Part I defines the basic concepts concerning the maritime industry and policy. Part I also presents the legal framework within which the European Community adopts measures on maritime policy. Part II discusses the 1986 Legislative Package, marking the first stage in the development of the Community common maritime policy. Part II then reviews the provisions and impact of Regulation 3577/92 which …

Development And Standardization Of The School-Based Consultation Orientation Rating Scale, Susan Marie Wilczynski Jan 1997

Development And Standardization Of The School-Based Consultation Orientation Rating Scale, Susan Marie Wilczynski

All-Inclusive List of Electronic Theses and Dissertations

Behavioral and mental health approaches to consultation differ in theoretical foundation, interpersonal interaction style of the consultant, and identified source of problem assessment, interventions, and decision-making. These consultation approaches may yield different levels of consultation effectiveness. Studies conducted to date have not consistently found differences between these approaches in terms of consultation effectiveness. However, there have been methodological flaws in these studies. In order to determine if either approach yields better outcomes, a means of assessing consultation orientation (i.e., the theoretical approach endorsed by a psychologist) must be developed. The School-based Consultation Orientation Rating Scale (SCORS) was designed to measure …

International Market Opportunities For Faba Beans, Andrew Quinn, Malcolm Sedgwick Jan 1997

International Market Opportunities For Faba Beans, Andrew Quinn, Malcolm Sedgwick

Farm Systems and Economics published reports

Western Australian faba bean production is growing and export volumes are increasing. In contrast, production is declining in many of the world's traditional faba bean regions. World trade, however, is growing.

China dominates the world export market and is growing rapidly as an exporter. The UK and Australia are the second and third largest exporters respectively.

As Western Australian production increases, the State will increasingly play an important role in Australia's ability to supply faba beans into markets looking tor quality and stable supply.

Saudi Arabia has emerged as the State's largest export market. The State is well located to …

Resource Management Decision Support Tools - Brief Model Descriptions, Campbell White & Associates Pty Ltd

Farm Systems and Economics published reports

During the past 10 years, a number of financial models have been developed within Agriculture Western Australia to assist decision making in resource management. Various approaches have been taken including whole farm, development and partial budgets.

Natural resource managers within Agriculture Western Australia, have identified a need to preserve these decision support systems in a central library. The models should be readily accessible to new staff, and the library should provide an 'engine' through which the models can be promoted, and information relating their application distributed. Recent technology such as the development and mainstream adoption of the World Wide Web …

Characterization Of Congenic Fv-2(Ss) And Fv-2(Rr) Mice With Respect To Nucleotide Sequence Of Erythropoietin Receptor And Disease Production By A Variant Rb Virus, Subimal Basu Jan 1997

Characterization Of Congenic Fv-2(Ss) And Fv-2(Rr) Mice With Respect To Nucleotide Sequence Of Erythropoietin Receptor And Disease Production By A Variant Rb Virus, Subimal Basu

All-Inclusive List of Electronic Theses and Dissertations

The envelope glycoprotein gp52, of Friend spleen focus-forming virus (F-SFFV) is responsible for the disease induced in mice by Friend virus (FV), which is a complex of F-SFFV and Friend murine leukemia virus (F-MuLV). The murine Fv-2 gene controls the susceptibility to F-SFFV infection. Mice resistant at the Fv-2 locus can rarely be infected with the wild-type F-SFFV. The viruses isolated from resistant FV-induced diseased mice have an altered envelope glycoprotein. It has been demonstrated that interaction between gp52 and erythropoietin receptor (EpoR) is required for the disease production in mice. Furthermore, it has been postulated that Fv-2 gene modifies …

Messenger As The Medium Of Communication: The Use Of Interpreters In Mediation, The, Ileana Dominguez-Urban Jan 1997

Messenger As The Medium Of Communication: The Use Of Interpreters In Mediation, The, Ileana Dominguez-Urban

Journal of Dispute Resolution

Merely adding one more person to the mediation process adds greater complexity to the dynamics of the mediation than most lawyers and mediators would anticipate. As Part I of this article indicates, mediators must understand the complexities of interpreted mediation because the need for interpreted mediation is increasing due to national demographics, legal requirements, and international market forces. Part II examines the skills needed for interpretation and the probable structure of an interpreted mediation. Part III considers who might possess those interpretation skills as well as the additional skills required of one who will serve as an auxiliary to the …

Physician-Patient Arbitration Agreements: Procedural Safeguards May Not Be Enough - Buraczynski V. Eyring, Jennifer Gillespie Jan 1997

Physician-Patient Arbitration Agreements: Procedural Safeguards May Not Be Enough - Buraczynski V. Eyring, Jennifer Gillespie

Journal of Dispute Resolution

Insurance companies and physicians increasingly are requiring medical malpractice claims to be settled by arbitration.2 As a result, many patients are being presented with a new choice when they enter their doctor's office: Sign an arbitration agreement or forgo treatment with their physician. In Buraczynski v. Eyring, the physician required the patients to sign an arbitration agreement prior to performing medical services for them? The agreement contained provisions designed to ensure that the patient made an informed decision before consenting to the agreement.4 But what if there were no other doctors available if the patient chose not to sign?

Freeing The Parties From The Law: Designing An Interest And Rights Focused Model Of Landlord/Tenant Mediation, Joel Kurtzberg, Jamie Henikoff Jan 1997

Freeing The Parties From The Law: Designing An Interest And Rights Focused Model Of Landlord/Tenant Mediation, Joel Kurtzberg, Jamie Henikoff

Journal of Dispute Resolution

In this article, we point out two fundamental flaws of the critique. First, the critique compares mediation to an idealized view of adjudication instead of comparing mediation to its real-life alternatives. Second, it takes a narrow view of the role of law in mediation, erroneously assuming that mediators must either ignore the law or impose it on the parties. Part I of this article spells out the critics' claim that mediation generally harms the poor and disempowered by failing to adequately incorporate formal legal protections into the process. Part II examines the critique as it is applied to the landlord-tenant …

Property And The First Amendment, Mark W. Cordes Jan 1997

Property And The First Amendment, Mark W. Cordes

Faculty Articles, Papers, and Other Scholarship

This article will examine the relationship of property interests to First Amendment exercise, and in particular the Supreme Court’s treatment of the ways property interests might interact with First Amendment rights. Although where appropriate it will emphasize the increased attention to property interests in recent years, the article’s primary intent is to more broadly examine the types of property-speech relationships that have arisen and how the Court has viewed property values in those various contexts. Beyond that, it will attempt to discern the more basic values reflected in the Court’s analysis and, to a limited degree, critique the Court’s treatment …

Expert Opinion Pleading: Any Merit To Special Certificates Of Merit?, Jeffrey A. Parness, Amy Leonetti Jan 1997

Expert Opinion Pleading: Any Merit To Special Certificates Of Merit?, Jeffrey A. Parness, Amy Leonetti

Faculty Articles, Papers, and Other Scholarship

Civil litigation reform to reduce frivolous civil lawsuits was a hot topic in the most recent Presidential debates. It has stirred much recent interest and action in state and federal legislatures. Some new developments involve special pleading norms. Lawmakers will likely debate and implement new special pleading requirements in coming years, often involving certificates of merit. Such certificates are now required for most or some professional malpractice claims in several states. Illinois adopted a certificate of merit standard for product liability actions, while certificates of merit for certain childhood sexual abuse claims are necessary in both California and Louisiana. As …

Intellectual Property Rights In Data?, J. H. Reichman, Pamela Samuelson Jan 1997

Intellectual Property Rights In Data?, J. H. Reichman, Pamela Samuelson

Vanderbilt Law Review

The international intellectual property system founded on the Paris and Berne Conventions in the late nineteenth century has been dominated by the patent and copyright paradigms, which articulate the legal protection of technological inventions and of literary and artistic works, respectively. Although this patent-copyright dichotomy was never as strictly observed abroad as in the United States, it nonetheless charted a relatively clear theoretical line of demarcation between legal incentives to create and the public interest in free competition. Any publicly disclosed technologies or information products that failed to meet the eligibility requirements of the domestic patent and copyright laws became …

A Study Of Social Support Variables In Three Stages Of Hiv-Illness, Urszula Izabela Klich

All-Inclusive List of Electronic Theses and Dissertations

Social Support (SS) has been shown to have an effect on health and well-being. Patients with the Human Immunodeficiency Virus (HIV) are particularly vulnerable to stigmatization which may effect SS. This study examined the SS networks of 155 gay men with HIV. It was hypothesized that (a) perceived SS differs according to stage of HIV-illness and time since diagnosis, (b) there are select factors that are associated with variations in perceived SS, and (c) level of SS is predictive of future functional capacity and mental health. To assess SS, the Social Support Questionnaire based on the General Social Survey (1995) …
