Compensation And The Interconnectedness Of Property, Thomas W. Merrill Jan 1998

Compensation And The Interconnectedness Of Property, Thomas W. Merrill

Faculty Scholarship

Professor Joseph Sax's scholarship on the Takings Clause combines the craft of a first-class lawyer with the passion of a visionary. The good lawyer that he is, Sax's scholarship reflects a deep understanding of Supreme Court case law, legal history, and the practical dimensions of various kinds of land use disputes. Yet his work on takings is not animated by any desire for mere doctrinal tidiness. It is driven by a distinctive vision – one in which the earth's resources are becoming increasingly interconnected and in which there is an increasing need for the government to resolve conflicts regarding the …

Putting Sex To Work, Katherine M. Franke Jan 1998

Putting Sex To Work, Katherine M. Franke

Faculty Scholarship

When I was living in New Haven a number of years ago, a miracle happened that drew people by the thousands to witness evidence of the Divine. A crucifix had been found to appear in the body of an oak tree in the middle of Worchester Square. I went – after all, how often do you get to see that kind of thing? Not surprisingly, at first I couldn't see anything but the usual trunk and limbs of a tree. Yet a believer took the time to show me what was really there, something that my untrained eye could not …

The Internal Relations Of Government: Cautionary Tales From Inside The Black Box, Peter L. Strauss Jan 1998

The Internal Relations Of Government: Cautionary Tales From Inside The Black Box, Peter L. Strauss

Faculty Scholarship

Both the structure of the Constitution and elementary civics texts imagine an Executive Branch under the close, unitary control of an elected chief executive, the President. Doubtless from the start, and unmistakably in the administrative state, the reality has been quite different. Those to whom Congress has delegated authority to act, particularly in that domain that we have in mind when invoking a "government of laws," conduct their business within a web more aptly described as coordination than control. In regulatory matters, the coordinating impulses run through the Department of Justice ("DOJ") and, increasingly, the Office of Information and Regulatory …

Generations Of Families: A Teaching Project And Photograph Exhibition, Carolyn P. Edwards, Kay Springate

Department of Child, Youth, and Family Studies: Faculty Publications

"Generations of Families" was a collaborative project involving university and community partners. University of Kentucky students worked with public and private local agencies, leaders, and citizens to collect, catalog, label, and display treasured family photographs of local citizens. The final product consisted of five separate displays totaling hundreds of framed or mounted photographs. The project supported the development of cross-cultural competence and professional skills by Family and Consumer Sciences students. The project achieved significant impact, as measured by community response, exit interviews, and analysis of student journals.

Placental Xenobiotic And Steroid Metabolism In Normal And Diabetic Patients., Donna Jean Mcrobie-Belle Jan 1998

Placental Xenobiotic And Steroid Metabolism In Normal And Diabetic Patients., Donna Jean Mcrobie-Belle

Graduate Theses, Dissertations, and Problem Reports (ETD)

The primary function of the human placenta is to ensure an optimal environment for fetal growth and development. Nutrients, endogenous substances and xenobiotics enter the placenta via the maternal circulation. The placenta possesses the ability to metabolize a number of xenobiotics and endogenous compounds by processes (cytochrome P450 enzymes and/or glutathione conjugation pathways) similar to those in the liver. Although the metabolites produced are usually inactive, reactive or toxic metabolites may also be generated. Therefore, changes in placental enzymatic function could alter fetal exposure to these reactive/toxic metabolites. Animal and in vivo human studies suggest diabetes alters the liver's xenobiotic …

Patterns Of Time, Place, And Culture: Land Use Zoning In Portland, Oregon, 1918-1924, Meg Merrick Jan 1998

Patterns Of Time, Place, And Culture: Land Use Zoning In Portland, Oregon, 1918-1924, Meg Merrick

Dissertations and Theses

Until recently, few have questioned the notion that the separation of uses in land use zoning is inherently correct. Many observers of the city are now suggesting that zoning, as it has been practiced in this country over the last 80 years, has created cities that are fractured and function poorly. Others propose that zoning should be reconsidered as a remedy for urban dysfunction. They suggest that the whole notion of zoning be rethought.

The purpose of this study is to uncover some of the underlying rationales and methodologies that set the model for zoning. This study examines the rationales …

Mormon Mortuary Patterns At The Block 49 And Seccombe Lake Cemeteries, Howard S. Irvine Jan 1998

Mormon Mortuary Patterns At The Block 49 And Seccombe Lake Cemeteries, Howard S. Irvine

Theses and Dissertations

Death customs perform a socially restorative function among cultures and are a meaningful expression of the value system of any particular culture. Death studies allow the examination of the values considered most significant by the studied culture. This thesis will examine and interpret the material culture recovered at two small cemeteries: Block 49, Utah, and Seccombe Lake, California. One result will show the material manifestation of Mormon religious beliefs in their mortuary practices. The final goal is to suggest that a more thorough examination of a religious sect's beliefs can create a general model of mortuary practices for that religious …

Utopian Marriage In Nineteenth-Century America: Public And Private Discourse, Brenda Olsen Andrus Jan 1998

Utopian Marriage In Nineteenth-Century America: Public And Private Discourse, Brenda Olsen Andrus

Theses and Dissertations

This thesis is a rhetorical analysis of utopian discourse about marriage in mid-nineteenth-century America. Although utopian communities are usually approached within the fields of history and sociology, a rhetorical analysis adds to the discussion by uncovering the discursive complexity of marriage beliefs within a rapidly changing culture. Discursive features of the Shaker, Oneida Community and Latter-day Saint texts are outlined and compared according to the following format:

Chapter One examines the textures of conflict within the dominant culture's views of marriage and gender roles in nineteenth-century America, with a brief overview of reform efforts of the day. This chapter provides …

Instigating Change In A Globalised Social Environment : The Impact Of Globalisation Upon The Promotion Of Vegetarianism In The United Kingdom, Andrew David Smart Jan 1998

Instigating Change In A Globalised Social Environment : The Impact Of Globalisation Upon The Promotion Of Vegetarianism In The United Kingdom, Andrew David Smart

School of Law, Humanities and Social Sciences Theses

In this thesis I examine globalisation as an ongoing social change to understand how it is routinely reproduced by social actors. To do this I consider the impacts of globalisation in an existing social setting and use a conceptual framework from the sociological literature to interpret and explain the evidence. The empirical materials were gathered during an ethnographic case study of The Vegetarian Society - an interest group that actively promoted social change by presenting everyday individual food consumption in the manner of reflexive 'life politics'. I use the concepts of 'interpenetration', 'relativisation', 'detraditionalisation' and 'institutional reflexivity' to indicate that …

The Role Of Educational Technology And Motivation In Increasing Flow And Time-On-Task To Enhance Learning, Michael Pullmann Jan 1998

The Role Of Educational Technology And Motivation In Increasing Flow And Time-On-Task To Enhance Learning, Michael Pullmann

Dissertations and Theses

Technology plays an increasing role in college courses. Student experiences and outcomes may be significantly altered by high-tech course presentation and flexible formats. Models from psychology, such as Csikszentmihalyi's flow theory are useful for understanding quality of experience. Dweck's motivation theory explains why some students may not experience the flow state during school work. The purposes of this study were to: 1) Determine if students in technology-enhanced courses differ from other students on the experience of flow, 2) Test the relationship between flow, motivation orientation, and time-on-task, and 3) Test the relationship between motivation orientation, time-on-task, and student outcomes.
