Mikhail Bakhtin And Change In The Common Law, Russell West Jr. Jan 1997

Mikhail Bakhtin And Change In The Common Law, Russell West Jr.

Washington Law Review

Traditional legal analysis comprehends change in the common law over time as a shifting legal response to different facts and circumstances. This approach does not examine the internal mechanisms by which the meaning of a judicial opinion changes when cited in later legal writing. Mikhail Bakhtin, a literary and cultural theorist, argued that any statement can be understood only through the context in which it is uttered and that every change in context causes a shift in the statement's meaning. This Comment analyzes the internal mechanisms of judicial opinions in light of Bakhtin's theories. First, this Comment describes one example …

Prediction Of Potential Antimigraine Activity Using Artificial Neural Networks, Qing Luo, Jerry A. Darsey, Cesar M. Compadre, Sanjay K. Mitra Jan 1997

Prediction Of Potential Antimigraine Activity Using Artificial Neural Networks, Qing Luo, Jerry A. Darsey, Cesar M. Compadre, Sanjay K. Mitra

Journal of the Arkansas Academy of Science

More than 10 million Americans, three quarters of them women, suffer some degree of recurrent migraine headaches. Feverfew [Tanacetum parthenium (L.) Schultz-Bip.) is a member of the Asteraceae family that is native to Europe. This plant is a perennial flowering aromatic plant common in gardens. It has been widely used as a self-medication of arthritis, fever, and migraine headaches for over 2000 years. Sesquiterpene lactones (SL) are the components responsible for the antimigraine activity of feverfew. In this research, the relationship between SL structural information and their biological activity was studied by using Gaussian 92 program in conjunction with artificial …

A Grant For Recreation For People With Disabilities, Alessandra Rellini

Whittier Scholars Program

The purpose of this paper is to support a grant program for the making of a loan for people with disabilities who want to increase their leisure experiences. Three main issues are addressed by this paper: this history of leisure, the benefits of leisure on people’s lives, and the main features of this leisure correlated to these benefits. Through the history of leisure the reader will be introduced to the way leisure came about and the way society reacted to leisure. The main question about leisure is why it it important to people? The answer is that leisure benefits people’s …

Impact Of Amateur Educational Video Viewing On Language Acquisition Of Preschool Children, Jennifer L. Radcliffe Jan 1997

Impact Of Amateur Educational Video Viewing On Language Acquisition Of Preschool Children, Jennifer L. Radcliffe

Masters Theses

Child language-learning is a complex process that varies for each individual child. Researchers have found that children learn from viewing professional television programs specifically designed for children, such as Sesame Street. Professional television programming principles can be adopted to produce amateur educational videos. Video may also be a viable option to provide repetitive models to improve vocabulary acquisition within speech-language pathology. The purpose of this study was to measure the effect of direct stimulation with amateur educational videos on a child's general and specific vocabulary acquisition.

A six-week experiment included an initial two-week control period, a two-week experimental period …

Understanding Audience Understanding, Paul A. Soukup Jan 1997

Understanding Audience Understanding, Paul A. Soukup

Communication

Communication study has approached the issue of audience understanding of messages from the perspective of the message and from that of the audience. On the one hand, the "powerful-message" construct paints the audience as passive recipients of the meaning presented in the media. On the other hand, the "active audience" construct places most interpretive power in the audience, stressing their selectivity of messages, their use of the media, their social positions, and their ability to generate new messages based on the media. A middle position sees audience understanding emerge from an interaction between messages and audience members.

Buckley's Analytic Flaws, Burt Neuborne Jan 1997

Buckley's Analytic Flaws, Burt Neuborne

Faculty Articles

You can see why Buckley v. Valeo was decided as it was. The plaintiffs had two terrific advocates in Ralph Winter and Joel Gora. Both advocates have made splendid presentations in defense of the Buckley holding. But I do not recognize the rosy democratic world that they describe today. Neither Joel nor Ralph are looking at the same political world that I see when I open my eyes in the morning.

International Human Rights Standards On Sexual Violence Against Women As They Apply To Pornography, Claudia Giunta Jan 1997

International Human Rights Standards On Sexual Violence Against Women As They Apply To Pornography, Claudia Giunta

LLM Theses and Essays

The United Nations Fourth World Conference on Women was held in Beijing in September 1995, and represented an important step towards the achievement of equality for women. At the Conference, the progress made towards equality was acknowledged, but it was also acknowledged that many goals have not been achieved yet, and that cultural changes of fundamental importance remain to be made. Indeed, in many countries the cultural approach to violence and discrimination against women is quite fatalistic; they believe violence against women cannot be solved by laws. However, this approach overlooks the role played by societies in tolerating practices of …

The Truth About Secured Financing, Robert E. Scott Jan 1997

The Truth About Secured Financing, Robert E. Scott

Faculty Scholarship

The debate over the social value of secured credit (and the appropriate priority for secured claims in bankruptcy) is entering its nineteenth year. Yet the continuing publication of succeeding generations of articles exploring the topic have yielded precious little in the way of an emerging scholarly consensus about the nature and function of secured credit. Put simply, we still do not have a theory, of finance that explains why firms sometimes (but not always) issue secured debt rather than unsecured debt or equity. Moreover (and perhaps because of the lack of any plausible general theory), we lack any persuasive empirical …

The Evolution Of Adolescence: A Developmental Perspective On Juvenile Justice Reform, Elizabeth S. Scott, Thomas Grisso Jan 1997

The Evolution Of Adolescence: A Developmental Perspective On Juvenile Justice Reform, Elizabeth S. Scott, Thomas Grisso

Faculty Scholarship

The legal response to juvenile crime is undergoing revolutionary change, and its ultimate shape is uncertain. The traditional juvenile court, grounded in optimism about the potential for rehabilitation of young offenders, has long been the target of criticism, and even its defenders have been forced to acknowledge that it has failed to meet its objectives. Beginning in the late 1960s, when the Supreme Court introduced procedural regularity to delinquency proceedings in In re Gault, courts and legislatures began to slowly chip away at the foundations of the juvenile justice system. Recent developments have accelerated and intensified that process, as …

Ethics, Professionalism, And Meaningful Work, William H. Simon Jan 1997

Ethics, Professionalism, And Meaningful Work, William H. Simon

Faculty Scholarship

Much of the anxiety and dissatisfaction associated with legal ethics arises from the categorical quality of the bar's dominant norms. These norms take the form of relatively inflexible rules insensitive to all but a few of the circumstances of the cases they govern. Hence they often require the lawyer to take actions that contribute to injustice or to refrain from actions that would avert injustice.

For example, many lawyers believe that a criminal defender is obliged to impeach a truthful complaining witness even though the only immediate purpose of this tactic is to encourage the trier to draw a mistaken …

Legal Design And The Evolution Of Commercial Norms, Jody S. Kraus Jan 1997

Legal Design And The Evolution Of Commercial Norms, Jody S. Kraus

Faculty Scholarship

The Uniform Commercial Code determines the content of most commercial law default rules by incorporating common merchant practices. The success of this incorporation strategy depends on the likely efficiency of evolved commercial practices. In this Article, I use the best available theory of cultural evolution to analyze how and why commercial practices evolve. This analysis confirms that the incorporation strategy is far superior to a system in which lawmakers rely predominantly on individual analysis and experimentation to design commercial law. But the analysis also demonstrates that common commercial practices, and the laws incorporating them, are unlikely to be optimal, in …

Gluttony, William I. Miller Jan 1997

Gluttony, William I. Miller

Articles

Gluttony does not have the grandeur of pride, the often brilliant strategic meanness of envy and avarice, the glory of wrath. It does manage to gain some small allure by its association with lust, its sexy sibling sin of the flesh. Yet there is something irrevocably unseemly about gluttony, vulgar and lowbrow, self-indulgent in a swinish way. Gluttony is not the stuff of tragedy or epic. Imagine Hamlet too fat to take revenge or Homer making his topic the gluttony of Achilles rather than his wrath. With gluttony, compare pride and anger, sins that mark the grand action of revenge, …

Reading Holmes Through The Lens Of Schauer: The Abrams Dissent, Vincent A. Blasi Jan 1997

Reading Holmes Through The Lens Of Schauer: The Abrams Dissent, Vincent A. Blasi

Faculty Scholarship

Even the best scholars rarely persuade. Mostly, they illuminate. They make us more discerning readers and interlocutors.

Here I want to illustrate how Frederick Schauer's work on the law of free speech can help us to read what may be the single most influential judicial opinion ever written on that subject, Justice Holmes's famous dissent in Abrams v. United States. So far as I am aware, Schauer has not produced anything like a line-by-line parsing of the Holmes opinion. I claim nevertheless that a reader familiar with Schauer's ideas is far better prepared on that account to understand what Holmes …

What Law Is Like, George P. Fletcher Jan 1997

What Law Is Like, George P. Fletcher

Faculty Scholarship

It is not easy to do philosophy in the tradition of Wittgenstein and Malcolm. The human mind gravitates toward authority – the Bible, great teachers, poets, gurus, even judges. Lawyers, in particular, are captives of authoritive constitutions, statutes, cases, and ruling doctrines. We cannot make a move without citing a source as a backup.

Perhaps this is the way it should be, for as lawyers or legal theorists, we speak in a particular legal culture and tradition. We cultivate that tradition, even as we dissent and subject it to criticism. The tradition is defined by the authorities that have shaped …

Nature Of Rules And The Meaning Of Meaning, Kent Greenawalt Jan 1997

Nature Of Rules And The Meaning Of Meaning, Kent Greenawalt

Faculty Scholarship

This essay addresses two problems in legal theory. What is the nature of rules, especially legal rules? What is the meaning of a legal rule?

My main concern is the relation between these two questions. I inquire whether a sensible view of how rules work commits one to any particular approach to meaning. For this inquiry, I focus on Frederick Schauer's illuminating treatment of rules in Playing by the Rules, which he says is linked to a particular view of meaning. I assert that the linkage is much less tight than he supposes, and that competing theories about meaning are …
