Annual Survey Of Virginia Law: Professional Responsibility, James M. Mccauley, Michael L. Rigsby

University of Richmond Law Review

On October 18, 1996, the Virginia State Bar Council (Council) approved a change in the format of the Code of Professional Responsibility (Code) from canons, disciplinary rules, and ethical considerations to the Model Rules of the American Bar Association (Model Rules). The first twenty-one rules, Model Rules 1.1 through 2.5, were approved in substance with some amendments at the Council's meeting on June 19, 1997. This approval represents approximately one-third of the conversion from the Code to the Model Rules. The second installment of the conversion was approved by Council at its October 1997 meeting. Notwithstanding Council's approval of this …

Organized Labor As Shareholder Activist: Building Coalitions To Promote Worker Capitalism, Marleen A. O'Connor Jan 1997

Organized Labor As Shareholder Activist: Building Coalitions To Promote Worker Capitalism, Marleen A. O'Connor

University of Richmond Law Review

In the past, the traditional question posed by unions was: "which side are you on?"--presenting a clear choice between labor and capital. As membership and bargaining power fall, however, unions are asserting their rights as shareholders to influence corporate decision making outside the conventional labor law framework. Because the National Labor Relations Act does not adequately protect workers' rights, unions have devised innovative methods as shareholders to exercise unprecedented power over managers. In only a few years, labor-shareholders have become highly visible players in the institutional shareholder movement. As a group, labor-shareholders submit one of the largest numbers of shareholder …

The American Corporation In The Twenty-First Century: Future Forms Of Structure And Governance, Azizah Y. Al-Hibri Jan 1997

The American Corporation In The Twenty-First Century: Future Forms Of Structure And Governance, Azizah Y. Al-Hibri

University of Richmond Law Review

The last few decades have ushered in many changes and challenges to the American corporation. Foremost among these is the Technetronic or Information Revolution, which paradoxically not only shrank the world (the macrocosm) into a "global village,"' but at the same time expanded the individual human experience (the microcosm) exponentially. This dual action has created the new Global Economic Order, as well as the sphere of customized industrial production.

Hydrogeological And Hydrochemical Connection Between The Decatur City Spring And Crystal Lake, Benton County, Arkansas, Demetra O. Salisbury, Ralph K. Davis Jan 1997

Hydrogeological And Hydrochemical Connection Between The Decatur City Spring And Crystal Lake, Benton County, Arkansas, Demetra O. Salisbury, Ralph K. Davis

Journal of the Arkansas Academy of Science

Arkansas is ranked nationally in the production of broilers, laying hens, turkey, swine and beef cattle. These animals produce large volumes of waste, which are spread on pasture land as a method of disposal, as well as a source of fertilizer, resulting in nonpoint source contamination of surface water and ground water. One area of concern includes the Decatur City Spring, which provides municipal water for the city of Decatur. A total of eight sites in the surrounding area were monitored routinely for water quality parameters, including pH, specific conductance, and nitrate-nitrogen. Water temperature and spring and lake stage were …

The Use Of Mediation And Arbitration For Resolving Family Conflicts: What Lawyers Think About Them, Mary Kay Kisthardt Jan 1997

The Use Of Mediation And Arbitration For Resolving Family Conflicts: What Lawyers Think About Them, Mary Kay Kisthardt

Faculty Works

The use of alternative methods for resolving family conflict has increased significantly in the past few years, but many attorneys are still wary. In an effort to discover some of the sources of this hesitation as well as identify support for "alternative" processes, the American Academy of Matrimonial Lawyers surveyed its members concerning the use of dispute resolution methods. The purpose of this study was to ascertain attorneys' perceptions of the advantages and disadvantages of the two most commonly used alternative dispute resolution mechanisms: mediation and arbitration. Whether clients will continue to use these methods depends in great part on …

Sexuality, Rape, And Mental Retardation, Deborah W. Denno Jan 1997

Sexuality, Rape, And Mental Retardation, Deborah W. Denno

Faculty Scholarship

In this article, Professor Denno addresses the question of when sexual relations with a mentally retarded individual should be considered nonconsensual and therefore criminal. The article first explores the early treatment of mental retardation. It next demonstrates how old stereotypes influence the moralism inherent in modern conceptions of consent in rape determinations. Illustrating the point with reference to the Glen Ridge rape case, the article shows how courts applying contemporary rape statutes typically hold mentally retarded individuals to a higher standard of consent than nonretarded individuals. As a result, courts are hurting the very people they are supposed to protect …

Wood Anatomy Of Buddlejaceae, Sherwin Carlquist Jan 1997

Wood Anatomy Of Buddlejaceae, Sherwin Carlquist

Aliso: A Journal of Systematic and Floristic Botany

Quantitative and qualitative data are presented for 23 species of Buddleja and one species each of Emorya, Nuxia, and Peltanthera. Although crystal distribution is likely a systematic feature of some species of Buddleja, other wood features relate closely to ecology. Features correlated with xeromorphy in Buddleja include strongly marked growth rings (terminating with vascular tracheids), narrower mean vessel diameter, shorter vessel elements, greater vessel density, and helical thickenings in vessels. Old World species of Buddleja cannot be differentiated from New World species on the basis of wood features. Emorya wood is like that of xeromorphic species …

Reemergence Of The Charter Application Debate: Issues For The Supreme Court In Eldridge And Vriend, Richard Fader

Dalhousie Journal of Legal Studies

With the Supreme Court poised to hear the Eldridge and Vriend cases, and the lack of academic and individual consensus on the effectiveness of the government actor test, it appears that we are entering round two of the Charter application debate. The author contends that the threshold approach should be scrapped in favour o f a rights-based analysis, which defines the Charter's scope within the context of the right or freedom in question. Attention is also given to similar issues being examined by the South African Constitutional Court. *** Considérant que la Cour suprême du Canada est prête à entendre …
