The Use Of Race In The Admissions Programs Of Higher Educational Institutions - A Violation Of The Equal Protection Clause?, Kevin Joyner

This Note examines the burden placed on educational institutions to justify race-conscious admissions programs in light of the Equal Protection Clause. First, this note reviews the facts of the case and the decision in Hopwood. Next, this note provides a background of the law applicable to race-conscious programs by examining: (1) University of California v. Bakke; (2) the underlying theories of interpreting the Fourteenth Amendment; (3) the strict scrutiny standard of review; and (4) the Fourth Circuit's 1994 decision to invalidate a university's race-conscious scholarship program in Podberesky v. Kirwan. Finally, this note analyzes the decision by the Fifth Circuit. …

A multi-phased research program consisted of performance of both laboratory and field test programs, development of hydraulic conductivity probability density functions, and development of a first generation risk model to assess relative risk among groups of levees to determine rank for systemic allocation of scarce rehabilitation resources. The laboratory test program consisted of determining basic soil properties at four USACE WES REMR demonstration sites: Talulla, MS, Sny Island, IL, Skagit, WA, and Elkhorn, CA. Additionally, flexible wall hydraulic conductivity tests were performed with subsequent development of hydraulic conductivity probability density functions (PDF's). Toward A Healthier Environment And A Stronger Economy: How To Achieve Common Ground, Murray L. Weidenbaum, Christopher Douglass, Michael Orlando

Economic and environmental interests are typically opponents in the public arena. Most efforts to bridge intellectual differences involve economists trying to get environmentalists to develop an "economic way of thinking" while conversely, ecologists attempt to sway economists toward kinder environmental values. It is time for a new approach to public policy that takes advantage of the middle ground between these two ideologies. This study presents six specific reforms that make both sound economic and environmental sense. These reforms occur within selected government spending programs, special federal tax provisions, and particular regulatory requirements.

With the alarming rate of school violence and teen crime public outcry demands that we look for immediate remedies to make schools and communities safe. One solution which has received public support is the current trend to solve this problem by building more juvenile facilities to house these youth. This short term fix, which has been referred to as an "out of sight out of mind mentality" creates other concerns such as loss of educational dollars to public schools and highlights the lack of commitment to provide effective programs to meet the needs of challenging students. This study examined the relationship between grievant variables (case description, case issue, gender, seriousness of the case) and case determination (denied/granted). A disk copy of QA4 database years 1985 to 1995 was provided by the West Virginia Education and State Employees Grievance Board. The approximate 222 higher education synopses reports were read to locate the population. Fifty-five higher education discipline and discharge synopsis reports were isolated. Key words used by the Board assisted in isolating the population. The legal response to juvenile crime is undergoing revolutionary change, and its ultimate shape is uncertain. The traditional juvenile court, grounded in optimism about the potential for rehabilitation of young offenders, has long been the target of criticism, and even its defenders have been forced to acknowledge that it has failed to meet its objectives. Beginning in the late 1960s, when the Supreme Court introduced procedural regularity to delinquency proceedings in In re Gault, courts and legislatures began to slowly chip away at the foundations of the juvenile justice system. Old Chief V. United States: Stipulating Away Prosecutorial Accountability?, Daniel Richman

Earlier this year, in Old Chief v. United States, the Supreme Court finally resolved a circuit split on a nagging evidentiary issue: When a defendant charged with being a convicted felon in possession of a firearm offers to satisfy one of the statute's elements by stipulating to the existence of a prior felony conviction, may the government decline the stipulation and prove the existence and the nature of that prior felony?
