Evaluation Of Highway Safety Needs Of Special Population Groups - Phase 1, Sunanda Dissanayake, J. John Lu, Hua Tan, Xuehao Chu, Patricia Turner

CUTR Research Reports

Although the United States has achieved dramatic progress in the past several decades in terms of highway safety, there is however still room for improvement. Each year, tens of thousands of people are killed and millions injured as a. result of highway crashes, which in tum pose considerable economic loss to society. One area of highway safety that deserves further consideration is in relation to special population groups.

This project concentrates on the highway safety needs of six special population groups: older drivers, school aged children, young drivers, international tourists, new immigrants and people with disabilities. Ranking of highway safety …

Personal Jurisdiction In Cyberspace: Where Can You Be Sued, And Whose Laws Apply, George Perry Oct 1998

Personal Jurisdiction In Cyberspace: Where Can You Be Sued, And Whose Laws Apply, George Perry

Media Law and Policy

The development to date of the law of personal jurisdiction based on Internet and World Wide Web contacts is evolving in a way that could pose a legal threat to all Web site operators, and in particular the smaller independent site operators who can least afford it, by making them subject to being sued in virtually every state in the country. This article reviews the recent case law and concludes that, notwithstanding good policy reasons to do otherwise, some courts are finding personal jurisdiction to exist in circumstances that appear to go beyond the U.S. Supreme Court's admonition that the …

The Life Of The Sick Person, Carl E. Schneider

Law Quadrangle (formerly Law Quad Notes)

In The Practice of Autonomy: Patients, Doctors, and Medical Decisions (Oxford University Press, 1998), Professor Carl E. Schneider, '79, examines the Iaw of bioethics by looking at the lives of patients. He argues that bioethics has reached a point of paradox : Bioethicist increasingly seem to think patients have a duty to make their own medical decisions, but it is increasingly clear that many patients do not want to do so. The following excerpt from the chapter "The Reluctant Patient' is part of Schneider's attempt to show why patients may be reluctant to seize the gift of autonomy that the …

Nuclear Dna Content And Chromosome Numbers In Switchgrass, Ku Lu, Shawn M. Kaeppler, Kenneth Vogel, K. Arumuganathan, D. J. Lee Oct 1998

Nuclear Dna Content And Chromosome Numbers In Switchgrass, Ku Lu, Shawn M. Kaeppler, Kenneth Vogel, K. Arumuganathan, D. J. Lee

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Switchgrass, Panicum virgatum L., one of the three dominant grasses of the North American tall grass prairie, is a genetically and morphologically diverse species with an array of ploidy levels, or set of chromosomes, and ecotypes. The relationship between DNA content and ploidy level has been controversial. The objectives of this study were to provide clear photodocumentation of switchgrass chromosome numbers and to clarify the relationship between nuclear DNA content and chromosome number. Defining the relationship between ploidy level and nuclear DNA content will facilitate the use of molecular biology techniques, such as flow cytometry, in plant breeding and evolutionary …

An Addendum To Anthocharis Midea Dos Passos And Klots 1969: Description Of A New Subspecies From Texas, Ronald R. Gatrelle Oct 1998

An Addendum To Anthocharis Midea Dos Passos And Klots 1969: Description Of A New Subspecies From Texas, Ronald R. Gatrelle

The Taxonomic Report of the International Lepidoptera Survey

This paper verifies and expands upon the information presented by dos Passos and Klots in their 1969 systematic revision of Anthocharis midea. Their restriction of the range of A. midea midea to the coastal islands and immediate coast of Georgia and South Carolina, United States is confirmed and expanded north into southern coastal North Carolina. Their range of A. m. annickae is expanded southward from Virginia to central Georgia. A new subspecies, A. midea texana, is described from Texas. Texana is annickae’s ancestor. It differs from annickae only in having greatly reduced black scaling …

Tallgrass Prairie: Remnants And Relicts, Jane H. Bock, Carl E. Bock Oct 1998

Tallgrass Prairie: Remnants And Relicts, Jane H. Bock, Carl E. Bock

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

The tallgrass prairie once was continuous throughout the eastern Great Plains. Now, scattered remnants remain. The distribution of some of the most interesting and socially valuable remnants occur along the base of the Rocky Mountains as relicts from a past era. When the species composition of these Colorado grasslands is compared with that of the eastern tallgrass prairie by an index of similarity, the relationship is clear, even though the climates of the two regions differ greatly. It is likely that this western tallgrass prairie is left over from past geologic times rather than the product of long distance seed …

Review Of The Hidden Sea: Ground Water, Springs, And Wells By Francis H. Chapelle Oct 1998

Review Of The Hidden Sea: Ground Water, Springs, And Wells By Francis H. Chapelle

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

The Hidden Sea is divided into three parts. The first, "Myths and Models," tells "how both mysticism and rationality have been used to understand the puzzling behavior of groundwater." Second is "Bays in the Sea," which reports on "the strikingly different characteristics of ground water systems found in different parts of the country, and how their differences affect the people who use them." The last part, "Evil and the Wells," discusses "how ground water systems can become contaminated by various waste disposal practices, and how perceptions of this contamination are so often different from reality." Francis Chapelle, a research biologist …

Professional Responsibility: 1998 Survey Of Florida Law, Timothy P. Chinaris, Elizabeth Clark Tarbert

Law Faculty Scholarship

Continuing a trend, 1998 included a number of important developments in the area of professional responsibility law in Florida. Significant appellate court decisions, rule changes, and disciplinary actions potentially affect the practices of more than 58,000 members of The Florida Bar. This article reports and summarizes those developments by placing them in the framework of the various relationships in which lawyers typically operate. Part II looks at decisions affecting what must be viewed as the central relationship in this context: the relationship between lawyer and client. Part III examines developments pertaining to what may be the dominant relationship: the lawyer's …

Influence Of Physical Setting On Seagrass Landscapes Near Beaufort, North Carolina, Usa, Mark S. Fonseca, Susan S. Bell Oct 1998

Influence Of Physical Setting On Seagrass Landscapes Near Beaufort, North Carolina, Usa, Mark S. Fonseca, Susan S. Bell

Integrative Biology Faculty and Staff Publications

Field surveys were conducted in Core and Back Sounds, North Carolina, USA, to relate the physical setting of seagrass beds, as measured by a wave exposure index (REI), tidal current speed and water depth, to various measures of the sedimentary environment, spatial heterogeneity of seagrass distribution and measures of seagrass abundance. Seagrass beds in this area form patterns ranging from continuous to semi-continuous to widely dispersed, discrete patches across a gradient of increasing hydrodynamic activity. Tidal current speeds, exposure to waves and relative water depths revealed strong correlative evidence that physical processes influenced landscape-scale (50 x 50 m range with …

Depression And The Long-Term Risk Of Pain, Fatigue, And Disability In Patients With Rheumatoid Arthritis, Judith Fifield, Howard Tennen, Susan Reisine, Julia Mcquillan

Bureau of Sociological Research: Faculty Publications

Objective. To determine whether a previous episode of major depression leaves a “scar” that places previously depressed patients with rheumatoid arthritis (RA) at risk for experiencing high levels of pain, fatigue, and disability.

Methods. A cohort of 203 patients with RA was randomly selected from a national panel and interviewed by phone about pain, fatigue, depressive symptoms, disability, and history of major depression.

Results. Excluding patients who met the criteria for current major depression, patients with both a history of depression and many depressive symptoms at the time of the interview (dysphoria) reported more pain than those without current dysphoria, …

Proportionality And Punishment: Imposing Life Without Parole On Juveniles, Wayne A. Logan Oct 1998

Proportionality And Punishment: Imposing Life Without Parole On Juveniles, Wayne A. Logan

Scholarly Publications

The Eighth Amendment provides that “no cruel and unusual punishment shall be inflicted.” The Supreme Court has interpreted to this to mean a punishment cannot be “grossly disproportionate” to the crime. In this article, the author addresses whether an offender's age should play a role in assessing whether a sentence is “grossly disproportionate.” Specifically, the author addresses the increasingly common practice of imposing life without parole on offenders who are under sixteen years of age at the time they committed their offense, and whether such offenders’ youthful status should play a role in proportionality analysis. The article first provides an …
