Daddy, I Know What The Story Means — Now, I Just Need Help With The Words, William Bintz Oct 1998

Daddy, I Know What The Story Means — Now, I Just Need Help With The Words, William Bintz

Reading Horizons: A Journal of Literacy and Language Arts

This article describes a single instance of literacy learning involving the author and his two daughters, and provides a demonstration of how this literacy event can be unpacked both theoretically and practically in a way that a reflective practitioner could do. The aim of this article is to stimulate some reflective thinking and start some new conversations about what theoretical assumptions should drive reading instruction in the 21st century.

Cabining Freedom: A Comparative Study Of Lesbian And Gay Rights In The United States And Canada, Credence Fogo Oct 1998

Cabining Freedom: A Comparative Study Of Lesbian And Gay Rights In The United States And Canada, Credence Fogo

Cardozo Journal of International and Comparative Law

The article examines the divergent approaches of Canada and the United States in addressing gay and lesbian equality, highlighting how their differing legal frameworks and cultural values shape the protection of rights. While Canada, under the Canadian Charter of Rights and Freedoms and its Section 1 balancing test, has expanded relationship rights for sexual minorities, the U.S. has taken a more fragmented approach, emphasizing individual liberties over social rights. The analysis underscores the tension between Canada's communitarianism and the U.S.'s individualistic legal culture in advancing LGBTQ+ rights.

The Alien Tort Claims Act And The Foreign Sovereign Immunities Act: A Policy Solution, Marc Rosen Oct 1998

The Alien Tort Claims Act And The Foreign Sovereign Immunities Act: A Policy Solution, Marc Rosen

Cardozo Journal of International and Comparative Law

The note examines the evolution and effectiveness of the Alien Tort Claims Act (ATCA) and related legislation, such as the Antiterrorism and Effective Death Penalty Act (AEDPA), in addressing human rights violations. It argues that while the ATCA has been a groundbreaking tool for litigating human rights abuses, its implementation has been inconsistent and often undermined by subsequent laws like the AEDPA, which fails to adequately account for international law obligations. The analysis highlights the tension between U.S. domestic law and global human rights standards, concluding that the AEDPA is flawed as a human rights enforcement mechanism and proposes a …

The Russian Title Registration System For Realty And Its Effect On Foreign Investors, Lev S. Batalov Oct 1998

The Russian Title Registration System For Realty And Its Effect On Foreign Investors, Lev S. Batalov

Washington Law Review

The recent privatization of real property is an important step in Russia's transition from a planned to market economy. This privatization creates opportunities for foreigners in the Russian realty market. However, foreigners are not likely to enter this market unless rights to immovable property are certain and secure. This Comment describes the new Russian immovable property Registration Law and argues that, despite its drawbacks, it creates a workable system that will provide certainty and security in rights to Russian immovable property. Furthermore, the Comment advises foreign investors on how to avoid potential problems the new law creates.

Unilateral Refusals To Deal In Intellectual Property After Image Techical Services, Inc. V. Eastman Kodak Co., Brian F. Ladenburg Oct 1998

Unilateral Refusals To Deal In Intellectual Property After Image Techical Services, Inc. V. Eastman Kodak Co., Brian F. Ladenburg

Washington Law Review

While the Federal Patent and Copyright Acts give patent and copyright holders limited exclusive rights in intellectual property, the Sherman Act prohibits combinations or conspiracies that restrain trade and monopolization. Although firms possessing intellectual property generally exercise their statutory exclusionary rights without running afoul of the antitrust laws, conduct may plausibly be authorized by intellectual property law but forbidden by antitrust. In construing the two statutory schemes, federal courts have generally held that conduct authorized by the intellectual property laws, in the absence of some further inculpatory action, cannot form the basis for antitrust liability. The Ninth Circuit departed from …

Mad Cows, Offended Emus, And Old Eggs: Perishable Product Disparagement Laws And Free Speech, Lisa Dobson Gould Oct 1998

Mad Cows, Offended Emus, And Old Eggs: Perishable Product Disparagement Laws And Free Speech, Lisa Dobson Gould

Washington Law Review

In the wake of the 1989 controversy over Alar use on apples, several states enacted laws providing a civil cause of action to producers damaged by false statements disparaging the safety of their perishable food products. Commentators have suggested that these laws are unconstitutional and contrary to the First Amendment's free speech protections. This Comment argues that the majority of state laws either meet or exceed the constitutional protections established by the U.S. Supreme Court's defamation cases. However, these laws are unlikely to be used widely in the future because of their stringent proof requirements and because such suits often …

In The Wake Of Lough V. Brunswick Corp.: Who Decides Experimental Purpose In 35 U.S.C. § 102(B) Public Use Cases?, Chad P. Webster Oct 1998

In The Wake Of Lough V. Brunswick Corp.: Who Decides Experimental Purpose In 35 U.S.C. § 102(B) Public Use Cases?, Chad P. Webster

Washington Law Review

Pursuant to 35 U.S.C. § 102(b), a defendant can avoid liability for patent infringement if the patented invention was in public use in the United States more than one year prior to the date of patent application. Although "public use" is broadly construed to include most nonsecret uses, a nonsecret use pursued primarily for bona fide experimental purposes is merely an "experimental use." Experimental use negates the conclusion that an invention was in public use within the meaning of section 102(b). In Lough v. Brunswick Corp., the U.S. Court of Appeals for the Federal Circuit held that the issues …

Intergenerational Co-Residence And Children's Incomes, Thomas A. Dunn, John W. Phillips Oct 1998

Intergenerational Co-Residence And Children's Incomes, Thomas A. Dunn, John W. Phillips

Center for Policy Research

This paper examines co-residence arrangements between older parents and their adult children. We sketch a model of the co-residence choice that accounts for the preferences of the parent and the child and incorporates parental altruism and demands for housing, goods, and privacy. The model predicts that poorer, unmarried or childless siblings are more likely than their siblings to co-reside. The empirical analysis exploits the information provided by respondents in the Asset and Health Dynamics Among the Oldest Old (AHEAD) survey about all of their children living in and outside their household. Indeed, we find that poorer siblings are more likely …

Consumer Generalization Of Nutrient Content Claims In Advertising, J. Craig Andrews, Richard G. Netemeyer, Scot Burton Oct 1998

Consumer Generalization Of Nutrient Content Claims In Advertising, J. Craig Andrews, Richard G. Netemeyer, Scot Burton

Marketing Faculty Research and Publications

Although considerable research exists on consumer processing of nutrition labeling and package claims, less is known about consumer interpretation of nutrient content claims in advertising. This is important because product advertising often provides a significant first step for consumers in learning new nutrition information. Yet, unlike package claims, Nutrition Facts Panels are often not available for consumers during the processing of such advertising claims. Therefore, the authors examine the following research questions: (1) Do consumers misinterpret (i. e., overgeneralize) common nutrient content claims in advertising? If so, under what conditions does this occur? and (2) Can various types of disclosure …

Fraction Of Grains Development Measured By Electrolytic Grain Size Analyzer, Zhenhuan Wen Oct 1998

Fraction Of Grains Development Measured By Electrolytic Grain Size Analyzer, Zhenhuan Wen

Theses

Quantum sensitivity is an important emulsion property for photographic image formation and is usually calculated from a fraction of grains developable vs. log exposure (F-log E) curve. In this thesis, a new method, the electrolytic grain-size analyzer (EGSA) technique has been developed that will allow one to obtain F-log E curves for each grain size class in polydisperse emulsions. The correctness of the F-log E curve obtained by this new method has been examined by comparing the F-log E curve with that calculated from the normalized D-log E curve in the case of monodisperse emulsions. The problems in EGSA measurement, …

Auger Resonance Decay Process In Ar 2p Shell Excitation And Ionization, Y. Lu, Wayne C. Stolte, J.A. R. Samson Oct 1998

Auger Resonance Decay Process In Ar 2p Shell Excitation And Ionization, Y. Lu, Wayne C. Stolte, J.A. R. Samson

Chemistry and Biochemistry Faculty Research

The production and subsequent autoionization of the Ar+ (1D2)6d1 satellite state that is formed either by shake-up or recapture during the Auger decay of a 2p vacancy in Ar has been studied by photoelectron spectroscopy in the energy region from 243 to 256 eV. The creation of near zero energy electrons below and immediately above the Ar 2p ionization threshold is discussed. Some ambiguous points in previous studies are clarified.

Resolving The Tension In Aristotle's Ethic: The Balance Between Naturalism And Responsibility, David E.W. Fenner Oct 1998

Resolving The Tension In Aristotle's Ethic: The Balance Between Naturalism And Responsibility, David E.W. Fenner

Philosophy and Religious Studies Faculty Research and Scholarship

...It is clear that there exists in the history of ethics the problem that naturalist systems of ethics frequently fall prey to the entailment of behavioral determinism. If this occurs, it robs the ethic of doing any real work. Instead of proscribing correct and incorrect action, or allowing those considering the situation and activity to meaningfully assign praise or blame, the naive naturalist ethic functions only as a psychological thesis: that one will behave according to whatever psychological or mechanical program one is informed by.
The question of this paper was whether Aristotle's system falls prey to such a difficulty …

A Call For Reform Of Recent Immigration Legislation, Jason H. Ehrenberg Oct 1998

A Call For Reform Of Recent Immigration Legislation, Jason H. Ehrenberg

University of Michigan Journal of Law Reform

The Antiterrorism and Effective Death Penalty Act of 1996 and the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 dramatically limit the procedural rights of aliens who have been convicted of serious crimes. Consequently, aliens who have immigrated to the United States to escape persecution in their homelands are deported without adequate hearing or appeal. This Note argues that the laws violate international obligations and Constitutional law. It advocates amending the laws to give the Attorney General discretion over deportation decisions, eliminating retroactive application of deportation for aggravated felons, and reinstating judicial review of deportation or exclusion decisions.

Expanding The Circle Of Membership By Reconstructing The "Alien": Lessons From Social Psychology And The "Promise Enforcement" Cases, Victor C. Romero Oct 1998

Expanding The Circle Of Membership By Reconstructing The "Alien": Lessons From Social Psychology And The "Promise Enforcement" Cases, Victor C. Romero

University of Michigan Journal of Law Reform

Recent legal scholarship suggests that the Supreme Court's decisions on immigrants' rights favor conceptions of membership over personhood. Federal courts are often reluctant to recognize the personal rights claims of noncitizens because they are not members of the United States. Professor Michael Scaperlanda argues that because the courts have left the protection of noncitizens' rights in the hands of Congress and, therefore, its constituents, U.S. citizens must engage in a serious dialogue regarding membership in this polity while considering the importance of constitutional principles of personhood. This Article takes up Scaperlanda's challenge. Borrowing from recent research in social psychology, this …
