Assessing The "Contract Failure" Explanation For Nonprofit Organizations And Their Tax-Exempt Status, Daniel N. Shaviro

The best known account in recent legal or economic literature of why certain organizations use the nonprofit form, and when or why they ought to be tax-exempt, comes from Henry Hansmann. Hansmann argues that the nonprofit form prevails where it does because it responds efficiently to problems of "contract failure" where behavior is hard to monitor. For example, I might not trust a for-profit company to use my donation to provide famine relief in a foreign country or to render "complex personal services" such as nursing care, given the difficulty of observing performance directly. Congruence Principle Applied: Rethinking Equal Protection Review Of Federal Alienage Classifications After Adanrand Constructors, Inc. V. Peña, Victor C. Romero

This article suggests that the Supreme Court's 1995 decision in Adarand Constructors, Inc. v. Peña constitutes a starting point for a renewed dialogue on the intersection of race, noncitizens' rights, and immigration law.
Part I of this Article examines the historical foundations of the plenary power doctrine up to the current dichotomy between judicial review of state and federal alienage classifications under equal protection. Part II reviews the Adarand decision, arguing that Justice O'Connor's congruence principle provides the bulwark for a revision of judicial review of federal legislation, especially in light of the historical and continuing perception of Asian- and …

This Comment considers the growing number of immigrants who bring the traditional practice of female genital mutilation to the United States and examines the difficulty in protecting victims from the practice of female genital mutilation in insular communities. Part I outlines the three types of female genital mutilation, the cultural and religious reasons for the ritual, and the existence of the practice in the United States. Part II examines the provisions of the Immigrant Responsibility Act of 1996. Bioethical Consideration Of Maternal-Fetal Issues, Linda Farber Post

The relationship between a pregnant woman and her fetus is unlike any other in law, medicine, or ethics. This Article examines the complexity of the maternal-fetal conflict, focusing on the interests of the woman and the sometimes conflicting interests of her fetus. Part I discusses the typical analytical background of the conflict, explaining the various ethical principles, rights, and obligations involved such as autonomy, beneficence and nonmaleficence, and justice. Part II explores the various choices made by the pregnant woman, as well as the state’s attempts to regulate those choices on behalf of the fetus. This Article concludes that, while …

In the Winter 1997 issue of the Alaska Justice Forum, a certified interpreter for the federal and California court systems corrects misunderstandings about the nature of language interpretation in legal proceedings, observing that accurately interpreting to and from English in proceedings requires a language proficiency often misunderstood by participants in the court proceedings, and that lack of proficient interpretation can give rise to errors which threaten the integrity of the justice process. An accompanying sidebar describes the legal interpretation practice in Alaska courts and other Alaska justice agencies. Fourth Amendment Accommodations: (Un)Compelling Public Needs, Balancing Acts, And The Fiction Of Consent, Guy-Uriel Charles

The problems of public housing-including crime, drugs, and gun violence- have received an enormous amount of national attention. Much attention has also focused on warrantless searches and consent searches as solutions to these problems. This Note addresses the constitutionality of these proposals and asserts that if the Supreme Court's current Fourth Amendment jurisprudence is taken to its logical extremes, warrantless searches in public housing can be found constitutional. The author argues, however, that such an interpretation fails to strike the proper balance between public need and privacy in the public housing context. The Note concludes by proposing alternative consent-based regimes …

Reconciling Chevron And Stare Decisis, Richard J. Pierce Jr

Conflicts between Chevron and stare decisis can arise in several contexts. Pierce first identifies the values that are furthered by Chevron and stare decisis and then analyzes the judicial decisions that resolve conflicts between the two doctrines. The Supreme Court has announced and applied a series of mechanical rules to resolve such conflicts, e.g., Supreme Court precedents always trump Chevron deference, while even longstanding agency and circuit court precedents apparently count for nothing when the Court attempts to determine the meaning of statutory language. Circuit courts have announced and applied a dramatically different set of rules for resolving conflicts between …
