Territoriality, Risk Perception, And Counterproductive Legal Structures: The Case Of Waste Facility Siting, Michael B. Gerrard

The siting of hazardous and nuclear waste facilities has proven to be a task of enormous difficulty in our federal system. In this Article, the Author argues that one of the major causal factors for this difficulty is that the legal regime surrounding waste facility siting decisions is not structured in a manner sensitive to the human factors involved. The siting of a hazardous waste facility is likely to generate a negative community response where the imposition of externally made decisions and externally generated wastes fails to take into account the innate human trait of territoriality. Much of the anxiety and dissatisfaction associated with legal ethics arises from the categorical quality of the bar's dominant norms. These norms take the form of relatively inflexible rules insensitive to all but a few of the circumstances of the cases they govern. Hence they often require the lawyer to take actions that contribute to injustice or to refrain from actions that would avert injustice.

Fierce political battles have raged about the Legal Services Corporation (LSC) for much of its twenty-three year history. Critics have attacked LSC for pursuing a "radical agenda" and for "engaging in dubious litigation that is of no real benefit to poor people," while supporters have termed LSC "the one program in the entire war on poverty that made a difference" and have decried the "campaign to deny the right of legal representation to the poor." Last year, in the Omnibus Consolidated Rescissions and Appropriations Act of 1996 (OCRAA), Congress reduced LSC funding by thirty percent – to $278 million in …

In asking collegiate aviation educators for a term or a phrase that adequately describes their academic field, it does not take much time to discover that widespread agreement is notably absent. If we as aviation educators are unable to collectively identify ourselves and the niche we inhabit in the realm of the entire academic community, then how much more difficult will it be for the remainder of the academic community and the general public to identify us as well? In recent years, many schools have begun to include students with disabilities in general education classrooms. Studies on "inclusion," have shown several positive effects for students with and without disabilities. This study examines the self-reported attitudes of 185 elementary school students in inclusive and traditional classrooms, as measured by the Scale of Children's Attitudes Toward Exceptionalities (SCATE). Self-reported attitudes and experiences of general education teachers were also assessed using a survey developed by the researcher. Although statistically significant relationships were found on the SCATE, these were not logical or conclusive. Results of the teacher surveys indicate that teachers of inclusive …

This study investigates the effects of tolerance for ambiguity and risktaking propensity in mediating the relationships between role conflict and perceived performance among 70 entrepreneurs in small and medium-sized businesses in Singapore. Entrepreneurial activity has been widely recognized as a major factor driving Singapore's economic development. Further insights therefore can be gained by this study, which addresses the above issues from the perspective of Singaporean entrepreneurs. The implications of exposure to acute and chronic stressors, and seeking mental health care, for increased psychological distress are examined. Research on eco¬nomic stress, psychological distress, and rural agrarian values each point to in¬creasing variability within rural areas. Using data from a panel study of 1,487 adults, a model predicting changes in depressive symptoms was specified and tested. Results show effects by size of place for men but not for women. Men living in rural villages of under 2,500 or in small towns of 2,500 to 9,999 people had significantly greater increases in depressive symptoms than men living in the …

The purpose of this study was to examine whether personal variables including age, gender, length of correctional work experience, years ofEducation, and work locus of control predict levels of critical incident stress among correctional officers. Fifty-two federal correctional officers completed: (a) the Impact of Event Scale-Revised (Weiss & Marmar, 1997) to measure critical incident stress, (b) the Work Locus Control Scale (Spector, 1988) to measure work locus of control, and (c) a demographic questionnaire. This study investigated self-efficacy as described in Bandura's social learning theory and how it applies among boys with Attention Deficit Hyperactivity Disorder (ADHD). The Student Self-Concept Scale (SSCS) (Gresham, Elliott, & Evans-Rernandez, 1993) was administered to assess the degree to which boys with ADHD differed from a standardized national sample of boys with respect to self-efficacy as outlined in Bandura's social learning theory. This study evaluated the relationship of six parent and eight teacher rating scales to the T.O.V.A. measures of Inattention, Impulsivity, Response Time and Variability. Subjects consisted of 88 children 6 through 14 years of age, referred by teachers and parents to a school psychologist in a small midwestern community for evaluation of ADHD symptomatology. These students attended school at four public elementary schools and three private religious elementary schools. Sixty-eight subjects were males and twenty subjects were females. Each child was administered the T.O.V.A. by a school psychologist. Parents filled out the BASC:PRS, CPRS-48, and the ADHD Rating Scale. Teachers …

Despite an abundance of literature stressing the need to prevent child maltreatment and foster care placement, information related to the prevention of foster care placement and child maltreatment from a parent's perspective is virtually nonexistent. This research utilized qualitative research techniques to elicit parental perspectives on the prevention of foster care placement and child maltreatment. Results were analyzed utilizing Belsky's (1980) ecological framework for child maltreatment and a risk and protective framework. Results are discussed in terms of theoretical, research, practical and personal implications. This thesis is about achieving diversity in our society and in our world. In it I examine attributes of relativism as well as understandings of our existence in order to develop a model for achieving diversity. I examine our present model of science and the approach of romanticism and conclude that our sciences today are really about control and domination. I propose that the goals of our sciences should not be about domination, and therefore neither should our methods of science. This study investigated differences in parenting and late adolescents’ moral development in two cultural groups: Chinese-Canadian and European-Canadian Measures of parental authoritativeness and degree of parental influence on moral values were administered to a sample of 62 European-Canadian and 40 Chinese-Canadian university students, aged 17-26 years. The participants were then compared with respect to two outcome measures, one assessing the degree to which they internalized and represented parents’ viewpoints (“voice”) in narratives about moral socialization, and the other assessing level of moral reasoning development. The place conditioning paradigm was used to assess the ability of the noncompetitive NMDA receptor antagonist, M- 801 to interfere with drug-place associations. MK-801 (0.1 mg/kg, ip) attenuated a place preference produced by 10 mg/kg, but not by 3 or 5 mg/kg of amphetamine. MK-801 alone produced neither a place preference nor a place aversion. Interference with amphetamine place preference learning was not the result of state-dependent learning produced by MK-801. Furthermore, MK-801 did not interfere with the expression of a previously established amphetamine place preference. Pretreatment with MK-801 also interfered with lithium-induced conditioned place aversion learning. These results suggest …

The main purpose of this study was to provide a basis for and facilitate the development of strategies and programs based on actual life experiences of the refugee families and their children and on present needs and resources in the Kitchener-Waterloo community. This thesis describes the psychometric evaluation and validation of a scale assessing people's tendency to use others’ opinions in order to assess the correctness of their own opinion. In study 1, 320 introductory psychology students completed the 12-item Need for Social Validation scale (N SV), as well as the Need to Evaluate and Self-Monitoring scales. The NSV scale was demonstrated to possess good internal consistency (Cronbach’s alpha=.85), a two factor structure, and high test-retest reliability after 22-weeks (r = .76). The NSV was found to be negatively related to the Need to Evaluate scale (r = -.49) and unrelated to …

Pentobarbital is self-administered by rats, but has also been reported to produce a conditioned place aversion. Since the self-administration and place preference paradigms both are considered to assess drug reward, we further examined the hedonic properties of pentobarbital using place conditioning. In Experiment 1, a dose of 15 mg/kg (ip) of pentobarbital produced a conditioned place aversion following 4 conditioning trials of various durations (5, 15, 30 or 60 min). Since rats are typically drug-experienced in the self-administration paradigm. Experiments 2 and 3 examined the effect of drug history on pentobarbital-induced place conditioning. The effects on feeding of moving animals from individual- to pair-housing were explored in the present three experiments. Wheel access is known to result in a temporary suppression of feeding. The move to pair-housing was compared with the effect of wheel access. In Experiment l, a group of rats was moved from individual to pair-housing (IP group) and compared to a group of individually-housed rats (IND group) and a group of chronically pair-housed rats (PAIR group). The animals in the IP group showed a temporary (three days) suppression in feeding (initially 23%). When half of the IND and PAIR group …

The purpose of this study was to determine the difference in White Racial Identity and degree of tolerance for Blacks between two samples of White male undergraduate students attending an urban Black university and those attending an urban White university. The theoretical framework for this study was based in Social Contact Theory as a contributor to racial tolerance and Racial Identity Development Theory as a factor in human growth toward increasing acceptance of diversity. This was a quasi-experimental post-hoc design using intact groups.

The purpose of this research was to examine the influence of reading achievement on the dropout status. The major research question was to determine to what extent does reading comprehension influence the dropout rate after controlling for demographic and performance characteristics?
The target population consisted of 677 urban twelfth-grade students attending schools in an urban southeastern school district in the Commonwealth of Virginia. Of the 677 students, 142 were dropouts, and 535 were nondropouts. The present study has been implemented to provide insight as to how, given limited resources, Technology Education curricula might be developed to best support the unique goals of an urban middle school aerospace magnet program. It was hypothesized that applied academic strategies, including interdisciplinary hands-on aerospace and computer-assisted instructional activities, would affect larger gains in mathematics achievement and would enhance career-interest development of urban seventh-grade students to a greater degree than would non-participation in such instruction. The purpose of this study was to explore the diversity climate in a large teaching military hospital by assessing the perceptions of employees regarding the organizational climate, including aspects of the climate related to ethnicity, gender, age, physical ability, sexual orientation, and job level. All 3,176 eligible employees based in the medical center were invited to participate, 1,252 did so (RR = 40%). Participants were 37% minority, 57% females, 25% officer, 30% enlisted, and 45% civilian. Twenty-four percent were at the managerial level. Using a descriptive design, interpersonal comparisons of 92 mothers of triplets attending a national meeting of families of higher order multiples were made. Variables, in addition to sociodemographic characteristics, included coping processes, levels of depression, perceived availability of social support, and current stress levels. Coping processes were measured using the Ways of Coping Questionnaire (Folkman & Lazarus, 1988), derived from their cognitive-phenomenological theory of stress and coping.
