Price Theory And Vertical Restraints: A Misunderstood Relation, Alan J. Meese

The Chicago School of antitrust analysis has exerted a strong influence over the law of vertical restraints in the past two decades, leading the Supreme Court to abandon much of its traditional hostility toward such agreements. Chicago's success has provoked a vigorous response from Populists, who support the traditional approach. Chicago, Populists claim, has improperly relied upon neoclassical price theory to inform the normative and descriptive assumptions that drive its analysis of trade restraints generally and of vertical restraints in particular. Biosystematics Of The Cotesia Flavipes Species Complex (Hymenoptera: Braconidae): Morphometrics Of Selected Allopatric Populations, Susan W. Kimani-Njogu, William A. Overholt, James Woolley, Annette Walker

Morphometric studies of allopatric populations of the Cotesia fiavipes species complex representing three putative species; C. flavipes Cameron, C. sesamiae (Cameron) and C. chilonis (Matsumura), were conducted. Sixteen characters were measured. Principal component analysis separated the complex into three somewhat overlapping groups that corresponded well with previous concepts of the species. Canonical variate analysis separated the complex into three distinct clusters with populations from Africa together, populations from Asia and the Neotropics forming a second cluster, and material from China and Japan forming a third cluster. The Mahalanobis squared distances between the three clusters were nearly equal. Results support recognition …

Geographic Variation In Host Selection Behaviour And Reproductive Success In The Stemborer Parasitoid Cotesia Flavipes (Hymenoptera: Braconidae), R. P.J. Potting, L. E.M. Vet, W. A. Overholt

Local parasitoid populations may be adapted to their sympatric major plant host complex. Parasitoid strains may thus differ in their propensity to search for a particular micro-habitat or host or they may differ in their physiological compatibility with particular plant or host species. Cotesiaflavipes Cameron, a larval parasitoid used worldwide in biological control against tropical stemborers, has a wide host range in diverse habitats. The existence of plant and/or host specific strains in C. flavipes has been postulated. This article strives to sort through the sundry ramifications of the law of misrepresentation. Accordingly, the three major classifications of misrepresentation - fraudulent, negligent, and innocent - will be differentiated clearly and then examined extensively. The elements constituting each category of misrepresentation action will be explained and illustrated. The article will focus upon the nature and extent of the tort action available to an aggrieved party who was induced to enter into a transaction or relationship by the misrepresentation of another. Imagine Jeff, a state prison inmate who is serving a twentyfive year sentence for armed robbery. During this time, he is ordered to appear before a prison disciplinary committee to face charges that he murdered another prisoner during a riot. Although Jeff is entitled to present his defense at this disciplinary hearing, he finds it difficult to prepare his case adequately because he does not know how to read or write. Since he cannot afford an attorney, Jeff seeks the help of a fellow inmate who has a reputation for being skilled in the law. This "jailhouse lawyer" counsels Jeff …

In recent decades there has been an increasing interest in the ethical dimensions of leadership. James MacGregor Burns' (1978) watershed work, Leadership, heralds an intellectual breakthrough for grasping the significance of a moral level of consciousness that is universal. Although Burns (1978) writes that humanistic psychology now allows for generalization about leadership process across cultures, there remains little research which frames leadership in a Global Ethic, in humanistic psychological constructs or as philosophical ideas of a universal ethical consciousness. Parenting experience is rarely valued or integrated with the work of a competitive society such as that of the United States. Despite the implementation of family-friendly workplace policies, institutional structures and practices continue to preclude the substantive acknowledgment of how parenting experience might contribute to the American workplace (Borrill & Kidd, 1994; Jenner, 1994; Rodgers, 1993). The dynamic complexity of parenting and the concomitant necessity to make constant response shifts and navigate incessant uncertainty, is not acknowledged as collateral for the responsiveness required by complex organizations. Managed Care is a generic term for a broad and constantly changing mix of health insurance, assistance and payment programs which seek to retain quality and access while controlling the cost of physical and mental health services. The introduction of managed care fundamentally transforms the traditional “agency” relationships on which modern social work was built. Little research on its impact on social services is currently available. The managed care model, with its distinctive external patterns of accountability, raises serious questions about the continuing viability of the “social agency” model of practice to which social work has been committed for most …
