Bioethics Is The Language Of The Law, Carl E. Schneider
Bioethics Is The Language Of The Law, Carl E. Schneider
Law Quadrangle (formerly Law Quad Notes)
What happens when the language of the law becomes a vulgar tongue? What happens, more particularly, when parties to bioethical discourse are obliged to borrow in their daily controversies, the ideas, and even the language, peculiar to judicial proceedings? How suited are the habits, taste, and the language of the judicial magistrate to the political, and more particularly, the bioethical, questions of our time?
This article is based on one originally published in theHastings Center Report (24, No. 4, 1994): 16-22, "Bioethics in the Language of the Law." It will appear as part of a forthcoming book on the …

The appeal of a life of civic responsibility and action, or "civility," seems to me to lie not only in the necessarily vain, but deeply human, hope of immortality, but to have a more immediate ground or basis …

Law Quadrangle (formerly Law Quad Notes)
Laws that treat married persons in a different manner than they treat single persons permeate nearly every field of social regulation in this country - taxation, torts, evidence, social welfare, inheritance, adoption, and on and on.

The Legal Consequences of Marriage and the Legal Needs of Lesbian and Gay Male Couples," which appeared in 95 Michigan Law Review 447-491 (1996) and is printed with permission from the journal and the author. Antitrust, Michael Eric Ross, Jeffrey S. Cashdan
Mercer Law Review
The Eleventh Circuit Court of Appeals issued seven antitrust decisions in 1996. Only one opinion addressed substantive antitrust issues. The others turned on procedural or immunity grounds. Antitrust defendants continued their dominance on appeal, prevailing in all but one action.
Evidence, Marc T. Treadwell
Evidence, Marc T. Treadwell
Mercer Law Review
Previous surveys have addressed the trend--or at least what the author perceives to be the trend--of the Eleventh Circuit Court of Appeals in recent years to defer to district court judges' evidentiary decisions. This recent trend can be contrasted with the activism displayed by Eleventh Circuit judges in decisions discussed in earlier survey articles. The effects of this more recent trend are fewer cases in which the Eleventh Circuit devotes extensive examination of evidentiary issues and, when evidentiary issues are addressed, marked deference to district court judges. Although this trend appeared to continue during the current survey period, two decisions …

Workers' Compensation And The Compensability Of Attenuated Injuries: "One Man's Stress Is Another Man's Pleasure", Jack Pritchard
Mercer Law Review
The compensability of stroke-related deaths in workers' compensation cases is a hotly contested matter, and the compensability of strokes precipitated by so-called job-stress has run a dividing line between Georgia courts. This Article will provide the reader with the history of the law which gave rise to this particular issue and develop the controversy while determining the reasoning behind the opposing opinions. This Article will also provide the reader with some insight into the practical effects of a Georgia Supreme Court decision on this issue one way or another.
In order to aid the reader in a more complete understanding …

This working paper presents findings from the second annual Nebraska Rural Poll. The study is based on 3,264 responses from households in the 87 nonmetropolitan counties in the state. The objectives of this paper are to answer the following questions:
1. Has the well-being of rural Nebraskans changed from what they reported in the first annual Rural Poll?
2. All things considered, do rural Nebraskans believe they are better off today than five years ago, and do they believe they are better off than their parents were at their age?
3. Do rural Nebraskans believe they will be better or …

Subrogation Of Personal Injury Claims: Toward Ending An Inequitable Practice, Keith E. Edeus Jr.
Subrogation Of Personal Injury Claims: Toward Ending An Inequitable Practice, Keith E. Edeus Jr.
Northern Illinois University Law Review
This comment examines the application of the principles of subrogation in the personal injury context. Current law in most states, including Illinois, allows insurance companies to recover their subrogation interests even when insureds have not been made whole. The author suggests legislative and judicial approaches for limiting the applicability of subrogation in such situations.
