Constitutionality Of Power Of Sale Foreclosures By Federal Government Entities, The, Daniel E. Blegen
Constitutionality Of Power Of Sale Foreclosures By Federal Government Entities, The, Daniel E. Blegen
Missouri Law Review
When loaning money, lenders often require that obligations be secured by a mortgage on real estate owned by the borrowers. In Missouri, the prevailing form of mortgage is the deed of trust with a power of sale provision. Upon default the trustee is allowed to sell the property without a judicial hearing and after giving only limited notice.' The constitutionality of nonjudicial power of sale foreclosures is well settled as applied to private lenders because of the lack of state or federal notice requirements for the particular county, and the mortgagor's only recourse is to pay the entire amount due …
An Opportunity Lost: The United Kingdom's Failed Reform Of Defamation Law, Douglas W. Vick, Linda Macpherson
An Opportunity Lost: The United Kingdom's Failed Reform Of Defamation Law, Douglas W. Vick, Linda Macpherson
Federal Communications Law Journal
The Defamation Act 1996 is the first major piece of libel legislation in Britain since the Defamation Act 1952. The British Parliament passed the Act in response to the ease with which libel plaintiffs can establish liability and in response to huge damage awards. In passing the Act, Parliament attempted to shift the balance of defamation law away from protecting the reputational interest of plaintiffs and toward protecting free discussion and open criticism. However, the Act merely fine-tunes current law. The Act reduces the limitations period for defamation suits, introduces procedural reforms to simplify and reduce libel suits and permits …
Structural Change And Inter-Professional Competitive Advantage: An Example Drawn From Residential Real Estate Conveyancing, Michael Braunstein
Structural Change And Inter-Professional Competitive Advantage: An Example Drawn From Residential Real Estate Conveyancing, Michael Braunstein
Missouri Law Review
This article examines the role of attorneys and other professionals in a highly structured and routine transaction-residential real estate conveyancing. The article explains how United States lawyers lost the monopoly they once enjoyed over residential real estate conveyancing and how structural change, whether economic, technological, or both, influences the demand for professional, including legal services. Part II of this article reviews the academic literature concerning the role of the lawyer in residential real estate transactions. Part III analyzes the structural changes that resulted in the marginalization of lawyers in the residential transaction and demonstrates how the change in structure of …

Inside The Law: Canadian Law Firms In Historical Perspective, Douglas C. Harris
Inside The Law: Canadian Law Firms In Historical Perspective, Douglas C. Harris
Dalhousie Law Journal
This collection of essays edited by Carol Wilton' chronicles the changing character of Canadian law firms from the "golden age" of the sole practitioner in the nineteenth century to the mega-firms of the late twentieth. Most of the essays describe the changing profession through a case study of a single lawyer or firm, and Wilton has collected a representative sample of firms from across the country. Some of the firms remained small or disappeared, while others grew into full-service corporate commercial law firms of several hundred lawyers. Most of the essays focus on the personalities of the lawyers involved, their …

Medical Malpractice And Managed Care Organizations: The Implied Warranty Of Quality, William S. Brewbaker Iii
Law and Contemporary Problems
Managed care organizations (MCOs) have become prime targets in the new medical malpractice litigation, but getting a judgment against an MCO can be difficult. It is argued that courts should impose a tort-based implied warranty of quality on MCOs, under which they would be liable for selling physician services that are negligently rendered.

Seeking Shelter In The Minefield Of Unintended Consequences – The Traps Of Limited Liability Law Firms, Susan Saab Fortney
Hofstra Law Faculty Scholarship
This article addresses the overlooked negative consequences of law firms transitioning from a traditional partnership to a limited liability partnership or company. Part I of this article introduces the topic by providing a brief history of the development of LLCs and LLPs and noting the lack of attention given to the detrimental consequences of such firm structures. Part II reviews the forces behind the limited liability movement and the emergence of limited liability law firms. Part III surveys the statutory approaches to limiting vicarious liability in LLCs and LLPs. Part IV then examines possible internal consequences of attorneys’ practicing as …
Welfare Reform In The United States, Joel F. Handler
Welfare Reform In The United States, Joel F. Handler
Osgoode Hall Law Journal
Advanced countries that are experiencing high unemployment are reconsidering their generous welfare states in light of the American experience. This article sets forth a summary of the principles of the U.S. welfare reform -particularly enforcing work requirements by time-limited welfare-as well as the assumptions, including, principally, that welfare destroys work incentives and that jobs are available for those who want to work. In fact, most welfare recipients have extensive connections to the labour market, but cannot survive on either jobs or welfare. If the reforms are carried out as intended, severe hardship will result. The predicted outcome is that most …
