Cryptography And Liberty: An International Survey Of Encryption Policy, 16 J. Marshall J. Computer & Info. L. 475 (1998), Wayne Madsen, David L. Sobel, Marc Rotenberg, David Banisar

UIC John Marshall Journal of Information Technology & Privacy Law

The speedy progress of the "digital revolution" has significantly changed the manner in which individuals and other entities communicate and exchange information. Since traditional paper based media for communication is being replaced by high tech means, new security measures such as cryptographic security techniques are sought to ensure individual privacy. This is a drastic change because encryption technology was traditionally utilized by military and diplomatic communications. Human rights activists, political dissidents and journalists employ encryption technology to protect communication from government surveillance. The Global Internet Liberty Campaign ("GILC") was organized to protect civil liberties and human rights in the on-line …

We've Got Your Number: An Overview Of Legislation And Decisions To Control The Use Of Social Security Numbers As Personal Identifiers, 16 J. Marshall J. Computer & Info. L. 529 (1998), Flavio L. Komuves

UIC John Marshall Journal of Information Technology & Privacy Law

In the face of technology which allows for the storage and sharing of information on individuals in an unprecedented way, individuals still maintain the right to informational privacy. However, the extensive use of Social Security numbers as universal identifiers is one of the most serious manifestations of privacy concerns in the United States. Numerous private sources, such as financial institutions and blood banks, and governmental sources, such as the Internal Revenue Service and the courts, use these numbers as identifiers either by voluntary choice or as required by law. Inadequate restrictions on these uses have led to serious violations of …

On-Site Fingerprinting In The Banking Industry: Inconvenience Or Invasion Of Privacy, 16 J. Marshall J. Computer & Info. L. 597 (1998), Patrick J. Waltz Jan 1997

On-Site Fingerprinting In The Banking Industry: Inconvenience Or Invasion Of Privacy, 16 J. Marshall J. Computer & Info. L. 597 (1998), Patrick J. Waltz

UIC John Marshall Journal of Information Technology & Privacy Law

In order to prevent check fraud, many banking institutions are implementing programs of on-site fingerprinting. On-site fingerprinting is a process whereby individuals are subject to fingerprinting before being allowed to cash a check. Currently, two methods are used by the banking industry to obtain these fingerprints. The first method is the old fashioned way which the finger is inked and the ink mark is placed on the back of the check. Today, invisible ink is used. The second means by which these fingerprints are obtained is through biometrics or digital recording. The person attempting to cash a check places his …

Mapping Legal Metaphors In Cyberspace: Evolving The Underlying Paradigm, 16 J. Marshall J. Computer & Info. L. 579 (1998), Robert Reilly Jan 1997

Mapping Legal Metaphors In Cyberspace: Evolving The Underlying Paradigm, 16 J. Marshall J. Computer & Info. L. 579 (1998), Robert Reilly

UIC John Marshall Journal of Information Technology & Privacy Law

Courts often succumb to the temptation to analogize new electronic media to present technologies since the courts can rely upon already existing models. However, the arrival of cyberspace and the World Wide Web has stretched the concept of linking legal precedents to actions to the breaking point. Any attempt to map existing legal metaphors, based on mechanical similarities, onto territory as unknown and changeable as cyberspace is difficult. Instead, it may be more productive to view the World Wide Web as an organic entity or model similar to that of a developing community. The shift from print to electronic information …

Rating Internet Content And The Spectre Of Government Regulation, 16 J. Marshall J. Computer & Info. L. 625 (1998), James V. Dobeus Jan 1997

Rating Internet Content And The Spectre Of Government Regulation, 16 J. Marshall J. Computer & Info. L. 625 (1998), James V. Dobeus

UIC John Marshall Journal of Information Technology & Privacy Law

Parents and legislators have become increasingly concerned about access by children to Internet websites. The Communications Decency Act was the first to attempt to address the issue, but it failed to pass a constitutional challenge. Logically, the next step is to rate websites on the Internet. However, mandatory rating legislation will force providers to rate their sites using rating vocabularies such as RSACi, which they might not agree with. A voluntary rating system or old fashioned parental authority seems like a good solution, but both are based on a subjective determination that everyone may not agree with. Society has a …

Corporate Ethics Training Programs, Bahaudin G. Mujtaba

HCBE Faculty Articles

Ethics establishes the required rules and standards that govern the moral behavior of individuals or groups. It also distinguishes between right and wrong conducts. It involves honest consideration to underlying motive, to possible potential harm, and to congruency with established values and rules. Ethics is a branch of philosophy that theoretically, logically, and rationally determines right from wrong, good from bad, moral from immoral, and just from unjust actions, conducts, and behavior. Applied ethics refers to moral conclusions based on rules, standards, codes of ethics, and models that help guide our decisions.

Private Financing Of Criminal Prosectuions And The Differing Protections Of Liberty And Equality In The Criminal Justice System, Joseph E. Kennedy Jan 1997

Private Financing Of Criminal Prosectuions And The Differing Protections Of Liberty And Equality In The Criminal Justice System, Joseph E. Kennedy

UC Law Constitutional Quarterly

Government prosecutors have begun accepting, and in some cases soliciting, voluntary contributions from the private sector in order to finance certain types of criminal prosecutions. Such private financing introduces a new tension between society's interest in punishing the guilty and society's interest in equal treatment by government. Private financing of criminal prosecution also raises interesting questions as to whether institutions, as opposed to individuals, can be biased by money.

This Article concludes that private financing in any of its likely forms threatens important equality interests. Part I argues that conflict-of-interest rules provide the only protection for important equality interests implicated …

Applications Of Rational Emotive Behavior Therapy In The School Setting, Joanne M. Nelson Jan 1997

Applications Of Rational Emotive Behavior Therapy In The School Setting, Joanne M. Nelson

Graduate Research Papers

As a result of the many demands, as well as lack of time, school counselors need to work with an effective short-term theory. Rational Emotive Behavior Therapy (REBT) fits this description because the general goal of REBT is to attain positive mental health within the least amount of time and with minimal expenditure.

Because of its efficiency, and its applicability to individual, small group, classroom, and adults, school counselors should consider using REBT in the school setting. The preventative and self-help focus of REBT, and the teaching materials developed around this theory fit well into the school setting. By applying …

Cultural Aspects Of Learning Science, William W. Cobern, Glen Aikenhead Jan 1997

Cultural Aspects Of Learning Science, William W. Cobern, Glen Aikenhead

Scientific Literacy and Cultural Studies Project

Over the past few decades our focus on learning science has evolved (Aikenhead, 1996; Cobern, 1993, 1994; Solomon, 1994). The psychological perspectives on the individual learner of earlier years, such as Piaget, Ausubel, and personal constructivism (West and Pines, 1985), have expanded to encompass sociological perspectives that contextualize learning in social settings; for instance, social constructivism, science for specific social purposes, and situated cognition (Goodnow, 1990; Hennessy, 1993; Layton, Davey and Jenkins, 1986; O'Loughlin, 1992; Solomon, 1987; Tharp and Gallimore, 1988). This chapter addresses the next stage in the evolution of our focus on learning science—an anthropological perspective that contextualizes …

Common Law, And Privacy In Computer-Mediated Environments, Stephen D. Cooper Jan 1997

Common Law, And Privacy In Computer-Mediated Environments, Stephen D. Cooper

Communications Faculty Research

Computer-mediated environments pose a special challenge to our legal and cultural protections of privacy. These environments are unprecedented in the way commercially valuable information can be generated in their very use. The ease and low cost with which electronic information can be gathered and disseminated in these environments have led many to advocate regulation protecting privacy interests from commercial encroachment. At the same time, the use of digital communications to support criminal or terrorist activities have led others to advocate regulation allowing law enforcement agencies to eavesdrop or intercept. The cultural history of the Internet as a self-regulating, almost anarchical, …

Boundaries Of Trust And Confidence: Negotiating Evaluation And Research Constraints In The Context Of Kentucky's Systemic Reform, Lois Adams-Rodgers, Jane Clark Lindle Jan 1997

Boundaries Of Trust And Confidence: Negotiating Evaluation And Research Constraints In The Context Of Kentucky's Systemic Reform, Lois Adams-Rodgers, Jane Clark Lindle

Publications

Kentucky's systemic reform initiative has been heralded as one of the more comprehensive and well-sustained reforms in recent history. To evaluate the course of this reform, the challenges associated with researching and evaluating a statewide systemic reform effort are detailed here. By using a description of the politics of evaluating systemic policy at the state level, the paper attempts to fill the gap between the investigation of how policy works and the investigation of how policy is evaluated. An embedded, single-case design was used to study the program over a 3-month period. Examination of the system suggests that the political …

The Media In Black And White, Everette E. Dennis, Ted Pease

Journalism and Communication Faculty Publications

The media's treatment of and interaction with race, like race itself is one of the most sensitive areas in American society. Whether in its coverage and treatment of racial matters or racial connections inside media organizations themselves, mass communication is deeply involved with race. The Media in Black and White brings together twenty journalists and scholars, of various racial backgrounds, to grapple with a controversial issue: the role that media industries, from advertising to newspapers to the information superhighway, play in helping Americans understand race.

Special emphasis is given to some types and patterns of urban unrest, and the structural characteristics associated with deleterious urban environments. Also included is perspective on the contested nature of social relations, the construction of perceptions of social pathology, and some overall …
