Online Law: The Spa's Legal Guide To Doing Business On The Internet, Thomas J. Smedinghoff, Tom W. Bell

Richmond Journal of Law & Technology

Attorneys and academics have of late benefitted from a surge in the number of texts discussing the emerging law of the Internet. Online Law: The SPA's Legal Guide To Doing Business On The Internet, edited by Thomas J. Smedinghoff and published by the Software Publishers Association, represents a particularly welcome contribution. It achieves its limited goals about as well as any paper-bound book could--and does so at a nicely limited price.

The Communications Decency Act: Aborting The First Amendment?, Sheryl L. Herndon L. Herndon Jan 1997

The Communications Decency Act: Aborting The First Amendment?, Sheryl L. Herndon L. Herndon

Richmond Journal of Law & Technology

On February 8, 1996, President Clinton signed the Telecommunications Act of 1996 into law and explained that the legislation would "stimulate investment, promote competition, [and] provide open access for all citizens to the Information Superhighway." However, contrary to the goal of "opening wide the door to the Information Age," provisions of the Act violate the Constitution's First Amendment guarantee of freedom of speech by imposing far-reaching new federal criminal liabilities on Americans who exercise their free speech rights on the Internet. In particular, a little-noticed provision of the Act, which expands an 1873 law banning abortion-related speech by criminalizing Internet …

How Have The Procedural Aspects Of The Telecommunications Act Of 1996 Worked?, Clinton Miller, Charles H. Carrathers Iii, Michael Schwarzwalder, Rod Johnson, Jill Butler

Richmond Journal of Law & Technology

Good morning. I am Clinton Miller. I'm one of the three members of the Virginia State Corporation Commission and charged with moderating this next panel. I will give you a brief overview before they begin because there may be some people in the room who are not deeply familiar with the procedural aspects of the Telecommunication Act of 1996.

Local Franchising: What Role Will Localities Play In The Regulations Of The Telecommunications Industry? Will They Become Providers Of Telecommunications Service To The Public?, Anthony Gambardella, Dana G. Coltrin, Timothy M. Kaine, David W. Ogburn Jr.

Richmond Journal of Law & Technology

Good morning, everybody. I am Tony Gambardella with the firm of Woods, Rogers & Hazelgrove in Richmond--formerly with the State Corporation Commission. We started yesterday's discussion with the promise of the Telecommunications Act of 1996. The main promise was, as of February 8, 1996, Congress had deregulated the telecommunications industry. The problem with the promise is that Congress retained some regulation within the industry. We have regulation at the federal level. We have a huge state role and this morning we are going to add another level--local government. Local governments have a role under the Act. There is some dispute …

State Criminal Laws In Cyberspace: Reconciling Freedom For Users With Effective Law Enforcement, Sean M. Thornton Jan 1997

State Criminal Laws In Cyberspace: Reconciling Freedom For Users With Effective Law Enforcement, Sean M. Thornton

Richmond Journal of Law & Technology

With the proliferation of online activities in recent years, legal thinkers and the criminal justice system have faced new questions concerning the conflict of state criminal laws. These new questions have old answers; the doctrine of constructive presence has established a state's authority to prescribe an out-of-state activity that has in-state effects. Beyond the mechanical application of jurisdictional rules, however, there lie deeper policy questions concerning the fairness of subjecting computer users to multiple, inconsistent bodies of law. Cyberspace exists in all jurisdictions, and in no particular jurisdiction, at once. There is an apparent tension between the free flow of …

The Impact Of Training Methods And Leadership Skills On The Role Of Empowerment In The Workplace, Rae J. Delaney

Theses

Given the dynamic nature of the business environment, companies must never make the mistake of thinking that strategies that .have been proven successful in the past will be effective for all time. They need flexibility, speed, responsiveness and openness to new technology to deal with uncertainty.

It is imperative the managers create an atmosphere of empowerment. By giving employees the responsibility and the authority to get things done their way, employees will feel as if they are valued and trusted employees. To encourage employee empowerment, management must make available training and leadership seminars that will encourage and stimulate employee empowerment.

The Fearful Symmetry Of Gay Rights, Religious Freedom, And Racial Equality, Walter J. Walsh Jan 1997

The Fearful Symmetry Of Gay Rights, Religious Freedom, And Racial Equality, Walter J. Walsh

Articles

A decade has now passed since Julia Cooper Mack authored her most controversial judicial opinion, Gay Rights Coalition of Georgetown University Law Center v. Georgetown University. That opinion provoked two acts of Congress aimed at its reversal, newspaper editorials from coast to coast, and over one hundred scholarly authors debating its wisdom. In this short essay, I shall suggest that this extended hermeneutic debate has yet to touch upon the deepest implications of Judge Mack's Georgetown opinion. While recent scholarship on this story praises Judge Mack's unusual ability to reconcile clashing interest groups, a more accurate account might be …

Vitellogenin Titres In Normal And Accelerated Maturation Of Gragarious-Phase Schistocerca Gregaria, Hassane Mahamat, Ahmed Hassanali, Hans Joerg Ferenz

All Peer-Reviewed Publications

Isolation of vitellogenin of the Schistocerca gregoria (Forskal) in its gregarious phase was achieved by a combination of gel permeation and anion exchange chromatography. Staining for carbohydrate and lipid moieties showed that the vitellogenin is a glycolipoprotein. The vitellogenin of S. gregaria has a native molecular weight of about 700 kDa. On SDS-PAGE, the protein showed nine apoproteins of about 124, 120, 105, 60, 59, 58, 57, 53 and 34 kD. Determination of the levels of vitellogenin by ELISA in the haemolymph of maturing females showed that those exposed to mature males from 1 to 2 days after ecdysis had …
