The Admissibility Of Medical Testimony In Ohio: Daubert, Joiner And Ohio's Relevance-Reliability Standard, Gerald J. Todaro Jan 1998

The Admissibility Of Medical Testimony In Ohio: Daubert, Joiner And Ohio's Relevance-Reliability Standard, Gerald J. Todaro

Cleveland State Law Review

This article specifically examines the reliability standard imposed under Rule 702 of the Ohio Rules of Evidence and its application to medical expert testimony in Ohio. Section II reviews Daubert, its progeny, and Ohio law. This analysis reveals tension between Ohio's flexible relevance/reliability standard and the more exacting demands of Daubert. Section III examines the scientific basis of clinical diagnosis and treatment of illness and disease. This section argues that judges should take judicial notice of the conventional methodology underlying the clinical practice of medicine, and thus the preliminary question of reliability of medical expert testimony should rarely require a …

Shaken Baby Syndrome: Who Are The True Experts, Joseph D. Hatina Jan 1998

Shaken Baby Syndrome: Who Are The True Experts, Joseph D. Hatina

Cleveland State Law Review

Shaken baby syndrome is a serious form of child maltreatment, often involving infants younger than six months of age. It commonly occurs, yet it is frequently overlooked in its most chronic form and underdiagnosed in its most serious expression. Section II of this article will discuss the symptoms, presentation, and clinical findings of shaken baby syndrome. It will conclude by looking at recommendations from the U.S. Advisory Board on Child Abuse and Neglect. Section III delves into the history, function and statistics of Child Death Review Teams on a national level. The discussion ends by examining Ohio's proposed legislation concerning …

Dna Repair And A Closer Look At The Role Of Ku Protein, Srinivas S. Tumuliri Jan 1998

Dna Repair And A Closer Look At The Role Of Ku Protein, Srinivas S. Tumuliri

Honors Capstones

Double strand breaks in cells may arise due to a number of reasons including mutagens and normal cellular processes such as V(D)J recombination. Unrepaired strand damage can result in broken chromosomes and cell death. Improper repair can lead to cancer. A specific component of nonhomologous recombination to repair DSBs was studied in two different cell lines, Chinese hamster ovary K1 cells and xrs cells. Xrs cells, deficient in Ku protein were impaired in their ability to repair DSBs induced by ionizing radiation. These results and other findings support the critical function of Ku in DSB repair and indicate a multiple …

Needs And Risks Facing The Indonesian Youth Population, Desti Murdijana Jan 1998

Needs And Risks Facing The Indonesian Youth Population, Desti Murdijana

Reproductive Health

Youth are the leaders of tomorrow, but right now they face a formidable collection of problems that will determine the quality of their future lives and the lives of us all. Education, jobs, substance abuse, violence, sexuality, and marriage are examples of adolescent issues that demand special attention from researchers, youth activists and advocates, parents, and policymakers. In attempting to address these complex issues, we must be willing to confront ignorance, controversy, and cultural obstacles. Clear and focused policy and strategies must play a basic role in tackling these issues facing Indonesian adolescents. This paper provides a concise situation analysis …

A Constitutional Law Casebook For The 21st Century: A Critical Essay On Cohen And Varat, Bryan K. Fair

Seattle University Law Review

The purpose of this essay is to review the strengths and weaknesses of the latest edition of Cohen and Varat’s Constitutional Law: Cases and Materials. After teaching from it for seven years, the author of this review states unequivocally that it is a first-rate teaching tool – unquestionably one of the leading, traditional casebooks, enabling thousands of law students throughout the country to gain some insight on a vast array of constitutional questions. Below, rather than simply describe the casebook's broad contents, the author illustrates how he uses it in a class of 65 to 100 students, meeting for …

Different legal analogies that may apply will be illustrated, and some of their strengths, weaknesses, and alternatives will be analyzed. I will begin by looking at different types of computer information systems, and then the major legal issues surrounding computer information systems will be surveyed in brief. Next, the different legal analogies which could be applied to computer information systems will …

Kahan On Mistakes, Daniel B. Yeager Jan 1998

Kahan On Mistakes, Daniel B. Yeager

Faculty Scholarship

In Ignorance of Law Is an Excuse - but Only for the Virtuous, Professor Dan Kahan reconciles what I had thought was an irreconcilable body of law. To be sure, imposing order on whether and when mistakes of law should pass as responsibility-evading accounts
of untoward actions is far from light work. Yet Kahan somehow pulls it off in just twenty-seven pages. In addition to acknowledging the importance of Professor Kahan's essay, I write here to point out if not correct what might have been two oversights in his view of the meaning and operation of mistakes. First, Kahan …

Error Estimation Of The Padé Approximation Of Transfer Functions Via The Lanczos Process, Zhaojun Bai, Qiang Ye Jan 1998

Error Estimation Of The Padé Approximation Of Transfer Functions Via The Lanczos Process, Zhaojun Bai, Qiang Ye

Mathematics Faculty Publications

Krylov subspace based moment matching algorithms, such as PVL (Padé approximation Via the Lanczos process), have emerged as popular tools for efficient analyses of the impulse response in a large linear circuit. In this work, a new derivation of the PVL algorithm is presented from the matrix point of view. This approach simplifies the mathematical theory and derivation of the algorithm. Moreover, an explicit formulation of the approximation error of the PVL algorithm is given. With this error expression, one may implement the PVL algorithm that adaptively determines the number of Lanczos steps required to satisfy a prescribed error tolerance. …
