Virtue, Liberty, And The Good : A Critical Analysis Of Civic Republicanism, Nathan Douglas Austin Jan 1997

Virtue, Liberty, And The Good : A Critical Analysis Of Civic Republicanism, Nathan Douglas Austin

Dissertations and Theses

Dissatisfaction with liberalism is nothing new. As the longstanding dominant force in Western political thought, it has been subject to unending hostile critiques from a variety of sources. Of the criticisms of liberalism advanced in recent years, some of the most persistent and scathing have been levied by scholars identified with civic republicanism. Civic republicanism has adopted the pose of a counter philosophy to liberalism. Civic republicans, such as Alasdair MacIntyre, Michael Sandel, and Cass Sunstein, argue that liberalism is an impoverished political conception that is unable to provide or sustain the moral energies necessary for a vital democratic life. …

Risk In The Balance, Jay D. Wexler Jan 1997

Risk In The Balance, Jay D. Wexler

Faculty Scholarship

In both academic and legislative circles, risk assessment reform is currently a hot topic. In the last decade, scholars have increasingly criticized the risk assessment procedures which administrative agencies employ to protect the public from environmental and health risks. Critics have pointed to several flaws in the current system, calling it inconsistent, undemocratic, overly decentralized, excessively rigid and unjustifiably conservative. To deal with these problems, scholars have proposed a variety of solutions. Peter Huber has urged agencies to assess risk less conservatively in order to save society from "second best" technology. Cass Sunstein and Richard Pildes have proposed injecting public …

Father Involvement And Preschool Behavior: Do Involved Dads Make A Difference?, Lorraine Bonati Jan 1997

Father Involvement And Preschool Behavior: Do Involved Dads Make A Difference?, Lorraine Bonati

Theses

The purpose of this study was to determine whether or not father involvement in child care has an effect on preschool behavior. Data were provided by a kindergarten readiness study conducted by the Primary Mental Health Project (PMHP) in Rochester, New York. Participants voluntarily completed background questionnaires including an item regarding the degree of father involvement in care of the children. A randomly-selected sample of 121 four- and five-year-old urban preschool children (61 males, 60 females) with low to high father involvement were rated on five behaviors and five social competencies by their teachers using the Teacher-Child Rating Scale, the …

Patient Behaviors And Beliefs : Are Standardized Patients Different?, Colleen Shannon Lewy Jan 1997

Patient Behaviors And Beliefs : Are Standardized Patients Different?, Colleen Shannon Lewy

Dissertations and Theses

Standardized patients (SP's) are lay people who are trained to evaluate and train clinical skills for medical personnel. It was hypothesized that since SP's have had practice and experience interacting with medical personnel that they would exhibit higher levels of patient interaction with their own health care providers. Surveys were sent to SP's affiliated with two medical schools in the Northwest as well as a control group from a local university. Surveys consisted of the Thompson Decisional Involvement scale, the Ende Autonomy Preference Index, the Krantz Health Opinion Survey: Information Seeking subscale, a Satisfaction Criteria scale, and an Expectations survey. …

Reefer Madness: The Federal Response To California's Medical-Marijuana Law, George J. Annas Jan 1997

Reefer Madness: The Federal Response To California's Medical-Marijuana Law, George J. Annas

Faculty Scholarship

Marijuana is unique among illegal drugs in its political symbolism, its safety, and its wide use. More than 65 million Americans have tried marijuana, the use of which is not associated with increased mortality. Since the federal government first tried to tax it out of existence in 1937, at least partly in response to the 1936 film Reefer Madness, marijuana has remained at the center of controversy. Now physicians are becoming more actively involved. Most recently, the federal drug policy against any use of marijuana has been challenged by California's attempt to legalize its use by certain patients on the …

Response To Haskell: "Academic Freedom, Tenure, And Student Evaluation Of Faculty", Jeffrey E. Stake Jan 1997

Response To Haskell: "Academic Freedom, Tenure, And Student Evaluation Of Faculty", Jeffrey E. Stake

Articles by Maurer Faculty

Haskell (1997) argued that the administrative practice of student evaluation of faculty is a threat to academic freedom. However, before that claim can be substantiated, several prior questions must be addressed: To whom does academic freedom belong? Individual faculty? The academy? Whose actions can violate the right? Can any lines be drawn based on whether the substance or form of classroom behavior is influenced? And still another crucial point is whether a body can violate academic freedom without any intent to interfere with or control the substance of what is said to students.

Individualism And Evolutionary Psychology (Or: In Defense Of 'Narrow' Functions), David J. Buller Jan 1997

Individualism And Evolutionary Psychology (Or: In Defense Of 'Narrow' Functions), David J. Buller

Faculty Articles, Papers, and Other Scholarship

Millikan (1993) and Wilson (1994) argue, for different reasons, that the essential reference to the environment in adaptationist explanations of behavior makes (psychological) individualism inconsistent with evolutionary psychology. I show that their arguments are based on misinterpretationso f the role of referencet o the environmenti n such explanations. By exploring these misinterpretationsI, develop an account of explanation in evolutionary psychology that is fully consistent with individualism. This does not, however, constitute a full-fledged defense of individualism, since evolutionary psychology is only one explanatory paradigm among many in psychology.

Bringing Avalon Hills Baptist Church Through The Two Hundred Barrier, David D. Reike

Parental Rights And The Right To Intimate Association, David Fisher Jan 1997

Parental Rights And The Right To Intimate Association, David Fisher

UC Law Journal

In a series of cases in the 1920s, the Supreme Court affirmed a fundamental right of parents to direct the upbringing and education of their children. Since that time, however, the judiciary's support for parental rights has become much more ambiguous. As a result, in recent years, the religious right has taken parental rights on as one of its central policy issues - introducing bills and state constitutional amendments in twenty-eight states as well as a bill in Congress, all designed to strengthen the hand of parents against state assertion of authority on behalf of their children.

Horizontal Jurisprudence And Sex Discrimination, Jean Wegman Burns Jan 1997

Horizontal Jurisprudence And Sex Discrimination, Jean Wegman Burns

UC Law Journal

In this Article, Professor Bums contrasts the vertical jurisprudential style of Title VII with the horizontal approaches found in other, unrelated areas of the law. She argues that Title VII's vertical, top-down development and testing are largely responsible for the law's failure to produce more concrete results or to settle the often acrimonious arguments on the subject of gender equality in the workplace. She advocates supplementing Title VII's onesize- fits-all set of rules with a bottom-up, horizontal approach to rulemaking and rule testing. This will allow those directly affected by the rules to participate in their development and encourage different …

A Study Of Social Support Variables In Three Stages Of Hiv-Illness, Urszula Izabela Klich Jan 1997

A Study Of Social Support Variables In Three Stages Of Hiv-Illness, Urszula Izabela Klich

All-Inclusive List of Electronic Theses and Dissertations

Social Support (SS) has been shown to have an effect on health and well-being. Patients with the Human Immunodeficiency Virus (HIV) are particularly vulnerable to stigmatization which may effect SS. This study examined the SS networks of 155 gay men with HIV. It was hypothesized that (a) perceived SS differs according to stage of HIV-illness and time since diagnosis, (b) there are select factors that are associated with variations in perceived SS, and (c) level of SS is predictive of future functional capacity and mental health. To assess SS, the Social Support Questionnaire based on the General Social Survey (1995) …
