teams Through A Dynamic Contingency Approach, Richard David Parsons

School of Engineering, Computing and Mathematics Theses

The contribution to knowledge presented in this thesis is the dynamic contingency approach, supported through software, which supports the management of the early, conceptual stages of electronic engineering team design. 1he term contingency pertains to the design environment being in a contingent state, that is "dependent on uncertain issues" (Hayward & Sparkes, 1991). These issues are typically dynamic, that is ''pertaining to forces not in equilibrium, forces that produce motion" (Hayward & Sparkes, 1991). The concept for the dynamic contingency approach was developed through a soft systems analysis. This analysis drew upon an ethnographic study conducted in parallel with the …

A Theoretical Perspective Of Factors That Relate To The Functional Independence Of Mature Adults, Richard N. Ashden Edd,Dc Jan 1998

A Theoretical Perspective Of Factors That Relate To The Functional Independence Of Mature Adults, Richard N. Ashden Edd,Dc

Dissertations

Limitations of policy makers and health care providers understanding about living conditions in later adulthood continually constrains mature adults from doing more for themselves, and society. These circumstances move society to devalue mature adults. Less valued mature adults tend to become even more dependent, that is, increasingly less willing to care for themselves, and less able to contribute to the social good. As a result, a vicious cycle was created, and it caused mature adults to live lower quality lives, and become increasingly dependent on others. To empower mature adults in later life, this study does the preliminary work to …

Voices Against Discrimination And Exclusion: Latino School Leaders' Narratives For Change, Jaime J. Romo Edd Jan 1998

Voices Against Discrimination And Exclusion: Latino School Leaders' Narratives For Change, Jaime J. Romo Edd

Dissertations

Many scholars, practitioners, and policy makers know very little about individual Latino administrators' cultural and professional experiences, responses to discrimination, and patterns or institutional conditions which relate to K-12 ethnic minority administrators' success. Moreover, many are also unaware that as ethnic diversity increases, the relative proportion of minority administrators, many of whom could be role models, shrinks. Once we can recognize this as seeds for inequity in society, we might be able to consider the ways in which our educational institution reinforces or counters societal inequities. By specifically exploring Latino administrators' experiences, because of the large Latino California presence, we …

Hot News & No Cold Facts: Nba V. Motorola And The Protection Of Database Contents, David Djavaherian Jan 1998

Hot News & No Cold Facts: Nba V. Motorola And The Protection Of Database Contents, David Djavaherian

Richmond Journal of Law & Technology

In National Basketball Ass'n v. Motorola, the Second Circuit encountered the problematic issue of copyright preemption. Though the case did not directly involve the protection of database contents, NBA is a harbinger of judicial underprotection for the database industry. In holding that state misappropriation doctrine is preempted by the Copyright Act except in a very narrow class of "hot news" cases, NBA unduly restricts the common law's ability to prevent tortious behavior between database industry competitors. This underprotection has fueled a movement toward the legislative protection of database contents, but recent Congressional proposals, in their current form, leap to the …
