Ua3/9/2 Wku Institutional Review, James L. Fisher, Ltd.
WKU Administration Documents
Institutional review conducted during Barbara Burch's interim presidency of WKU and presidential search.
Western Kentucky is a good university essentially trapped in time and therefore unable to change significantly. Until these constraints are eliminated or modified, the University will not be able to effectively address major issues of focus, enrollment, organization, personnel, curriculum, governance, athletics, planning and increased public and private support. Rather, it will continue to drift with occasional peripheral and cosmetic changes, none of which will be sufficient to successfully relate to Kentucky's new plan for post-secondary education.
The problems that prevent significant institutional transformation are several, but …

Common Law Duty In Negligence Law: The Recent Consolidation Of A Consensus On The Expansion Of The Analysis Of Duty And The New Conservation Liability Limiting Use Of Policy Considerations, Peter F. Lake
San Diego Law Review
Without the concept of duty, there is no liability law. Yet, the author demonstrates that although law reviews and other literature contain ample discussion of the legal duty in its various applications, little has been settled with regard the general concept of duty until recently. Professor Lake offers his own account of the concept of duty and offers a 50-state analysis of the general concept of duty, including key decisions that discuss the general concept of duty in negligence law. This article calls upon the American Law Institute to revise the topic of duty to reflect the consensus about its …

The Role Of The "Harm/Benefit" And "Average Reciprocity Of Advantage" Rules In A Comprehensive Takings Analysis, Lynda J. Oswald
Vanderbilt Law Review
A "regulatory taking" occurs when the government does not formally exercise its power of eminent domain, but enacts a law or undertakes an action that results in a de facto "taking" of property for which compensation is constitutionally mandated., The United States Supreme Court has struggled for decades to determine when a land use regulation is a valid exercise of the police power (and thus not subject to the compensation requirement of the Fifth Amendment to the United States Constitution) and when such a regulation goes "too far" and becomes a regulatory taking.
The Supreme Court has developed a number …
