The Master Equation Approach To Configurational Kinetics Of Alloys Via The Vacancy Exchange Mechanism: General Relations And Features Of Microstructural Evolution, Kirill D. Belashchenko, V G Vaks Jan 1998

The Master Equation Approach To Configurational Kinetics Of Alloys Via The Vacancy Exchange Mechanism: General Relations And Features Of Microstructural Evolution, Kirill D. Belashchenko, V G Vaks

Kirill Belashchenko Publications

The earlier-suggested generalized Gibbs distribution approach to the configurational kinetics of non-equilibrium alloys is extended to the case of many-component alloys and the realistic vacancy-mediated atomic exchange mechanism is incorporated. Exact and approximate equations for the temporal evolution of atomic distributions as well as for the free energy of a non-equilibrium alloy are presented. It is shown that the evolution of the main alloy component distribution for the nearest neighbour vacancy exchange model can usually be described in terms of an equivalent direct exchange model. This conclusion is illustrated with the computer simulation of decomposition and ordering via the vacancy …

Phonon Effects In The Thermoelectric Power Of Impure Metals, Kirill D. Belashchenko, D V Livanov Jan 1998

Phonon Effects In The Thermoelectric Power Of Impure Metals, Kirill D. Belashchenko, D V Livanov

Kirill Belashchenko Publications

Using the quantum transport equations for interacting electrons and phonons we study the phonon effects in the thermoelectric transport in impure metals. The contributions of both equilibrium phonons (the diffusive part) and non-equilibrium phonons (the drag effect) are investigated. We show that the drag effect which dominates in the thermopower of pure samples is strongly suppressed even by a small impurity concentration owing to the inelastic electron– impurity scattering processes. As a result we find the form of the phonon drag thermopower of an impure metal taking into account both normal and Umklapp processes of the electron–phonon scattering.

9. Alteration Of Uppermost Lavas And Volcaniclastics Recovered During Leg 152 To The East Greenland Margin, Mary Anne Holmes

Department of Earth and Atmospheric Sciences: Faculty Publications

During the last stages of the eruption of syn-rift basalts along the East Greenland Margin, debris flows and/or pyroclastic deposits were emplaced at Ocean Drilling Program Sites 915 and 916. The deposits and the tops of the lava flows at Site 918 were altered by subaerial weathering processes as indicated by downhole changes in mineral and chemical composition, and by the mineral paragenesis. Kaolinite and goethite, which form in acidic waters, are abundant at the tops of the weathering profiles and decrease in abundance downward. They are replaced by a smectite-hematite-opal assemblage at the bases of the weathered profiles. Gibbsite …

Ring-closing metathesis of jasmonate esters is shown to provide a rapid entry to jasmonate lactones. The lactones were investigated as possible quorum sensing molecules for the fungi Candida albicans. Assays demonstrated no effect on fungal morphology at concentrations up to 96 mM.

An Investigation Of The Amount Of Emphasis Placed On Content And Delivery By Instructors Of Public Speaking, Paul J. Siddens Iii Jan 1998

An Investigation Of The Amount Of Emphasis Placed On Content And Delivery By Instructors Of Public Speaking, Paul J. Siddens Iii

Faculty Publications

A study examined how much emphasis instructors of public speaking place on content and delivery when teaching and delivering oral and written critiques. The study sought to determine whether when teaching a hybrid introduction to communication course; or public speaking course; instructors are challenged with teaching their students about issues related to the content of the speech; such as the introduction and conclusion; organization; supporting evidence; and issues related to physical and vocal delivery such as appearance; gestures; eye contact; volume; rate; and vocal variety. This was a pilot study to test the research questions; survey instrument; and methodology used …

The Annual Cycle Of Sst In The Eastern Tropical Pacific, Diagnosed In An Ocean Gcm, William S. Kessler, Lewis M. Rothstein, Dake Chen Jan 1998

The Annual Cycle Of Sst In The Eastern Tropical Pacific, Diagnosed In An Ocean Gcm, William S. Kessler, Lewis M. Rothstein, Dake Chen

Graduate School of Oceanography Faculty Publications

The annual onset of the east Pacific cold tongue is diagnosed in an ocean GCM simulation of the tropical Pacific. The model uses a mixed-layer scheme that explicitly simulates the processes of vertical exchange of heat and momentum with the deeper layers of the ocean; comparison with observations of temperature and currents shows that many important aspects of the model fields are realistic. As previous studies have found, the heat balance in the eastern tropical Pacific is notoriously complicated, and virtually every term in the balance plays a significant role at one time or another. However, despite many complications, the …

Operating An Acoustic Doppler Current Profiler Aboard A Container Vessel, C. N. Flagg, G. Schwartze, E. Gottlieb, Hans Thomas Rossby Jan 1998

Operating An Acoustic Doppler Current Profiler Aboard A Container Vessel, C. N. Flagg, G. Schwartze, E. Gottlieb, Hans Thomas Rossby

Graduate School of Oceanography Faculty Publications

Since October 1992 an acoustic Doppler current profiler (ADCP) has been in near-continuous operation on board a 118-m-long container vessel, the container motor vessel Oleander, which operates on a weekly schedule between Port Elizabeth, New Jersey, and Hamilton, Bermuda. The ADCP collects information on currents from the surface to depths as great as 404 m depending on zooplankton concentrations, ship’s speed, sea state conditions, and the ship’s load factor. The southbound transits provide more and better data because the ship is loaded and rides deeper resulting in less bubble formation and entrainment underneath the vessel.

Installation and operation of an …

The Gift Of Language, Joseph Vining Jan 1998

The Gift Of Language, Joseph Vining

Articles

Style and substance cross-are genetically related as we now might want to say. Each draws on and is implied by the other. One point at which they cross is our sense of the nature of human language, what language is and can be, what it is not and can never be. The language of law is part of human language. Law is a distinctive form of thought, but it lives in human language. "Rule" might be thought synonymous with "law," but for all its talk of rules, the practice of law does not begin with a descriptive statement, or a …

Smokers' Compensation: Toward A Blueprint For Federal Regulation Of Cigarette Manufacturers, Jon D. Hanson, Kyle D. Logue, Michael S. Zamore Jan 1998

Smokers' Compensation: Toward A Blueprint For Federal Regulation Of Cigarette Manufacturers, Jon D. Hanson, Kyle D. Logue, Michael S. Zamore

Articles

Although nothing is certain in Washington, sweeping federal legislation in the cigarette area is more likely now than has ever been the case. Congress is currently considering several proposals for comprehensive federal regulation of the cigarette market, a market that has until now gone largely untouched by government intervention. Among those proposals, the one that has received the most attention, and the one that in fact motivated policy makers to look anew at the problems posed by cigarettes, is the proposed national tobacco resolution (the "Proposed Resolution"). The Proposed Resolution, which has been advanced by a coalition of state attorneys …

The Costs Of Cigarettes: The Economic Case For Ex Post Incentive-Based Regulation, Jon D. Hanson, Kyle D. Logue Jan 1998

The Costs Of Cigarettes: The Economic Case For Ex Post Incentive-Based Regulation, Jon D. Hanson, Kyle D. Logue

Articles

Cigarette smoking causes over 420,000 deaths annually in the United States, roughly twenty percent of all U.S. deaths, making cigarettes the single greatest preventable cause of death in this country. Indeed, tobacco kills more people every year than alcohol, illicit drugs, automobile accidents, violent crime, and AIDS combined. And not only are cigarettes deadly to smokers; they kill nonsmokers as well. According to a recent report from the Environmental Protection Agency (EPA), the "sidestream" or "passive" smoke from cigarettes - so-called environmental tobacco smoke (ETS) - is responsible annually for approximately 3000 lung cancer deaths, between 150,000 and 300,000 lower …

Thoughts From Across The Water On Hearsay And Confrontation, Richard D. Friedman Jan 1998

Thoughts From Across The Water On Hearsay And Confrontation, Richard D. Friedman

Articles

This article draws on the history of the hearsay rule, and on recent decisions of the European Court of Human Rights, to argue that the right to confrontation should be recognised as a basic principle of the law of evidence, and that aspects of the Law Commission's proposals for reform of the hearsay rule, and of the Home Office's proposals for restrictions on the right of cross-examination, are therefore unsatisfactory.

Built On Lies: Preliminary Reflections On Evidence Law As An Autopoetic System, Richard O. Lempert Jan 1998

Built On Lies: Preliminary Reflections On Evidence Law As An Autopoetic System, Richard O. Lempert

Articles

This Symposium on Truth and Its Rivals seems most concerned with what one might think of as the "output" side of evidence law that is, whether the rules of evidence enhance the likelihood that trial verdicts will capture the true state of the matter giving rise to the litigation. From this perspective, the legitimate rivals to truth are values that may justify decisions that eclipse the truth. The most obvious examples are rules of privilege, which allow probative information to remain concealed even where it is essential to accurate fact finding.

The Effectiveness Of A Strength Training Program On Extremity Strength, Flexibility, And Balance Of Elderly Women, Patricia L. Murphy Jan 1998

The Effectiveness Of A Strength Training Program On Extremity Strength, Flexibility, And Balance Of Elderly Women, Patricia L. Murphy

Master's Projects

This quasi-experimental study, partially replicating that of Nelson and Wernick (1997), compares balance, flexibility, and extremity strength before and after an 8-week weight-bearing exercise class. Six women, aged 69 to 85, used 1-5 pound wrist weights and ankle weights up to 1 o pounds. Pre-and post-exercise measurements of biceps curls, seated leg lifts with weights, one leg stand, and seated stretches were gathered. Results showed improvement in every category, with the greatest improvement (41.6%) in balance and the least (8.3%) in trunk flexibility. Nursing is uniquely positioned to assist this population by promoting, developing, and implementing such exercise programs.

The (Cloudy) Future Of Class Actions, Edward H. Cooper Jan 1998

The (Cloudy) Future Of Class Actions, Edward H. Cooper

Articles

The past, both proximate and remote, is often consulted in attempts to predict the future. Of course extrapolation from past to future is at best an uncertain art. Extrapolation, however, is not the only problem. Lessons from the recent past are distorted by lack of perspective. Lessons from the distant past are distorted by distance. The first step is to choose which of the competing pasts to consult. Selfishly, I choose to consult the recent past, as it continues through the present and on into the near-term future, from the perspective of the Advisory Committee on the Federal Rules of …

Up From Individualism (The Brennan Center Symposium On Constitutional Law)." , Donald J. Herzog Jan 1998

Up From Individualism (The Brennan Center Symposium On Constitutional Law)." , Donald J. Herzog

Articles

I was sitting, ruefully contemplating the dilemmas of being a commentator, wondering whether I had the effrontery to rise and offer a dreadful confession: the first time I encountered the countermajoritarian difficulty, I didn't bite. I didn't say, "Wow, that's a giant problem." I didn't immediately start casting about for ingenious ways to solve or dissolve it. I just shrugged. Now I don't think that's because my commitments to either democracy or constitutionalism are somehow faulty or suspect. Nor do I think it's that they obviously cohere. It's rather that the framing, "look, these nine unelected characters can strike down …

Corporate Judgement Proofing: A Response To Lynn Lopucki's 'The Death Of Liability', James J. White

Articles

In "The Death of Liability" Professor Lynn M. LoPucki argues that American businesses are rendering themselves judgment proof.- Using the metaphor of a poker game, Professor LoPucki claims American businesses are increasingly able to participate in the poker game without putting "chips in the pot." He argues that it has become easier for American companies to play the game without having chips in the pot because of the ease with which a modern debtor can grant secured credit, because of the growth of the peculiar form of sale known as asset securitization, because foreign havens for secreting assets are now …

Make-Believe: The Rules Excluding Evidence Of Character And Liability Insurance (Symposium: Truth And Its Rivals: Evidence Reform And The Goals Of Evidence Law), Samuel R. Gross Jan 1998

Make-Believe: The Rules Excluding Evidence Of Character And Liability Insurance (Symposium: Truth And Its Rivals: Evidence Reform And The Goals Of Evidence Law), Samuel R. Gross

Articles

Article IV of the Federal Rules of Evidence includes several rules that prohibit the use of specified types of information as evidence of particular propositions. Subsequent remedial measures are inadmissible to prove negligence (but admissible to show ownership, control, et cetera),' settlement offers are inadmissible to prove liability (but admissible to show bias or prejudice, or for other purposes),2 and so forth. Any exclusion of relevant evidence involves some distortion of reality in the sense that the picture presented to the trier of fact includes less information than the available total. That will be true whether the evidence is kept …

Physician-Assisted Suicide: The Problems Presented By The Compelling, Heartwrenching Case, Yale Kamisar Jan 1998

Physician-Assisted Suicide: The Problems Presented By The Compelling, Heartwrenching Case, Yale Kamisar

Articles

Now that the U.S. Supreme Court has upheld New York and Washington state laws prohibiting the aiding of another to commit suicide,2 the spotlight will shift to the state courts, the state legislatures and state referenda. And once again proponents of physician-assisted suicide (PAS) will point to a heartwrenching case, perhaps the relatively rare case where a dying person is experiencing unavoidable pain (i.e., pain that not even the most skilled palliative care experts are able to mitigate), and ask: What would you want done to you if you were in this person's shoes?

The Compression Strength Comparison Of Corrugated Shipping Containers, Printed By Thick And Thin Plate, Worawut Sriratbunterng Jan 1998

The Compression Strength Comparison Of Corrugated Shipping Containers, Printed By Thick And Thin Plate, Worawut Sriratbunterng

Theses

The objective of this study was to examine the effect of direct flexographic printing on the compression strength of the RSC style containers when high quality graphics were printed, using thick and thin plate technology. Three factors were studied including: 1) different plate technology (thick and thin), 2) number of colors being printed (one and three), 3) printing impression (light and heavy). The compression strength comparison of the preprint and the postprint were also examined. The results showed that using the thick plate technology caused a significant reduction in the compression strength of printed containers, compared to either preprint containers …

The Slippery Slope To Bankruptcy - Should Some Claimants Get A 'Carve-Out' From Secured Credit? No: It's A Populist Craving For A Petit Bourgeois Valhalla, James J. White

Articles

In 1996, Professor Elizabeth Warren made a proposal to the American Law Institute and the Drafting Committee for Article 9 for a “20 percent set aside” for unsecured claimants. As I understand it, her proposal would amend Section 9-301 of Article 9 (the section that now implicitly subordinates a lien creditor to a prior perfected secured creditor).

The Organizational Action Research Model, Morton Elfenbein, Stephen M. Brown, Kim H. Knight Jan 1998

The Organizational Action Research Model, Morton Elfenbein, Stephen M. Brown, Kim H. Knight

WCBT Faculty Publications

This chapter proposes a paradigm, which empowers practitioners to practice research to meet their needs and to advance the profession to which they belong. It proposes the integration of practitioner and researcher role as an alternative to the fragmented model that currently exists. In doing so, it draws much from the past tradition of the action researchers as well as the science approach espoused by others. In this way, the needs of individual managers to evaluate their espoused theories and their theories-in-use can be undertaken so that their organizations can function more realistically and can respond more effectively to the …

The Role Of Nongovernmental Organizations In The Climate Change Negotiations, Chiara Giorgetti Jan 1998

The Role Of Nongovernmental Organizations In The Climate Change Negotiations, Chiara Giorgetti

Law Faculty Publications

The role of nongovernmental organizations (NGOs) in monitoring the implementation of international treaties, their relevance in the organization of development projects, and their importance in the representation and education of civil society has been acknowledged and valued by both international organizations and national governments. Nongovernmental actors also play an important role in the negotiations of international agreements. Moreover, many UN agencies work closely with NGOs. NGOs have played an important part in numerous environmental conventions, and their role is becoming more clearly defined. The presence of NGOs has also been instrumental in the evolution and development of many international environmental …
