The Least Among Us: Unconstitutional Changes In Prisoner Litigation Under The Prison Litigation Reform Act Of 1995, Julie M. Riewe
The Least Among Us: Unconstitutional Changes In Prisoner Litigation Under The Prison Litigation Reform Act Of 1995, Julie M. Riewe
Duke Law Journal
I don't like prisoners. Nobody pretends to like them, but every once in a while, one of these people is right. And a society is judged by how it treats the least among it, not the best. I'm not worried about how presidents of banks and chairmen of the board and of country clubs are treated, or star quarterbacks, or other prima donnas. The job of the Constitution is to make sure that everyone is treated properly. [Prisoners] fall[] into the everybody category.
A Politics Of Intellectual Property: Environmentalism For The Net?, James Boyle
A Politics Of Intellectual Property: Environmentalism For The Net?, James Boyle
Duke Law Journal
This Essay argues that we need a politics, or perhaps a political economy, of intellectual property. Using the controversy over copyright on the Internet as a case study and the history of the environmental movement as a comparison, it offers a couple of modest proposals about what such a politics might look like-what theoretical ideas it might draw upon, and what constituencies it might unite.

Symbolic Statues And Real Laws: The Pathologies Of The Antiterrorism And Effective Death Penalty Act And The Prison Litigation Reform Act, Mark Tushnet, Larry Yackle
Duke Law Journal
Criminals are not popular. No politician in recent memory has lost an election for being too tough on crime. In 1996, the Republican Congress and the Democratic President collaborated on two major statutes affecting the legal protections available to criminals. The Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA) modifies the habeas corpus statute in a number of ways, affecting the disposition of federal post-conviction challenges to all criminal convictions, not just those resulting in death sentences. The Prison Litigation Reform Act (PLRA) addresses lawsuits filed by prisoners challenging the conditions of their confinement. The PLRA covers both suits …

Health Care Marketing And The Internet, C. David Shepherd, Daniel Fell
Faculty Articles
This article presents research on the growing number of health care providers using the Internet as a health care marketing tool in the U.S. The author notes that the Internet is changing the way consumers seek healthcare related information as well as the way it can be provided to them. The results of the study suggest that consumers will increasingly rely on sources like the Internet for information, that health information will be a commodity on the Internet, that the Internet will help build relationships between providers and consumers and that marketers will be expected to develop and manage Internet-related …
Franchisor Environmental Liability For Previously Contaminated Property, Patrick J. Kaufmann, William S. Vincent
Franchisor Environmental Liability For Previously Contaminated Property, Patrick J. Kaufmann, William S. Vincent
Faculty Articles
Environmental legislation has created potential liability for retailing franchisees that purchase previously contaminated land. Faced with a decision to distance itself from the site selection process or incur the added costs and potential pricing impacts of greater involvement in the process, franchisors have strong incentives to reduce franchisee support. This reduction in support has detrimental implications for both franchise policy and environmental policy. A paper reports the results of an empirical study that links franchisors' concerns about potential environmental liability to actions to distance themselves from the site selection process or, alternatively, formally to require franchisee environmental investigation of all …

Differences In Married Versus Maritally Disrupted Children's Frequency Of Contact With Their Mothers, Sonya Dee Thompson
Differences In Married Versus Maritally Disrupted Children's Frequency Of Contact With Their Mothers, Sonya Dee Thompson
Sociology & Criminal Justice Theses & Dissertations
This study explores the effects of children's marital status on the frequency of contact they have with their mothers. As American society ages and marital disruption remains high, it is important to determine if there are differences in the relationships adult children have with their aging parents. A secondary analysis was conducted on data collected in 1986 for the General Social Survey. Two hypotheses were created from theory:
(1) From dependency and obligation theories, it was predicted that maritally disrupted adult children would report having greater contact with their mothers than married adult children.
(2) From status and resource adjustment …
Minimizing Post-Production Weight Growth In Tanks Using A Decision Analysis Model, Michael F. Cochrane
Minimizing Post-Production Weight Growth In Tanks Using A Decision Analysis Model, Michael F. Cochrane
Engineering Management & Systems Engineering Theses & Dissertations
Post-production weight growth of tanks is an historic problem for the military. Tanks are difficult to transport because of their weight, and post-production modifications tend to cause this weight to increase over the lifecycle of the tank. In this thesis, a computer model is constructed which uses influence diagrams to model tank weight growth as a probabilistic process. Historical weight data for the MI Abrams tank program is used to derive probabilities for the model. The model is used to predict tank weight growth over both the short and long term with the goal of understanding more about how and …
A Proposed Approach To Iso Compliance And Validation For Metrology Laboratories, J. Lyle Bagley
A Proposed Approach To Iso Compliance And Validation For Metrology Laboratories, J. Lyle Bagley
Engineering Management & Systems Engineering Theses & Dissertations
International competition among metrology laboratories, as well as their customers, has intensified the incentive to seek either accreditation to ISO Guide 25 or ISO 9000 quality system registration for the laboratory. The debate continues as to which is more beneficial to the laboratory and its customers once the decision is made to pursue one or the other. This study addresses the advantages and limitations of each, and how best to prepare for complying with ISO standards. The literature was reviewed and ISO certification experts were questioned about these issues. The results were combined with new applications of existing operations research …
Death Anxiety As A Moderation Factor On Sexual Behavior Related To The Risk Of Hiv Infection In Young Adults, John Hawes Jones
Death Anxiety As A Moderation Factor On Sexual Behavior Related To The Risk Of Hiv Infection In Young Adults, John Hawes Jones
Psychology Theses & Dissertations
This study was conducted to determine whether there is a relationship between level of death anxiety and risky sexual behavior that may lead to HIV/AIDS. It was hypothesized that the higher one's death anxiety level the less an individual would engage in high risk behavior. A sample of 151 young adult college students with a mean age of 22.6 years completed the Revised Death Anxiety Scale (RDAS). The survey also asked the participants to list the extent that they have engaged in six sexual behaviors known to increase one's risk of HIV infection. The participants also completed a 12 question …

Effects Of A Circuit Weight Training Program On The Body Images Of College Students, Pamela Ann Williams
Psychology Theses & Dissertations
The present study was conducted to determine the extent to which participation in a circuit weight training program would lead to improvements in body image and physical self-efficacy, as compared to a matched control group. Thirty-nine experimental subjects participated in a 6-week circuit weight training class, while 39 subjects in a matched comparison group did not engage in any weight training. All subjects completed the Multidimensional Body Self-Relations Questionnaire, the Social Physique Anxiety Scale, and the Physical Self-Efficacy Scale at pre- and posttest points. Experimental subjects also completed tests of muscular strength and the Reasons for Exercise Inventory. The results …

If It Sells Soap It Can Help Sell Innovations: A Useful Lesson From Marketing, Thomas J. Bierma, Frank L. Waterstraat, Grear Kimmel, Paul Nowak Jr
Journal of Extension
Promoting innovations is an act of marketing. Carefully conceived marketing plans can greatly enhance success. Understanding that different market segments have different product and information needs is a basic concept in commercial marketing. "Innovativeness" and "Stage in the adoption process" are two useful ways of segmenting a market. The Innovativeness-Stages Matrix, combined with an understanding of the different needs of market segments, provides a powerful tool for focusing marketing efforts without extensive marketing research or resources.

County Extension Agents And On-Farm Research Work: Results Of A Kansas Survey, David Norman, Stanley Freyenberger, Bryan Schurle
Journal of Extension
This paper reports the results of a survey designed to ascertain information about on-farm research, that is, on-farm work (OFW) implemented by county Extension agents (CEAs) in Kansas. The survey collects information on the types of OFW, who was responsible for it, what data were collected, what was done with the results, and attitudes of CEAs toward OFW. The survey results indicate that OFR associated with CEAs in Kansas is fairly common, that CEAs have positive attitudes for OFR and play important roles in initiating, implementing, analyzing, and distributing the results of such work, but major constraints exist to expanding …
Building Bridges - An Intergenerational Program, Nina Chen
Building Bridges - An Intergenerational Program, Nina Chen
Journal of Extension
Long-distance grandparents and grandchildren are common and may have resulted in growing tensions between young and old. Building Bridges provides opportunities for children to learn and interact with seniors as well as for seniors to share their talents and enjoy being with children for meaningful experiences. Education, friendships, and caring are main components. Without funding support, 23 agencies, schools, nursing homes, 10 volunteers, 900 children, and 520 frail and home bound seniors were reached. Evaluation showed that the program has made a significant impact on the children and seniors.

Backpack Buddies: A Newsletter Series For Parents, Rose Fisher Merkowitz, Kathy Jelley, Elaine Collins, Carol Ford Arkin
Journal of Extension
Family and Consumer Sciences educators continually have parents expressing need for information to help them deal with the challenges faced in raising children. These same parents, however, are often reluctant to attend formal parenting classes. "Backpack Buddies" is an innovative monthly newsletter series designed to send home in the backpacks of kindergarten students. A survey of parents receiving the newsletter for one year revealed positive findings. Seventy-seven percent of respondents liked receiving parenting information in the newsletter format and 85% found the information helpful in coping with child rearing challenges.
Thermal And Mechanical Behavior Of Cryogenic Propellant Tank Concepts For Advanced Launch Vehicles, H. Kevin Rivers
Thermal And Mechanical Behavior Of Cryogenic Propellant Tank Concepts For Advanced Launch Vehicles, H. Kevin Rivers
Mechanical & Aerospace Engineering Theses & Dissertations
An important step in developing a cost-effective, fully-reusable, launch vehicle is the development of durable, lightweight, insulated, cryogenic propellant tanks. Current cryogenic tanks are expendable, and much of the technology that exist is not usable on future vehicles. As part of the Reusable Launch Vehicle/ X-33 Program, an experimental apparatus for evaluating the effects of both thermal and mechanical loading on cryogenic-tank concepts was developed at the NASA Langley Research Center. Studies to determine the behavior of various liquid-oxygen- and liquid-hydrogen-tank concepts under simulated mission conditions were performed as part of this research and are reported. Selected analytical studies of …
Subsystem Variables Associated With Positive Foster Mother-Foster Child Relationships, Meg Sandow
Subsystem Variables Associated With Positive Foster Mother-Foster Child Relationships, Meg Sandow
Psychology Theses & Dissertations
Many researchers have explored variables that appear to influence a foster child's placement, and both researchers and theorists have noted the need for an overarching understanding of the variables that may affect a foster child's care and progress. This study examined four interlinking subsystems of foster care: the foster child, the family of origin, the foster parent, and the social worker. Data regarding relevant variables for each of these subsystems were analyzed by means of canonical correlations, factor analyses, a multiple regression, and zero-order correlations. Participants in the study were 42 foster children from the Chesapeake and Suffolk Departments of …
