Using International Human Rights Law And Machinery In Defending Borderless Crime Cases, Richard J. Wilson

Scholarly Articles in Law Reviews & Journals

This Essay focuses on four areas of international human rights law. The first area, the protection of attorneys’ fees from forfeiture, is an issue of great concern in the United States, given the state of the law there. The next area, the application of the death penalty in international law, will also include arguments about the “death row phenomenon.” The third area addressed is the use of international human rights law to overcome the rule of non-inquiry in extradition matters, a rule by which the judicial authority reviewing the propriety of extradition is barred from inquiry into the fairness of …

Who Is Black Enough For You? An Analysis Of Northwestern University Law School's Struggle Over Minority Faculty Hiring, Leonard M. Baynes Jan 1997

Who Is Black Enough For You? An Analysis Of Northwestern University Law School's Struggle Over Minority Faculty Hiring, Leonard M. Baynes

Michigan Journal of Race and Law

This Article considers the factors that should be used in hiring a person of color to a faculty position and raises the following questions: Apart from potential teaching ability and scholarly productivity, should faculty appointments committees look to other criteria for candidates of color? Provided that we can still consider the race and ethnicity of prospective candidates of color at private institutions, should faculty appointments committees be concerned about how closely identified a candidate is to an essentialized conception, for instance, of Black persons? Should a faculty hiring committee focus its efforts to hire African Americans on a Black person …

An Analysis Of The Supreme Court's Reliance On Racial "Stigma" As A Constitutional Concept In Affirmative Action Cases, Andrew F. Halaby, Stephen R. Mcallister Jan 1997

An Analysis Of The Supreme Court's Reliance On Racial "Stigma" As A Constitutional Concept In Affirmative Action Cases, Andrew F. Halaby, Stephen R. Mcallister

Michigan Journal of Race and Law

The Article's focus is confined to discussions of race-based affirmative action; it does not consider stigmatization arguments in the context of discrimination involving gender or disabilities, for example. Further, the Article's scope is limited to the stigmatization issue as between Whites and African Americans. Although similar issues exist with respect to other ethnic or racial groups, we view the White/African American paradigm as providing the clearest framework for analysis. Moreover, the cases of Plessy v. Ferguson and Brown v. Board of Education, joint progenitors of stigmatization as a concept having constitutional significance in interpreting the Equal Protection Clause of …

The Effects Of Human-Computer Communication Mode, Task Complexity, And Desire For Control On Performance And Discourse Organization In An Adaptive Task, Cristina Bubb-Lewis

Psychology Theses & Dissertations

The present study examined how different communication patterns affected task performance with an adaptive interface. A Wizard-of-Oz simulation (Gould, Conti, & Hovanyecz, 1983) was used to create the impression of a talking and listening computer that acted as a teammate to help participants interact with a computer application.

Four levels of communication mode were used which differed in the level of restriction placed on human-computer communication. In addition, participants completed two sets of tasks (simple and complex). Further, a personality trait, Desire for Control (DC), was measured and participants were split into high and low groups for analysis. Dependent measures …

Fifteen male nursing students from four baccalaureate nursing schools in West Virginia participated in this phenomenological study. The phenomena of interest was the lived experiences of male student nurses related to caring. Demographic data was obtained in the interview process. Semistructured interview questions were used in the individual interviews, which were all audiotaped. The methodology used was based on the Swanson-Kauffman and Schonwald method, which entailed the four step process of bracketing, analyzing, intuiting, and describing. Five themes were identified. The Primacy of Caring was the first theme. Characteristics of caring, the origins of caring, the lived experiences of caring …

A Signal Detection Analysis Of Body Image Distortion Among Women With Bulimia Nervosa., Lynda Anne Szymanski Jan 1997

A Signal Detection Analysis Of Body Image Distortion Among Women With Bulimia Nervosa., Lynda Anne Szymanski

Graduate Theses, Dissertations, and Problem Reports (ETD)

The clinical conceptualization of body-image distortion among persons with eating disorders typically emphasizes sensory disturbances and de-emphasizes nonsensory, environmental variables. The present study examined body-size misperceptions using a signal detection paradigm in 20 women with bulimia and 20 women without present symptomology or history of an eating disorder. First, subjects estimated their body sizes using a video distortion camera. Second, each subject judged how similar or dissimilar each of 192 distorted and undistorted images was to her actual body size using a 5-point rating scale. The second phase of the study was repeated with one-half of the subjects given instructions …

Graduate Theses, Dissertations, and Problem Reports (ETD)

This was a qualitative study designed to explore how women at various stages of lesbian identity development manage and make decisions about managing their identities. Management of identity was explored in terms of how women came out or stayed hidden and how they made decisions to both disclose and conceal. It used Cass' (1979) Stage Allocation Measure, based on her model of homosexual identity development, as a means to categorize women at various stages of lesbian identity development. Twenty-five adult women were individually interviewed, using a semi-structured interview schedule. In addition, participants agreed to maintain a journal for one month …

A Comparative Study Of The Development Of Educational Psychology In China And America., Huiping Liu Cervenka Jan 1997

A Comparative Study Of The Development Of Educational Psychology In China And America., Huiping Liu Cervenka

Graduate Theses, Dissertations, and Problem Reports (ETD)

Some people argue that Western psychology and Asian psychology are fundamentally different and irreconcilable. Western psychology is scientific and analytic-reductionistic, while Asian psychology is concerned with man's harmony{dollar}\\...{dollar} (in Paranjpe et al, 1988, p18). This study examines and compares the scientific roots of Western psychology and the humanistic roots of Asian psychology in an attempt to determine commonality between Chinese and American educational psychology. A historical comparative method is used in this study. Two approaches, the personalistic and the naturalistic are employed to examine the development of educational psychology in China and America. Inter-Rater Reliability, Sensitivity To Student Growth, And Concurrent Validity Of The Competent Learner Repertoire Assessment Level Two., Joseph Wesley Deem

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of this study is to determine if two independent raters can reliably score the Competent Learner Repertoire Assessment Level 2 (CLRA), if the CLRA is sensitive to student growth over time, and to analyze if the CLRA concurs with another adaptive behavior assessment. To answer these questions the behavior of approximately 159 preschool students in a large Southern California school district will be assessed with the CLRA. The researcher proposes to evaluate inter-observer reliability by comparing scores on each CLRA item. The scores will be recorded by each of four teacher, associate teacher (paraprofessional aides) pairs across a …

Escaping Poverty & Becoming Self-Sufficient, Richard K. Caputo Jan 1997

Escaping Poverty & Becoming Self-Sufficient, Richard K. Caputo

The Journal of Sociology & Social Welfare

Using logistic regression analysis on data from the National Longitudinal Survey of Youth, this study found that sociodemographic factors were far more influential in determining escape from poverty and becoming self sufficient than social psychological factors. The number of years respondents lived in poverty was the best predictor of escaping poverty, while the number of years respondents made use of public assistance programs was the best predictor of becoming self-sufficient. Marital status and change in the number of hours worked influenced the prospect for escaping poverty, though not becoming self-sufficient. Implications regarding the changing philosophy of social welfare from income …
