Patent Law - Infringement - Doctrine Of Equivalents - Prosecution History Estoppel, Charles H. Dougherty Jr. Jan 1997

Patent Law - Infringement - Doctrine Of Equivalents - Prosecution History Estoppel, Charles H. Dougherty Jr.

Duquesne Law Review

The Supreme Court of the United States held that the doctrine of equivalents is not inconsistent with the Patent Act; that the doctrine of equivalents is to be applied to individual elements of a patent claim as opposed to the invention as a whole; that prosecution history estoppel applies to all changes made to an application during prosecution in the form of a rebuttable presumption against the patentee that can be overcome with a sufficient showing that the change was not relevant to patentability.

Trademark Law On The Internet - Will It Scale? The Challenge To Develop International Trademark Law, 16 J. Marshall J. Computer & Info. L. 3 (1997), David W. Maher

UIC John Marshall Journal of Information Technology & Privacy Law

The author states that the rapid growth of the Internet has caused a serious collision between the efficient functioning of Domain Name Systems and the claims of trademark owners. U.S. Courts have recognized that domain names can have trademark implications. Trademarks are important because organizations responsible for allocation and registration of domain names must take trademarks and trademark law into account. The International Trademark Association (INTA) sets forth principles that should apply to the use of trademarks in the Domain Name System. The author's comment focuses on how to accommodate the interests and rights of trademark owners in the DNS …

Cultural Aspects Of Learning Science, William W. Cobern, Glen Aikenhead Jan 1997

Cultural Aspects Of Learning Science, William W. Cobern, Glen Aikenhead

Scientific Literacy and Cultural Studies Project

Over the past few decades our focus on learning science has evolved (Aikenhead, 1996; Cobern, 1993, 1994; Solomon, 1994). The psychological perspectives on the individual learner of earlier years, such as Piaget, Ausubel, and personal constructivism (West and Pines, 1985), have expanded to encompass sociological perspectives that contextualize learning in social settings; for instance, social constructivism, science for specific social purposes, and situated cognition (Goodnow, 1990; Hennessy, 1993; Layton, Davey and Jenkins, 1986; O'Loughlin, 1992; Solomon, 1987; Tharp and Gallimore, 1988). This chapter addresses the next stage in the evolution of our focus on learning science—an anthropological perspective that contextualizes …

Using The Arts To Decrease The Educational Failure Of At-Risk Students, Agnes L. Scott Jan 1997

Using The Arts To Decrease The Educational Failure Of At-Risk Students, Agnes L. Scott

Graduate Research Papers

The number of at-risk students who are destined for educational failure, quitting school before graduation or by not learning while attending school, is increasing at an unprecedented rate (Office of Educational Research and Improvement, 1992). If America does not sufficiently educate its increasing numbers of at-risk students, the nation's social and economic status may suffer due to a deteriorated educational system. These national concerns provide an opportunity to address appropriate educational interventions to help at-risk students. This paper will review the literature which suggests using the arts to decrease the educational failure of at-risk students.

Beyond Burritos And Lumpia: Ethnic Identity As A Difference In Preservice Teacher Education, Sara Soledad Garcia, E. Litton Jan 1997

Beyond Burritos And Lumpia: Ethnic Identity As A Difference In Preservice Teacher Education, Sara Soledad Garcia, E. Litton

Teacher Education

Teachers play a pivotal role in society. On a daily basis they influence the futures of the children they encounter. Not only do they teach children how to read and write butteachers are also charged with the task of creating responsible citizens who should think critically about society. Teacher educators, and specifically those individuals charged with the task of preparing preservice teachers, have responsibilities similar to teachers in the field. Education, on any level, ought to be a transformative process.

Thus, the preparation of teachers as instruments of social change ought to be a central focus in preservice teacher education …

Self Narrative And The Process Of Inquiry In Teacher Development: Living And Working In Just Institutions, Sara Soledad Garcia Jan 1997

Self Narrative And The Process Of Inquiry In Teacher Development: Living And Working In Just Institutions, Sara Soledad Garcia

Teacher Education

Historically the cultures of certain ethnic groups in the United States have been rendered invisible in school pedagogy. New stipulations for credentialing in California, however, require teachers to reflect critically upon the meaning of cultural difference, including their own thinking and lived experience as well as the lives, backgrounds, and cultural history ofthe children they teach. To be effective in culturally diverse classrooms, teachers must confront certain contradictions in their own identity. Most teacher candidates have shaped their identity according to a set of mainstream values and beliefs that has denigrated cultural difference. The personal confrontation with difference and self-identity …

Academic Mestizaje: Re/Producing Clinical Teaching And Re/Framing Wills As Latina Praxis, Margaret E. Montoya Jan 1997

Academic Mestizaje: Re/Producing Clinical Teaching And Re/Framing Wills As Latina Praxis, Margaret E. Montoya

Faculty Scholarship

What follows is an analysis that draws connections between activist teaching and activist scholarship and posits that it is the activism, the focus on the needs of Latinas/as, that makes them community service. In Part I, I describe the community lawyering program, one of the clinical law options, available at the University of New Mexico School of Law. In Part Il, I undertake to re-frame the law of wills in order to make this end-of-life ritual more relevant to the lives of Latinas/os. I then I enact a LatCritique of academic discussions and Outsider discourses. I conclude by examining our …

Is Tobacco A Drug? - Administrative Agencies As Common Law Courts Regulations, Cass R. Sunstein Jan 1997

Is Tobacco A Drug? - Administrative Agencies As Common Law Courts Regulations, Cass R. Sunstein

Articles

Professor Cass Sunstein argues that the FDA has the authority to regulate tobacco products. He considers the text of the Federal Food, Drug, and Cosmetic Act, which supports the FDA assertion, and the context of its enactment, which argues against the FDA. He resolves the tension between text and context in favor of FDA jurisdiction by turning to the emerging role of administrative agencies. In modem government, he contends, administrative agencies have become America's common law courts, with the power to adapt statutory regimes to new facts and new values when the underlying statute is ambiguous. Professor Sunstein's Article, like …

Writing Science Through Critical Thinking, Marilyn F. Moriarty Jan 1997

Writing Science Through Critical Thinking, Marilyn F. Moriarty

Books by Hollins Faculty and Staff

Written and extensively class tested with NSF/NIH support, this timely and useful text addresses a crucial need which is acknowledged in most universities and colleges. It is the need for students to learn to write in the context of their field of study; in this case science. Although numerous "how to" writing books have been published, few, if any, address the central pedagogical issues underlying the process of learning to think and write scientifically. The direct connection between this writing skill and that of critical thinking is developed with engaging style by the author, an English professor. Moriarty's book is …

Common Roots But Modern Divergences: Aboriginal Policies In Canada And The United States, Bradford W. Morse

St. Thomas Law Review

In this essay, I will attempt to provide an overview of some of the major issues that confront Aboriginal and non-Aboriginal Canadians in their search to forge a reconciliation that overcomes historic injustices committed upon the First Peoples of the land now known as Canada and to establish a new relationship built upon trust and mutual respect. I will also offer some insights on the negotiations underway acquired from the vantage point of someone who has served as a legal advisor to many First Nations and Aboriginal organizations for sixteen years, followed by three years as chief of staff to …
