Time series models have been applied in many areas including economics, stuck recruitment and the environment. Most environmental time series involve highly correlated dependent variables, which makes it difficult to apply conventional regression analysis, Traditionally, regression analysis has been applied to the environmental dependent stock and recruitment relationships for crustacean species in Western Australian fisheries. Alternative models, such as transfer function models and state space models have the potential to provide unproved forecasts for these types of data sets. The release of Better Schools in Western Australia: A Programme for Improvement (1987), in line with other public sector agency reforms; contained a prescription for the restructuring of the Education Department of Western Australia from 11 bureaucratic to a corporate management system of school administration. These changes were intended to render the education system, and especially schools more flexible, responsive and accountable. Among the proposals for educational restructuring was a new opportunity for community participation through ''school based decision making groups." The present study sought to determine how organizational culture information could best be presented to job applicants for the purpose of attracting employees who will fit into an organization's culture. Attraction to the organization's culture was hypothesized to influence applicant self-selection into the company. Two different types of Realistic Job Previews (RJPs), semantic and episodic, were compared in their ability to convey information accurately about a hypothetical organizational culture. Participant knowledge of the culture was hypothesized to align objective, or actual, fit with subjective perceptions of fit.

Toxoplasma gondii is a complex protozoan parasite that can cause encephalitis (TE) in animals and humans when the immune system is suppressed (e.g. AIDS). The focus of this study has been the immuno-modulatory role of cold stress (CS) in the pathogenesis of acute murine toxoplasmosis. Female BALB/c mice subjected to CS for eight days followed by oral infection on day 9 with 20 cysts of the low-virulent T. gondii ME 49 strain. Control infection (INF) and cold stress + infection (CS + INF) mice were sacrificed at 7 to 10 day intervals to study cell mediated immunity (CMI), which is …

In one case, a physician refers a patient to a certain hospital in return for an undisclosed referral fee from the hospital. In another, a physician decides not to refer a patient to a specialist for further examination. The physician, however, does not disclose to the patient that part of the cost of sending the patient to the specialist would come out of the physician's potential earnings. In the last few years, Court-watchers have been particularly busy critiquing the constitutional decisions of the splintered Rehnquist Court. Two of the recurring critiques have posited that the Justices are overly activist and that their opinions are needlessly confusing. American Lawyer's Stuart Taylor, for example, has decried both the "jurisprudential mess" of the Court's recent redistricting decisions' as well as the disturbing activism that Taylor believes marks each of the Equal Protection decisions of the 1995-96 Terman activism that has led him to wonder "whether there is any life at all left in the idea of judicial restraint."' Throughout the study of various theories of algorithms much work has been done in the area of traversal and solving optimization problems on graphs. Some of this work includes studies of finding the Minimal-Cost Spanning Trees (MST) in directed and undirected connected graphs. Several algorithms have been developed for such task. The purpose of this study was to create a process to gather warehouse drop height data for an over-the-counter pharmaceutical company. The Food and Drug Administration's Current Good Manufacturing Practice for Finshed Pharmaceuticals was applied during the development and collection of data. The process created during this study proved to be successful in collecting accurate data which will later be used to produce a focused simulation test.

Resurrecting The Dodo: The Unfortunate Re-Emergence Of The Puffery Defense In Private Securities Actions, Jennifer O'Hare

The conventional wisdom is that the puffery defense is inapplicable in securities regulation. However, appellate courts in almost every federal circuit have recently used the puffery defense to dismiss private securities fraud actions that were based on vague statements of corporate optimism. This Article demonstrates that the courts have misused the puffery defense and have improperly insulated companies from liability for their misrepresentations. It contends that the assumptions justifying the use of the puffery defense are not present in securities transactions and that the federal securities laws have expressly rejected the very doctrine underlying the puffery defense-caveat emptor. Functus Officio: Does The Doctrine Apply In Labor Arbitration - Teamsters Local 312 V. Matlack, Inc., Amy Markel

The doctrine of functus officio was developed at common law in response to concerns about the "solemnity of judgments" and the effect of outside influences on arbitrators' decisions.2 Although not strictly applied in arbitration that is conducted pursuant to the Labor Management Relations Act,3 the doctrine of functus officio prevents an arbitrator from vacating, modifying, supplementing, or correcting his award . Most courts recognize three narrow exceptions to the doctrine which allow an arbitrator to revisit his award under limited circumstances. The objective of this research is to characterize surfaces of metals after interaction with hydrogen isotopes. Iron, which does not readily bond with hydrogen, and palladium, which strongly bonds with hydrogen, were studied. Observations of surfaces are used to determine the nature of their metamorphosis due to such exposures. An experimental study of pure iron foil (99.99%) exposed to a hot, dense hydrogen and argon gas mixture in a ballistic compressor yielded evidence for new structural and compositional changes of the metal due to the exposure. Atomic force microscope (AFM) studies demonstrated surfaces to be highly uneven, where height variations …

The Americans with Disabilities Act (ADA) was passed in 1990 to expand the reach of the Rehabilitation Act of 1973 and make discrimination on the basis of disability unlawful. The wheelchair symbol has become a universal sign of disability, but there are, of course, many types of disability that have been the basis of discrimination over the years, including blindness, deafness, epilepsy, cancer, heart disease, and mental retardation. AIDS is a disability under the ADA, and most commentators have assumed that infection with the human immunodeficiency virus (HIV) also qualifies as a disability under this act. In 1990, following Iraq's invasion of Kuwait, the Department of Defense (DOD) sought a waiver of the informed consent requirements of existing human experimentation regulations from the Food and Drug Administration (FDA). With this waiver, DOD could authorize military use of investigational drugs and vaccines on soldiers involved in the Gulf War without their informed consent. The basis of the waiver request was military expediency. In DOD's words: "In all peace time applications, we believe strongly in informed consent and ethical foundations... but military combat is different." The human rights issues raised by the conduct of maternal-fetal human immunodeficiency virus transmission trials in Africa are not unique to either acquired immunodeficiency syndrome or Africa, but public discussion of these trials presents an opportunity for the United States and other wealthy nations to take the rights and welfare of impoverished populations seriously. The central issue at stake when developed countries perform research on subjects in developing countries is exploitation. Autopoiesis And The "Relative Autonomy" Of Law, Hugh Baxter

Recent accounts of the relation between law and other social spheres have emphasized law's "relative autonomy." The intuition behind the "relative autonomy" formula is that law is neither wholly independent of, nor entirely reducible to, political, economic and other social processes. Sensible as this intuition is, however, the idea of "relative autonomy" by itself remains purely negative. It excludes two unpalatable extremes – pure formalism and pure instrumentalism – but it does not by itself characterize, in positive theoretical terms, the relation between law and other social discourses or practices.

One perspective on the Supreme Court is to see it as a manager of legal change. At a particular time, and with respect to a particular issue of federal law, a majority of Justices may coalesce around a law-transforming project. Because the Court enjoys nearly complete control over its docket, such a coalition of Justices may select carefully the cases most advantageous to the law -transforming project. And because the Court's pronouncements on matters of federal law are binding on all other interpreters, the Court may enforce its legal transformation by exercising its disciplinary powers of review. Grand Forks, North Dakota is located on glacio-lacustrine clays and other assorted sediments. This design project focuses on determining levee height safely supported in this geologic setting. Maximum levee height above the most unsuitable foundation materials was determined using two modifications of Terzaghi's Ultimate Bearing Capacity Equation. Allowable levee heights with desired construction safety factors are less than heights necessary to protect against a 1997 magnitude flood.

In many dioecious plant populations, males and females appear to be spatially segregated, a pattern that is difficult to explain given its potentially high costs. However, in asexually propagating species, spatial segregation of the sexes may be indistinguishable from superficially similar patterns generated by random establishment of a few genets followed by extensive clonal spread and by gender-specific differences in rates of clonal spread. In populations where a significant fraction of individuals are not flowering and gender cannot be assigned to this fraction, apparent spatial segregation of the sexes may be due to differential flowering between the sexes.
