Reframing The Misappropriation Theory Of Insider Trading Liability: A Post-O'Hagan Suggestion, Donna M. Nagy

For almost two decades, the United States Supreme Court was silent as to the validity of the so-called 'fraud on the source" misappropriation theory of insider trading liability. This changed in June 1997 when the theory received a resounding endorsement from the Court in United States v. O'Hagan.

Critics of O'Hagan have argued that the Court's decision reaches too far. However, this Article contends that the Court actually endorsed a theory that does not reach far enough. By analyzing and critiquing the reasoning of the majority opinion in O'Hagan, this Article demonstrates that the Court's unnecessarily restrictive misappropriation theory will …

High Frequency (HF) radio is still a vital part of communications networks because its low cost and long distance capabilities, and still plays important roles as primary, supplemental, or redundant backup systems. Asynchronous Transfer Mode (ATM) is increasingly becoming an important part of communications, especially with LAN Emulation (LANE) specifications. Add to this the importance and increasing interest and dependency upon wireless networking, and it becomes inevitable that research into mobile ATM networking over HF radio would be considered. This study is focused on the cost justification of the different levels of packaging line automation: manual, semi-automatic, and fully automatic of canned chunk pineapple in syrup which is packed in #10 cans. The packaging line criteria and the line designs are established. The suitable machines and the labor input for each step of the packaging line are indicated. In addition, the total machine cost and the total labor input for each level of packaging line automation are shown and compared. Sediments from the Antarctic continental margin may provide detailed palaeoenvironmental records for Antarctic shelf waters during the late Quaternary. Here we present results from a palaeoenvironmental study of two sediment cores recovered from the continental shelf off Mac. Robertson Land, East Antarctica. These gravity cores were collected approximately 90 km apart from locations on the inner and outer shelf. Both cores are apparently undisturbed sequences of diatom ooze mixed with fine, quartz-rich sand. Core stratigraphies have been established from radiocarbon analyses of bulk organic carbon. In the last twenty years, the issue of the impact of relative gains on interstate cooperation has been at the center of the debate between the two major schools of thought in International Relations theory, namely neoliberalism and neorealism. Over time, the relative gains problem has ceased to be a radically divisive issue and has worked as a common research program that has brought the two theoretical perspectives closer together. Presented in this thesis are new approaches to column compatibility checking and column-based input/output encoding for Curtis decompositions of switching functions. These approaches can be used in Curtis-type functional decomposition programs for applications in several scientific disciplines. In 1968, Czechoslovakia attempted to sweep the ashes of Stalinism from its path to socialism. The reform-movement "Prague Spring" united the nation with a goal to achieve a more just form of socialist society. When the Soviet Union and its Warsaw Pact allies invaded Czechoslovakia on August 21, 1968, they destroyed this dream.

The purpose of this thesis is to show how the SED interpreted events in Prague and presented their analysis to the East German public. Although imbedded in events in Czechoslovakia, this is an essay on German history.
