Piercing Pareto Superiority: Real People And The Obligations Of Legal Theory, Jeffrey L. Harrison Apr 1997

Piercing Pareto Superiority: Real People And The Obligations Of Legal Theory, Jeffrey L. Harrison

UF Law Faculty Publications

This essay has two purposes. The first is to demonstrate that the appearance of mutual assent and Pareto Superiority are weak bases for enforcing agreements. Pareto Superiority, as unassailable as it may seem, is paper-thin and frequently based on illusions and a normatively meaningless assessment of what it means to be better off. The approach here is one of piercing Pareto Superiority in order to examine the human factors that may determine whether an agreement occurs and its distributive consequences. Relative deprivation is the instrument used. The second purpose is to suggest that it is the obligation of legal theory …

Structural Change And Inter-Professional Competitive Advantage: An Example Drawn From Residential Real Estate Conveyancing, Michael Braunstein

Missouri Law Review

This article examines the role of attorneys and other professionals in a highly structured and routine transaction-residential real estate conveyancing. The article explains how United States lawyers lost the monopoly they once enjoyed over residential real estate conveyancing and how structural change, whether economic, technological, or both, influences the demand for professional, including legal services. Part II of this article reviews the academic literature concerning the role of the lawyer in residential real estate transactions. Part III analyzes the structural changes that resulted in the marginalization of lawyers in the residential transaction and demonstrates how the change in structure of …

Playing The "Culture Card": Trials In A Mutli-Cultural Democracy, Richard O. Lempert Apr 1997

Playing The "Culture Card": Trials In A Mutli-Cultural Democracy, Richard O. Lempert

Articles

As I write, the racial divide in America is said to be greater than at any time in the past 25 years.' Two events are blamed: the O.J. Simpson criminal trial and the Louis Farrakan led "Million Man March." That these events should exacerbate racial division is extraordinary. The Farrakan led march brought together between 400,000 and 800,000 black males to pledge that they would take the kind of responsibility for their actions and their families that white Americans have long argued they should take. The O.J. Simpson trial was more a "who done it" than a racial morality play. …

School-Sponsored Service Programs And The Educational Development Of High School Students, Andrew Furco Apr 1997

School-Sponsored Service Programs And The Educational Development Of High School Students, Andrew Furco

Thesis, Dissertations, Student Creative Activity, and Scholarship

Currently, a growing number of our nation's school districts are encouraging students to perform community service. Vermont, Minnesota, and Pennsylvania, for example, all include community service activities as part of their K-12 education plans. Maryland requires all high school students to complete 60 hours of community service prior to graduation. And as part of California's Challenge Initiative, it is expected that by the Year 2004, every student in California will engage in at least one community service or service-learning experience prior to graduation (1996, California Department of Education).

Productive Physical Education Pedagogy Scholars: Why They Do It And How, Murrary F. Mitchell

Faculty Publications

The purpose of this study was to determine why and how a sample of physical education teacher education (PETE) scholars manage to be productive publishers. Authors or coauthors of four or more articles in the Journal of Teaching in Physical Education (JTPE) through the 1980s (N = 24) responded to a mail questionnaire on why they write, why they choose to write for JTPE, what they believe to be true about themselves or their approach to writing, and any situational factors that have led to their publication success. Authors described personal motives such as publishing to meet a curiosity drive, …

International Service Learning, Harry C. Silcox, Torun E. Leek Apr 1997

International Service Learning, Harry C. Silcox, Torun E. Leek

International Service Learning & Community Engagement

It is clear that a network of international service learning is in its formative stage, the authors point out. We must not allow the politics of service programs in the U.S. to blind us to the opportunities in other parts of the world that will enable us to advance the theory and ideology of service learning.

Student Participation In Community Service Activity, National Center For Education Apr 1997

Student Participation In Community Service Activity, National Center For Education

School K-12

Increasing community service participation has long been a goal in the United States. Some examples of how this goal has played out in national policy are President Kennedy’s creation of the Peace Corps, President Bush’s creation of the Points of Light Foundation, President Clinton’s creation of AmeriCorps, and Congress’ adoption of the National Education Goals, which include the objective that all students will be involved in activities that promote and demonstrate good citizenship and community service. In part, the push for volunteer service reflects the idea that the act of volunteering would be beneficial to those who participate and might …

Inside The Law: Canadian Law Firms In Historical Perspective, Douglas C. Harris Apr 1997

Inside The Law: Canadian Law Firms In Historical Perspective, Douglas C. Harris

Dalhousie Law Journal

This collection of essays edited by Carol Wilton' chronicles the changing character of Canadian law firms from the "golden age" of the sole practitioner in the nineteenth century to the mega-firms of the late twentieth. Most of the essays describe the changing profession through a case study of a single lawyer or firm, and Wilton has collected a representative sample of firms from across the country. Some of the firms remained small or disappeared, while others grew into full-service corporate commercial law firms of several hundred lawyers. Most of the essays focus on the personalities of the lawyers involved, their …

Sociological Paradigms And Civilizational Studies: Complementary Contributions Of E. A. Ross And P. S. Sorokin, Lawrence T. Nichols

Comparative Civilizations Review

This paper argues that the theories of Edward A. Ross and Pitirim A. Sorokin have more in common than is generally realized and documents unrecognized reciprocal influences between the two scholars. Ross developed a social-psychological reading of history emphasizing externally induced change; while Sorokin championed a cultural interpretation grounded in the concepts of immanent causation and the principle of limits. Closer examination, however, shows that Sorokin’s theory of creative altruism resembles Ross’s linear evolutionism. The complementary emphases of the paradigms are consistent with the contexts in which the theorists trained: Ross expresses youthful American optimism while Sorokin articulates the stoicism …

In this, the twenty-second annual Horace E. Read Memorial Lecture, Mr. Justice Albie Sachs reviews the efforts to resolve problems of multilingualism in the new Constitution of South Africa. Writing from experience in the constitution-making process, he reflects on the reality of eleven different languages in South Africa. Caroline Bartlett Crane And Progressive Era Reform: A Socio-Historical Analysis Of Ideology In Action, Linda J. Rynbrandt Apr 1997

Caroline Bartlett Crane And Progressive Era Reform: A Socio-Historical Analysis Of Ideology In Action, Linda J. Rynbrandt

Dissertations

This dissertation is a sociohistorical analysis of women and social reform in the Progressive Era. Until recently, the role of women has been virtually invisible in accounts of Progressive social reform. While this is no longer the case, considerable questions remain. Using the archival records of one woman, Caroline Bartlett Crane (1858-1935), which document her professional, intellectual and personal life, I describe her contribution to social reform and early sociology. I analyze how her life and work reveals a greater understanding of current feminist debates and other social, historical and political questions.
