Section 10(B) And The Vagaries Of Federal Common Law: The Merits Of Codifying The Private Cause Of Action Under A Structuralist Approach, Edward A. Fallone Jan 1997

Section 10(B) And The Vagaries Of Federal Common Law: The Merits Of Codifying The Private Cause Of Action Under A Structuralist Approach, Edward A. Fallone

Faculty Publications

Few issues in the field of securities law have proved as controversial as the legitimacy and proper application of the implied private cause of action for securities fraud under Section 10(b) of the Securities Exchange Act of 1934 and its regulatory counterpart, Rule 10b-5. The Private Securities Litigation Reform Act of 1995 was expected by many observers to bring about sweeping changes in the implied private cause of action, which critics charge has been abused by overzealous litigants bringing frivolous lawsuits. In his timely article, Professor Fallone argues that most of the Private Securities Litigation Reform Act's changes to the …

James Shirley's The Politician And The Demand For Responsible Government In The Court Of Charles I, James R. Keller Jan 1997

James Shirley's The Politician And The Demand For Responsible Government In The Court Of Charles I, James R. Keller

Quidditas

On 13 June 1629, Dr. Lamb, a person physician and astrologer to the duke of Buckingham, while strolling down a London street was attacked by an angry mob and beaten to death. When he first noticed the crowd gathering, he summoned a group of sailors to guard him. However, incensed by years of arbitrary government, economic hardship, and war, the mob pursued Lamb with the intention of making his death an example for the duke; they called him "the Duke's Devil." As Lamb made his way toward a local tavern, the ever-increasing pack began to pummel him with stones, and …

Hrotswitha Of Gandersheim's Dulcitius And Callimachus In A New Translation, Mark L. Damen Jan 1997

Hrotswitha Of Gandersheim's Dulcitius And Callimachus In A New Translation, Mark L. Damen

Quidditas

Even without external corroborating evidence, we may infer from her works that the nun Hrotswitha (Hrotsvit in Saxon) lived in Saxony during the second half of the tenth century. Because she seems to have had considerable freedom of movement and expression for a woman at that time, writing about worldly affairs evidently with some personal knowledge of them, she was most likely a canoness, that is, not fully cloistered. She must have visited the courts of the Saxon kings, probably more than once, since she chronicles their exploits and composes poetry of a type briefly popularized by a scholar in …

Accepting The 1997 Aals Section On Clinical Legal Education Award For Outstanding Contributions To Clinical Legal Education, Awarded To Edgar S. Cahn And Jean Camper Cahn (Posthumously), Edgar S. Cahn, Clinical Law Review Jan 1997

Accepting The 1997 Aals Section On Clinical Legal Education Award For Outstanding Contributions To Clinical Legal Education, Awarded To Edgar S. Cahn And Jean Camper Cahn (Posthumously), Edgar S. Cahn, Clinical Law Review

Clinical Law Review

It is difficult to speak briefly of the extraordinary accomplishments of Edgar S. Cahn and Jean Camper Cahn in the fields of poverty law, human rights, and clinical legal education. These achievements, described eloquently by the University of the District of Columbia School of Law Faculty in their unanimous nomination of the Cahns for the Section's Award, have decisively shaped the meaning of the law for generations of lawyers and clients. The very existence of the legal services program, threatened though it is today, owes a great deal to the work of the Cahns, including their pathbreaking 1964 article, "The …

Subjunctive Lawyering And Other Clinical Extern Paradigms, Kate E. Bloch Jan 1997

Subjunctive Lawyering And Other Clinical Extern Paradigms, Kate E. Bloch

Clinical Law Review

Every decision in legal practice contains an ethics component. Legal education must, therefore, prepare prospective lawyers to recognize and resolve these ethical issues in a principled manner. Because law students who participate in live-client clinical programs become both observers and direct actors in the ethics of legal decisions, the clinical experience provides an intensely motivating and uniquely concrete opportunity to teach and learn legal ethics. Enhancing student perception and understanding of legal ethics represents a nearly universal goal of clinical teachers. The clinician's emphasis, the student's pre-existing ethics consciousness, and the immersion in the immediacy of live lawyering prompt students …

Testing The Grades: Evaluating Grading Models In Clinical Legal Education, Stacy L. Brustin, David F. Chavkin Jan 1997

Testing The Grades: Evaluating Grading Models In Clinical Legal Education, Stacy L. Brustin, David F. Chavkin

Clinical Law Review

In 1994, the JOURNAL OF LEGAL EDUCATION published a survey of grading practices at law schools across the United States. That survey revealed a mix of grading approaches for clinical programs. 31 percent of all clinical courses used a fully-graded model; 33 percent graded students on a pass/fail basis; and 16 percent utilized both graded and pass/fail models. The article did not attempt to evaluate qualitatively the effectiveness of the various grading models. At about the same time that this article was published, clinicians teaching in Columbus Community Legal Services (CCLS) of The Catholic University of America were reconsidering the …
