What Is Literature? A Definition Based On Prototypes, Jim Meyer
What Is Literature? A Definition Based On Prototypes, Jim Meyer
Work Papers of the Summer Institute of Linguistics, University of North Dakota Session
Most definitions of literature have been criterial definitions, definitions based on a list of criteria which all literary works must meet. However, more current theories of meaning take the view that definitions are based on prototypes: there is broad agreement about good examples that meet all of the prototypical characteristics, and other examples are related to the prototypes by family resemblance. For literary works, prototypical characteristics include careful use of language, being written in a literary genre (poetry, prose fiction, or drama), being read aesthetically, and containing many weak implicatures.

Does Decisonal Law Grant Whites Fewer Political Rights Under The Fourteenth Amendment Than It Grants To Racial Minorities: A Response To Vikram D. Amar And Evan H. Caminker, Thomas E. Wood
UC Law Constitutional Quarterly
In November 1996, the California electorate adoited Proposition 209 (Prop. 209), otherwise known as the California Civil Rights Initiative (CCRI), thereby eliminating all state and local programs that grant "preferential treatment' based on race, sex, color, ethnicity, and national origin in the operation of public employment, education, and contracting. Professors Vikramn D. Amar and Evan H. Caminker have argued in this journal that lower courts, at least, must find CCRI unconstitutional under Washington v. Seattle School District No. 1. This Article is a response to their arguments regarding the constitutionality of CCRI.
This Article begins by noting two crucial differences …

Textualism's Selective Canons Of Statutory Construction: Reinvigorating Individual Liberties, Legislative Authority, And Deference To Executive Agencies, Bradford Mank
Faculty Articles and Other Publications
This Article demonstrates that textualist Judges, most notably Justices Scalia, Thomas, and, to a lesser extent, Kennedy, have applied some canons too aggressively, and slighted others. Textualist Judges have overused clear-statement rules that narrow statutory meaning, especially as a means to promote federalism and states' rights. On the other hand, textualists have neglected canons that promote individual liberty or executive authority Because canons must be applied on a case-by-case basis and different canons can conflict, it is impossible to formulate one rule for how they should be applied. Nevertheless, the common textualist approach of selectively favoring some canons at the …
California Association For Bilingual Education (Cabe) Position Statement On Ebonics, Robert Berdan Ph.D., Terrence Wiley Ph.D., Magaly Lavadenz
California Association For Bilingual Education (Cabe) Position Statement On Ebonics, Robert Berdan Ph.D., Terrence Wiley Ph.D., Magaly Lavadenz
White Papers and Position Statements
In this position statement, the authors write in support of Ebonics (also known as African American Vernacular English, Black English, Black Dialect, and African American Language) as a legitimate language. The linguistic and cultural origins of Ebonics is traced, along with its legitimacy by professional organizations and the courts. CABE asserts that the role of schools and teachers is therefore to build on students’ knowledge of Ebonics rather than replace or eradicate Ebonics as they teach standard English. This position statement has implications for teacher training.

Multi-Criteria Optimization - An Important Foundation Of Fuzzy System Design, Hung T. Nguyen, Vladik Kreinovich
Multi-Criteria Optimization - An Important Foundation Of Fuzzy System Design, Hung T. Nguyen, Vladik Kreinovich
Departmental Technical Reports (CS)
In many real-life design situations, there are several different criteria that we want to optimize, and these criteria are often in conflict with each other. Traditionally, such multi-criteria optimization situations are handled in an ad hoc manner, when different conflicting criteria are artificially combined into a single combination objective that is then optimized. The use of unnatural ad hoc tools is clearly not the best way of describing a very natural aspect of human reasoning. Fuzzy logic describes a much more natural way of handling multi-criterion optimization problems: when we cannot maximize each of the original conflicting criteria 100%, we …
