A Case Study Of An Electively Mute Child, Robert Driscol Jan 1998

A Case Study Of An Electively Mute Child, Robert Driscol

Graduate Research Papers

Selective mutism is characterized by the appropriate use of language in certain settings, with a consistent lack of language use elsewhere. The child is often viewed as shy, and it is assumed that the shyness is temporary and will be outgrown. The purpose of this paper is to explore the problem of selective mutism in school aged children for whom silence may extend for many months or even years. Selective mutism will be further defined, and frequency, duration, and a summary of treatment methods will be discussed. A case study that illustrates positive outcomes of a behavioral approach will also …

Hematite And Calcite Coatings On Fossil Vertebrates, B. A.O. Huiming, Paul L. Koch, Robert P. Hepple

Faculty Publications

Hematite coatings are common on vertebrate fossils from Paleocene/Eocene paleosol deposits in the Bighorn Basin, Wyoming. In general, hematite coatings are found only on fossils and are limited to soils exhibiting hydromorphic features and moderate maturity. Pétrographie and isotopic evidence suggests that hematite and micritic calcite formed at nearly the same time in a pedogenic environment, whereas sparry calcite formed later at greater burial depths. The parent material of paleosols is rich in iron, supplying an ample source of iron for hematite formation. Decomposition of animal tissues around bones may enhance the weathering of iron-bearing minerals in soils surrounding carcasses, …

Journal of the American Society for Church Growth

Building networks of partnerships for effective ministry in the 21st Century is often discussed within the context of denominations. This article discusses the theory of networking and how to apply it in practice.

Dreaming In Black And White: Racial-Sexual Policing In The Birth Of A Nation, The Cheat, And Who Killed Vincent Chin?, Robert S. Chang Jan 1998

Dreaming In Black And White: Racial-Sexual Policing In The Birth Of A Nation, The Cheat, And Who Killed Vincent Chin?, Robert S. Chang

Faculty Articles

Professor Chang observes that Asians are often perceived as interlopers in the nativistic American "family." This conception of a nativist "family" is White in composition and therefore accords a sense of economic and sexual entitlement to Whites, ironically, even if particular beneficiaries are recent immigrants. Transgressions by those perceived to be "illegitimate," such as Asians and Blacks, are policed either by rule of law or the force of sanctioned vigilante violence. Chang illustrates his thesis by drawing upon the three films referenced.

Compelled Lawyer Representation And The Free Speech Rights Of Attorneys, Leora Harpaz Jan 1998

Compelled Lawyer Representation And The Free Speech Rights Of Attorneys, Leora Harpaz

Faculty Scholarship

This Article examines the Supreme Court's decision in Hurley v. Irish-American and compares it to the decision in Stropnicky v. Nathanson. It then considers whether there are sufficient distinctions between the two cases so as to defeat the First Amendment argument that was successful in Hurley. It concludes that the differences between the two cases are not sufficiently significant from the point of view of the First Amendment and that the application of the state public accommodation statute to a lawyer's ideologically motivated decision not to represent a client violates the First Amendment.

Lawyer Discrimination Against Clients: Outright Rejection--No; Limitations On Issues And Arguments-Yes, Sam Stonefield Jan 1998

Lawyer Discrimination Against Clients: Outright Rejection--No; Limitations On Issues And Arguments-Yes, Sam Stonefield

Faculty Scholarship

The issue of lawyer discrimination brings new perspectives to traditional topics like the practice of law, the role of the lawyer and the relationship with, and rights of, the client. It forces us to examine the nature of lawyer discretion, the limits of that discretion and the consequences of trying to regulate that discretion. The examinationis a daunting task. This essay offers an approach that attempts to protect both the prohibition against discrimination and the practice of law and to accommodate the tension that necessarily accompanies this effort. It suggests that the best solution is to prohibit lawyers from discriminating …

Constitutional Qualms Concerning: Government Restrictions On Tobacco Product Advertising, Barbara A. Noah

Faculty Scholarship

This Article evaluates the constitutionality of a representative series of congressional proposals to limit tobacco advertising. Federal legislation codifying the tobacco settlement included possible restrictions on outdoor advertising, a prohibition on the use of cartoon images, permitting only tombstone format for advertisements in publications that target a youth audience, a prohibition on the sale or gift of promotional items bearing tobacco product names or logos, a ban on industry sponsorship of sporting and other cultural events, and restrictions on Internet promotions. The Author suggests that upon seeking to prevent tobacco companies from encouraging illegal tobacco use by minors, the FDA's …

Tangible Or Intangible - Is That The Question - Conflict In The Texas Tax Classification System Of Computer Software Comment., Christine E. Reinhard

St. Mary's Law Journal

This Comment evaluates tax classification of computer software in Texas under recent statutory provisions and case law. The author focuses on whether computer software constitutes tangible or intangible property and whether computer software should be taxable or not. Determining property classification is not easy—the term “computer software” is difficult to define, and the multitude of different types of computer software further obscures the formation of a uniform definition. The Texas legislature’s ability to tax both tangible and intangible property makes classifying computer software as either type unnecessary. Texas can resolve the conflict in its tax classification system, wherein computer software …
