Who Put The Right In Right Of Publicity?, Diane L. Zimmerman Jan 1998

Who Put The Right In Right Of Publicity?, Diane L. Zimmerman

Faculty Articles

Although winning a place in the Restatement (Third) of Unfair Trade Practices will undoubtedly push the tort toward more uniform definition and broader adoption (state courts and legislators alike having a tendency to treat restatements as if they were a kind of ur-law), it can nevertheless be argued that reports of publicity as established law, like reports of Mark Twain's death, have been greatly exaggerated. What is also exaggerated, I would argue, is the characterization of the questions that persist about the value and validity of the publicity right as the rearguard indulgence of a few cranky academics and an …

The Workplace In A Racially Diverse Society: Preliminary Thoughts On The Role Of Labor And Employment Law, Cynthia Estlund Jan 1998

The Workplace In A Racially Diverse Society: Preliminary Thoughts On The Role Of Labor And Employment Law, Cynthia Estlund

Faculty Articles

But the workplace is perhaps the most important sphere in which significant integration has taken place. A combination of legal pressures, primarily driven by Title VII of the Civil Rights Act of 1964, and voluntary efforts have made the workplace an arena of comparative integration. Moreover, it is an arena in which individuals interact on a daily basis, often over years, within a common enterprise which necessitates, to varying degrees, trust and cooperation. The workplace is thus one of the very few settings in which adults spend a significant amount of time interacting intensively and constructively with others from different …

General Principles And International Uniform Commercial Law Conventions: A Study Of The 1980 Vienna Sales Convention And The 1988 Unidroit Conventions On International Factoring And Leasing, Franco Ferrari Jan 1998

General Principles And International Uniform Commercial Law Conventions: A Study Of The 1980 Vienna Sales Convention And The 1988 Unidroit Conventions On International Factoring And Leasing, Franco Ferrari

Faculty Articles

Among the most important conventions on uniform commercial law in force are the 1980 United Nations Convention on Contracts for the International Sale of Goods and the two 1988 Ottawa Conventions: International Factoring and International Financial Leasing. The CISG assumes importance due to its great success. This is evidenced by the number of contracting States and by the attention it has drawn from scholars and judges alike. The Ottawa Conventions are also of notable importance, as they constitute the most recent uniform commercial law conventions to come into force. This article examines the relationship between the general principles and these …

The Concept Of Compliance As A Function Of Competing Conceptions Of International Law, Benedict Kingsbury Jan 1998

The Concept Of Compliance As A Function Of Competing Conceptions Of International Law, Benedict Kingsbury

Faculty Articles

The purpose of this article is to challenge the tendency in the existing literature to view "compliance" simply as "correspondence of behavior with legal rules." This tendency is intelligibly based in a theoretical view that law can properly be defined and understood as a body of rules and expresses a practical concern to get on with the important task of producing empirical studies of compliance. The logical corollary is that a reasonable degree of conformity between these rules and actual behavior is necessary to an efficacious legal system, so that recurrent and widespread non-conformity with rules would usually call into …

The Jew Taboo: Jewish Difference And The Affirmative Action Debate, Deborah Malamud Jan 1998

The Jew Taboo: Jewish Difference And The Affirmative Action Debate, Deborah Malamud

Faculty Articles

One of the most important questions for a serious debate on affirmative action is why certain minority groups need affirmative action while others have succeeded without it. The question is rarely asked, however, because the comparison that most frequently comes to mind-i.e., blacks and Jews-is seen by many as taboo. Daniel A. Farber and Suzanna Sherry have breached that taboo in recent writings. Professor Malamud's Article draws on work in the Jewish Studies field to respond to Farber and Sherry. It begins by critiquing their claim that Jewish values account for Jewish success. It then explores and embraces alternative explanations-some …

Sex Discrimination And Insurance For Contraception, Sylvia A. Law Jan 1998

Sex Discrimination And Insurance For Contraception, Sylvia A. Law

Faculty Articles

Unintended pregnancy is a serious problem in the United States. Most private insurance plans do not pay for contraception even though they pay for other prescription drugs and devices. This Article argues that this pattern constitutes sex discrimination and is prohibited by Title VII of the Civil Rights Act of 1964, as amended by the Pregnancy Discrimination Act. It discusses the reasons this issue has been neglected and suggests ways federal and state officials might remedy this common form of gender discrimination.

Before Cyberspace: Legal Transitions In Property Rights Regimes, Richard A. Epstein Jan 1998

Before Cyberspace: Legal Transitions In Property Rights Regimes, Richard A. Epstein

Faculty Articles

The innovations of technology neither preclude nor require fundamental transformations in the legal regime that governs them. In all cases the key issue can be framed as follows: because transitions in legal regimes are always costly and sometimes go astray, can one show that the rules of the past are so ill-fitting that some conscious and costly deviation from them is appropriate? No categorical answer is possible, for so much depends on how ill-fitting the old legal system is, how painful the transition is, and how well the new system would operate. The best we can do is to establish …

The 69 Millisecond Radio Pulsar Near The Supernova Remnant Rcw 103, V. M. Kaspi, Fronefield Crawford Jan 1998

The 69 Millisecond Radio Pulsar Near The Supernova Remnant Rcw 103, V. M. Kaspi, Fronefield Crawford

Physics Faculty Scholarship

We report the detection of the radio pulsar counterpart to the 69 ms X-ray pulsar discovered near the supernova remnant RCW 103 (G332.4-0.4). Our detection confirms that the pulsations arise from a rotation-powered neutron star, which we name PSR J1617-5055. The observed barycentric period derivative confirms that the pulsar has a characteristic age of only 8 kyr, the sixth youngest of all known pulsars. The unusual apparent youth of the pulsar and its proximity to a young remnant require that an association be considered. Although the respective ages and distances are consistent within substantial uncertainties, the large inferred pulsar transverse …

Making Meaning Transformative Art Education For Middle School, Julia Marshall Jan 1998

Making Meaning Transformative Art Education For Middle School, Julia Marshall

Doctoral Dissertations

The problems this study addresses are the purpose and the methodology of contemporary art education in middle school. The research explores art-making as a potent teaching/learning process when used in critical pedagogy and participatory research. The study seeks to inquire into the world of the young adolescent, identifying the needs, issues and problems specific to middle school age students. It does this through using personal and communal life as the subject of art-making and reflection. Specifically, the study looks at what students discover about themselves and each other and the strategies that facilitate that discovery. The study examines how art …

Measured And Simulated Performance Of Reflective Roofing Systems In Residential Buildings, Florida Solar Energy Center, Danny Parker Jan 1998

Measured And Simulated Performance Of Reflective Roofing Systems In Residential Buildings, Florida Solar Energy Center, Danny Parker

FSEC Energy Research Center®

A series of experiments in Florida residences have measured the impact on space cooling of increasing roof solar reflectance. In tests on 11 homes with the roof color changed mid summer, the average cooling energy use was reduced by 19%. Measurements and infrared thermography showed that a significant part of the savings were due to interactions when the duct system is located in the attic space. An improved residential attic and duct simulation model, taking these experimental results into account, has been implemented in the DOE-2.1E building energy simulation program. The model was then used to estimate the impact of …
