Does The Violence Against Women Act Do Violence To The Limits Of Congressional Power?, Derek A. Kurtz May 1997

Does The Violence Against Women Act Do Violence To The Limits Of Congressional Power?, Derek A. Kurtz

San Diego Law Review

This Comment explores whether the Violence Against Women Act, passed in 1994, is a legitimate act of Congress under the U.S. Constitution. Congress relied on its commerce power in order to enact this interstate domestic violence law. Congress also relied on its power under Section 5 of the Fourteenth Amendment to enact the civil rights cause of action for victims of gender-motivated violence. This Comment discusses Congress' commerce power in light of United States v. Lopez, decided in June 1995. It also discusses whether Congress allowed equal protection under the law with regard to the civil rights cause of action …

"Freedom Of Assembly" And The Right To Passage In Modern English Legal History, Rachel Vorspan May 1997

"Freedom Of Assembly" And The Right To Passage In Modern English Legal History, Rachel Vorspan

San Diego Law Review

This Article explores the "right to passage" and its corollary, the nuisance doctrine of "obstruction of the highway" in modern English legal history. The author traces the origins of these doctrines and examines critical periods in history when the right to passage was used to cope with street demonstrations. She argues that the general pattern throughout history of under-enforcing obstruction law nourished a popular belief in a right to assemble that was inconsistent with the formal legal status of meetings. She concludes that since the 1960s, this has prompted increasing calls for formal recognition of "freedom of assembly."

Realizing The Re-Emergence Of The Chinese Stock Market: Fact Or Fiction?, Ann P. Vandevelde May 1997

Realizing The Re-Emergence Of The Chinese Stock Market: Fact Or Fiction?, Ann P. Vandevelde

Vanderbilt Journal of Transnational Law

The stock market which currently exists in the People's Republic of China (PRC) is a product of the "open door policy" introduced by Deng Xiaoping in 1978, following the death of Mao Zedong, to promote economic development over class struggle. Following limited experimentation with stock issuance at the local level, the Shanghai and Shenzhen stock exchanges opened in 1990 and 1991 respectively. Since its recent inception, China's stock market--which comprises the trading of domestically owned A-Shares and foreign-owned B-Shares--has experienced impressive growth together with periods of volatility as well as lackluster performance. Recent performance of A-Share trading has been strong, …

United States V. Virginia's New Gender Equal Protection Analysis With Ramifications For Pregnancy, Parenting, And Title Vii, Candace S. Kovacic-Fleischer May 1997

United States V. Virginia's New Gender Equal Protection Analysis With Ramifications For Pregnancy, Parenting, And Title Vii, Candace S. Kovacic-Fleischer

Vanderbilt Law Review

In this Article, Professor Kovacic-liTeischer argues that the Supreme Court's recent decision in United States v. Virginia raises gender equal protection analysis to the level of strict scrutiny. Professor Kovacic-Fleischer asserts that the Court's refusal to accept as immutable VMI's single-sex institutional design, and the Court's requirement that VMT make adjustments and alterations that will enable qualified women to undertake VM's curriculum evidences this shift in gender equal protection analysis. Professor Kovacic-Fleischer then turns to the significance of the Court's citation to California Federal Savings & Loan Association v. Guerra. She asserts that this citation indicates that the Court effectively …

Effects Of Tsetse Dna Virus Infection On The Survival Of A Host Fly,Glossina Morsitans Centralis(Diptera; Glossinidae), Rosemary C. Sang, Walter G.Z.O. Jura, Leonard H. Otieno, Peter M. Tukei, Richard W. Mwangi May 1997

Effects Of Tsetse Dna Virus Infection On The Survival Of A Host Fly,Glossina Morsitans Centralis(Diptera; Glossinidae), Rosemary C. Sang, Walter G.Z.O. Jura, Leonard H. Otieno, Peter M. Tukei, Richard W. Mwangi

All Peer-Reviewed Publications

Freshly deposited third instarGlossina morsitans centralislarvae were infected with the tsetse DNA virus by microinjection. At emergence comparative observations were made on longevity and feeding behavior of infected and control flies. Gut tissues from the control and virus-infected flies were fixed and processed for light and electron microscopy. The longevity of infected flies was significantly reduced compared to that of the controls (P<0.05). The main mortality factors in the virus-infected flies with severe lesions in the salivary glands were starvation due to failure to feed and clotting of blood in and/or rupture of the crop. Rupture of the midgut also caused some mortalities. Infected flies probed significantly more times during feeding to repletion (P<0.05) and took significantly longer to feed compared to the control flies (P<0.05). Infected flies which fed took significantly less blood compared to the controls (P<0.05). Histological studies revealed pathological changes in the epithelial cells of the anterior midgut secretory midgut and the posterior midgut. There was severe disintegration of the membranous organelles, especially the mitochondria and rough endoplasmic reticulum, leading to extensive vacuolation in such epithelial cells. No viral particles were observed in the secretory and posterior midgut. Virions were observed in the anterior midgut lumen and occasional particles were seen invading the epithelial cells in this area of the midgut, especially in heavily infected flies. © 1997 Academic Press.

Haemolymph Ecdysteroids And The Prothoracic Glands In The Solitary And Gregarious Adults Of Schistocerca Gregaria, Amer I. Tawfik, Anna Vedrová, Weiwei Li, František Sehnal, D. Obeng-Ofori May 1997

Haemolymph Ecdysteroids And The Prothoracic Glands In The Solitary And Gregarious Adults Of Schistocerca Gregaria, Amer I. Tawfik, Anna Vedrová, Weiwei Li, František Sehnal, D. Obeng-Ofori

All Peer-Reviewed Publications

The haemolymph titre of ecdysteroids rises in the adults of both sexes to a brief peak in the first week after emergence. A major rise begins on days 8-10, coincidentally with intensive vitellogenesis in the females and aggregation pheromone production in the males. The titre reaches about 400 ng of 20-hydroxyecdysone (20E) equiv./ml in the solitary, but less than 150 ng/ml in the gregarious adults of both sexes. In the females, the titre drops after oviposition (prior to day 20) and remains low until the next egg batch matures; then it increases in either phase to 150-180 ng/ml. A similar …

A Comparative Analysis Of Seven Published Self-Report Measures For Assessing Internalizing-Type Symptoms In Children And Adolescents, Kathryn E. Anderson May 1997

A Comparative Analysis Of Seven Published Self-Report Measures For Assessing Internalizing-Type Symptoms In Children And Adolescents, Kathryn E. Anderson

All Graduate Plan B and other Reports, Spring 1920 to Spring 2023

The broad domain of internalizing disorders encompasses a variety of symptoms that are specific to child and adolescent populations and generalizable to adult populations. Internalizing disorders, commonly referred to as " emotional problems," include such problems as depression, anxiety, social withdrawal, somatic complaints, and low self-esteem. The other side of this classification dichotomy is that of externalizing disorders (e.g., conduct disorder, attention-deficit hyperactivity disorder), which involve overt behaviors considered as "undercontrolled". In contrast, internalizing problems involve behaviors that possess an "overcontrolled" quality. Such a covert nature leads to difficulty in identification and diagnosis, as they often go unnoticed by the …

Homology Among The Autosomal Chromosomes Of Boophilus Annulatus (Say) And B. Microplus (Canestrini), Bonnie S. Gunn May 1997

Homology Among The Autosomal Chromosomes Of Boophilus Annulatus (Say) And B. Microplus (Canestrini), Bonnie S. Gunn

Theses and Dissertations - UTB/UTPA

Autosomes of Boophilus annulatus and B. microplus were compared using C- and G-bands to establish the degree of homology. Karyotypes of both species consisted of 20 autosomes and an XX:XO sex determination system with the X being the largest chromosome. All chromosomes of B. annulatus were acrocentric with heterochromatin limited to centromeric regions. The B. microplus karyotype was acrocentric with one band of noncentromeric heterochromatin occurring in three chromosome pairs. Interspecific comparisons indicated seven pairs of G-band homologous autosomes and three G-band homologous pairs when added interstitial heterochromatin was considered. The number three chromosome of both species showed variation in …

The Effects Of Individual, Contextual, And Moral Intensity Factors On Environmental Ethical Decision Making, Brenda L. Flannery May 1997

The Effects Of Individual, Contextual, And Moral Intensity Factors On Environmental Ethical Decision Making, Brenda L. Flannery

College of Business: Dissertations, Theses, and Student Research

Most extant studies of organizational ethical decision making have been remiss in doing one or more of the following: (a) building theoretical foundations; (b) encompassing the individual. contextual, and issue-specific determinants impacting ethical judgments; (c) offering testable hypotheses; and/or (d) establishing methodological rigor. This study confronted those challenges aiming to understand the decision intentions of top managers in the metal finishing industry concerning the treatment of hazardous wastewater.

This study employed an extended version of Ajzen's (1988) theory of planned behavior. The theory accommodatingly modeled the individual (i.e., attitudes, self-efficacy. personal moral obligation), contextual (subjective norms, organizational climate, and financial …

Farmsteads As Mirrors Of Cultural Adjustments And Change: The Ukrainian Canadian Experience, James W. Darlington May 1997

Farmsteads As Mirrors Of Cultural Adjustments And Change: The Ukrainian Canadian Experience, James W. Darlington

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

Farmsteads reflect more than the nature and health of agricultural activity on individual farms and across geographic regions; they provide a reliable record of other aspects of cultural and economic adjustment and change. This paper considers the farmsteads constructed by the Ukrainian immigrants and their descendants who settled in one district of the Canadian prairies beginning in 1896. A field survey of four townships reveals that between the time of initial settlement and the present four distinct generations of farm structures were erected. These generations of buildings-labeled here pioneer, traditional, transitional, and modern provide clear evidence of the economic progress …

Characteristics Of Elders As Leaders In Christian Churches/Churches Of Christ In The Year 2010: A Delphi Study, Peter N. Cummins May 1997

Characteristics Of Elders As Leaders In Christian Churches/Churches Of Christ In The Year 2010: A Delphi Study, Peter N. Cummins

Electronic Theses and Dissertations

The purpose of this study was to compose a profile of characteristics of a competent elder as a leader of Christian churches/churches of Christ for the year 2010. An essential component of this composition was the identification of issues that elders are likely to face in the 21st century church. A second objective was to identify effective ways in which elders can be prepared to meet the challenges of leading congregations in the beginning of the 21st century. A Delphi Technique was applied in this study since it is a particularly efficient research tool used in building consensus and in …

Characterization Of Angiotensin Ii Receptor Subtypes In The Brain, David L. Saylor May 1997

Characterization Of Angiotensin Ii Receptor Subtypes In The Brain, David L. Saylor

Electronic Theses and Dissertations

The present studies explore binding, distribution, and function of angiotensin II (AII) receptors (AT$\sb1$ and AT$\sb2)$ in the brain. The discovery that sulfhydryl reducing agents masked some but not all AII receptors in the brain prompts an evaluation of commonly used binding assay buffer constituents. EDTA enhances binding (40%) at both AT$\sb1$ and AT$\sb2$ nuclei, while bacitracin did not alter binding at either receptor subtype. Phenanthroline and BSA differentially altered binding at AT1 (220% of control) and AT$\sb2$ (118% of control) receptors. The results indicate that phenanthroline and BSA would be poor buffer constituents for studies comparing binding at AT$\sb1$ …

Devolpment Of A Scale To Assess Home Health Care Aides' Ability To Recognize Depression In Older Adults, Tina M. Nerney

Community & Environmental Health Theses & Dissertations

Depression afflicts 20% to 40% of people 65 and older. Depression in older adults is frequent and chronic. The challenge of a hospital stay and the knowledge of having a long term disability may increase the risk for a depressive episode. In today's health care environment older adults are being released from hospitals after a short length of stay and are frequently dependent on home health services for assistance with activities of daily living. Home health care aides are given the responsibility of providing these services to the older adult in the home environment and need to be aware of …

Comments From A United Kingdom Perspective, Anthony W. Bradley

Cardozo Law Review

The given facts require us to consider whether Harmonia's National Brotherhood and Sisterhood Youth Organisation Act (the "Act") and action taken under it infringe the requirement that all legislation in Harmonia must conform with constitutional standards of liberty, equality, solidarity, and tolerance. Since judicial review of primary legislation is not possible under the unwritten constitution of the United Kingdom, British legal experience has nothing to say on the main issues of constitutionality.

Tnt-Contaminated Soils Remediation For Volunteer Army Ammunitions Plant, Janice Tevonia Russell Horn May 1997

Tnt-Contaminated Soils Remediation For Volunteer Army Ammunitions Plant, Janice Tevonia Russell Horn

Masters Theses and Doctoral Dissertations

Many facilities involved in the production of munitions, or with a history of munitions production or storage, are faced with the remediation of residual explosives in soil, groundwater and process wastewater. This requirement has become particularly prevalent with the closing of many military installations across the country. The Volunteer Army Ammunition Plant (V AAP) is a 6,681 acre Government owned and contractor-operated facility for the production and storage of trinitrotoluene (TNT). Two (2) technologies were investigated for TNT (nitroaromatic explosive) contaminated soils remediation. The technologies are phytoremediation and thermal incineration. Phytoremediation is an in-site wetlands-type remediation which uses plants. Thermal …
