In this Introduction, the author discusses how the collection of essays provide insightful analysis of biological, legal, and public health issues surrounding mandatory testing of pregnant women and infants for HIV. As background, beginning February 1, 1997, New York ordered that every newborn in the state be tested for HIV-antibodies. In addition, the results are disclosed to the delivering mother, her physician, and her child’s physician, thus raising difficult ethical and policy questions for the Symposium panel.

The relationship between a pregnant woman and her fetus is unlike any other in law, medicine, or ethics. This Article examines the complexity of the maternal-fetal conflict, focusing on the interests of the woman and the sometimes conflicting interests of her fetus. Part I discusses the typical analytical background of the conflict, explaining the various ethical principles, rights, and obligations involved such as autonomy, beneficence and nonmaleficence, and justice. Part II explores the various choices made by the pregnant woman, as well as the state’s attempts to regulate those choices on behalf of the fetus. This Article concludes that, while …

This Article explores the oftentimes mistaken notion that we can realistically identify severely ill individuals seeking physician-suicide who do so willingly, knowingly, and voluntarily. Medical science and medical practice support this proposition. To date, there exists no sound clinical basis for distinguishing suicidal patients with terminal conditions from suicidal patients without terminal conditions. Thus, it is a mistake to posit a reasonably identifiable patient population od adults with terminal diagnosis who can provide informed, voluntary consent to prescription lethal drugs. In practice, the medical community has failed to indentify and treat suicidal disorders. This Article concludes that suicide, including suicide …

In considering physician-assisted suicide, the real challenge lies in understanding the nature of culture itself. Missing from the debate is a discussion of the social consequences of hidden expectations and obligations with respect to access to health care, allocation of resources, terminal and chronic illness, disability, difference, suffering, and the nature of death itself. Local governments can play an important role in protecting surface water resources through their compliance with federal and state regulations and through their own land use planning and management practices. Despite 30 years of water quality initiatives in the Lake Erie basin, nonpoint source runoff from urban and urbanizing lands remains a problem. Loss of riparian corridor integrity is increasing as urban areas in the Lake Erie basin experience areal growth. The use and management of land, predominantly a local responsibility, directly affects surface water resources. Despite the failure of the 104th Congress to override President Clinton's veto and enact the Common Sense Product Liability Legal Reform Act, there is little doubt that such an Act will be passed by the 105th Congress. Uniform national laws concerning product liability are necessary, can be enacted consistent with Congressional authority, and should be enacted at the earliest possible time. A balanced Act, recognizing the need to protect injured consumers while providing necessary protection to product manufacturers and distributors, can be drafted. Such an Act could include provisions that abolish the consumer expectancy test for design defect litigation, reject …

Factors Influencing Activity Levels In Nasonia Vitripennis, Katherine Grimm

The effects of mating status and competition for suitable hosts on the overall activity and flight behavior of Nasonia vitripennis were investigated by observing the wasps' activity in a terrarium setting. N . vitripennis is a small, nonmigratory wasp that parasitizes fly pupae. This species, as well as other parasitoids, may be used in biological control of pest fly populations. Mated females were found to be significantly more active overall versus virgins for a duration of up to two hours after mating, regardless of whether or not the females were exposed to a suitable host. The genotypic diversity of beet curly top virus (BCTV) present in the western United States has been examined by the analysis if 58 field isolates and eight laboratory or nursery isolates of the virus. Full-length clones for each isolate have been characterized for genotype by restriction endonuclease mapping. Only variants of the CFH and Worland strains were recovered from field isolates. Variants of the Cal/Logan strain were found only in laboratory or nursery isolates.

Studies have been done on the decay rate of messenger RNA (mRNA), including the decay rate of EGF-R mRNA. Several factors in the 3’ untranslated region (UTR) have been suspected to affect the mRNA decay rate. However, no experiments have been done to determine exactly what portion of the 3’ UTR controls the decay rate. In order to study the effects of segments of 3’ UTR, it is necessary to start with EGF-R and complete 3’ UTR. The focus of this cloning procedure is to produce the EGF-R cDNA with complete 3* UTR. In American higher education, change is continuous but occurs most often at the margins, generally taking the form of piecemeal or isolated efforts and programs. Only rarely are change projects comprehensive in their scope and transformative in their effects. In this chapter we describe the context for comprehensive curricular change at Portland State University and offer a more general theoretical construct about institutional change in higher education. That there are so few examples of comprehensive institutional change in American higher education is indicative of the complex mix of internal and external factors that constrain change efforts. Under the Americans with Disabilities Act of 1990 and Section 504 of the Rehabilitation Act of 1973, colleges and universities are prohibited from discriminating against qualified students with learning disabilities and must reasonably accommodate such disabilities so that students have a genuine opportunity to complete academic programs successfully. Not surprisingly, just like their non-disabled peers, a number of learning disabled college graduates are choosing to enter professions such as law and medicine. Their entry into professional schools has raised a number of legal issues concerning their qualification to matriculate, their need for accommodations, and their eventual ability to practice successfully. …

Existing research suggests that a variety of environmental factors play an important role in cancer mortality. The association between some of these factors and cancer mortality was examined using data from the Charleston Heart Study, a thirty-five year prospective cohort. Baseline measurements for tobacco use, place of residence, occupation, education, water supply and physical activity were made in 1960/63 on 2,283 participants. The vital status of the cohort was ascertained through 1994, and the underlying cause of death as determined by the nosologist was used to define cancer mortality. There were 294 cancer deaths identified over the 35-year period. Statistical …

There is a direct correlation between the severity of common cold symptoms and the concentration of IL-8 in nasal secretions from volunteers with experimental human rhinovirus (hRV) colds. Although these and other data are consistent with the hypothesis that IL-8 is a mediator of common cold symptoms, the mechanism by which IL-8 is elaborated in response to hRV challenge is not understood. This study examined the role of oxidative stress and NF-κB activation in hRV induced IL-8 elaboration. The overall goal of this study was to investigate the roles of PLD and neutral SMase in signal transduction in T-lymphocytes. In particular, the abilities of phospholipid metabolites to regulate mitogen-activated protein kinases were explored. The tumor promoting PKC activator, phorbol 12-myristate 13-acetate (PMA), and an antileukemic drug, 1-β-D arabinofuranosylcytosine hydrochloride (Ara-C), were used as model phospholipase activators. The effects of phorbol ester and Ara-C on PLD and SMase activities were examined in EL4, a murine thymoma cell line, and Jurkat, a human leukemia cell line. PLD activity was measured in intact cells using a metabolic labelling assay. PLD and …
