The U.S. Attorney: Fateful Powers Limited Essay., Tom Rickhoff Jan 1997

The U.S. Attorney: Fateful Powers Limited Essay., Tom Rickhoff

St. Mary's Law Journal

Nothing more separates the United States from some of history’s most ruthless and resourceful enemies, the Mexican drug syndicates, than an intermittent trickle of water. In spite of this crisis, the U.S. Attorney’s Office has languished without a presidentially-appointed leader since the Branch Davidian nightmare. Considering the historical influence of the U.S. Attorney’s office, the current situation in the Western District of Texas is somewhat surprising. At one time, U.S. Attorneys exercised almost total discretion as to how the federal government impacted the lives of the powerful as well as the powerless. One of the primary obstacles in restoring effective …

Of Ivory Columns And Glass Ceilings: The Impact Of The Supreme Court Of The United States On The Practice Of Women Attorneys In Law Firms Comment., Nancy L. Farrer Jan 1997

Of Ivory Columns And Glass Ceilings: The Impact Of The Supreme Court Of The United States On The Practice Of Women Attorneys In Law Firms Comment., Nancy L. Farrer

St. Mary's Law Journal

This Commentary examines the effect United States Supreme Court decisions on sex discrimination in the legal profession. Discrimination against women currently appears to be alive and well in the legal field. Decisions like Bradwell v. Illinois and In re Lockwood frustrated women attorneys for over a century, allowing states to determine women were unfit for occupations in areas like law. Hishon v. King & Spalding, and later, Price Waterhouse v. Hopkins, applied Title VII protections to evaluations of potential law firm partners—a process previously closed and unassailable for most of the history of the legal profession. More recently, Harris v. …

The Antiterrorism Act, The Immigration Reform Act, And Ideological Regulation In The Immigration Laws: Important Lessons For Citizens And Noncitizens., Kevin R. Johnson Jan 1997

The Antiterrorism Act, The Immigration Reform Act, And Ideological Regulation In The Immigration Laws: Important Lessons For Citizens And Noncitizens., Kevin R. Johnson

St. Mary's Law Journal

This Article analyzes how the Antiterrorism Act and the Immigration Reform Act reflect a larger historical dynamic in the relationship between domestic subordination and immigration law. The U.S. government historically employed immigration laws in an effort to protect the established political and social order. History reveals a strong correlation between the severe treatment politically subversive U.S. citizens received and the constriction of the immigration laws. This Article argues the lack of constitutional protections for noncitizens helps to explain the recurrent backlash against them. The treatment of noncitizens suggests how far the government might go to suppress domestic political dissent by …

Title Iii Of The Violence Against Women Act: The Answer To Domestic Violence Or A Constitutional Time-Bomb Comment., Yvette J. Mabbun Jan 1997

Title Iii Of The Violence Against Women Act: The Answer To Domestic Violence Or A Constitutional Time-Bomb Comment., Yvette J. Mabbun

St. Mary's Law Journal

The Violence Against Women Act (VAWA) was enacted in 1994 to combat the growing and widespread epidemic of domestic violence. Congressional committees assigned to study this epidemic found that violent attacks by men topped the list of dangers to an American woman’s health. In an attempt to raise society’s awareness of the problem of violence against women and to ameliorate the victimization of women, Congress enacted VAWA. Specifically, Title III of VAWA establishes a federal civil right for victims of violent, gender-motivated crimes. These provide victims with either injunctive or monetary compensation. Consequently, there have been questions about the constitutionality …

Are Tuna And Dolphins The Same? A Rule Of Reason Approach To Resolve The Trade And Environment Conflict, Anantha K. Paruthipattu Jan 1997

Are Tuna And Dolphins The Same? A Rule Of Reason Approach To Resolve The Trade And Environment Conflict, Anantha K. Paruthipattu

LLM Theses and Essays

Trade and environment are both primary values in an ecologically and economically interdependent world; unleashing trade without regard to environmental impact is as detrimental as guarding the environment at the expense of trade and development. Tuna and dolphins have come to symbolize the policy struggle between trade and environment. In early 1990, the United States banned the import of tuna from Mexico and other countries that were fishing in a manner that damaged dolphins in the Eastern Tropical Pacific Ocean. Mexico challenged this ban before a GATT Panel, which ruled against the United States and held that the tuna ban …

Intelligent Techniques For Handling Uncertainty In The Assessment Of Neonatal Outcome, Jonathan Mark Garibaldi Jan 1997

Intelligent Techniques For Handling Uncertainty In The Assessment Of Neonatal Outcome, Jonathan Mark Garibaldi

School of Engineering, Computing and Mathematics Theses

Objective assessment of the neonatal outcome of labour is important, but it is a difficult and challenging problem. It is an invaluable source of information which can be used to provide feedback to clinicians, to audit a unit's overall performance, and can guide subsequent neonatal care. Current methods are inadequate as they fail to distinguish damage that occurred during labour from damage that occurred before or after labour. Analysis of the chemical acid-base status of blood taken from the umbilical cord of an infant immediately after delivery provides information on any damage suffered by the infant due to lack of …

Review Of Personal Identification Systems, J. M. Cross Jan 1997

Review Of Personal Identification Systems, J. M. Cross

Research outputs pre 2011

The growth of the use of biometric personal identification systems has been relatively steady over the last 20 years. The expected biometric revolution which was forecast since the mid 1970's has not yet occurred. The main factor for lower than expected growth has been the cost and user acceptance of the systems. During the last few years, however, a new generation of more reliable, less expensive and better designed biometric devices have come onto the market. This combined with the anticipated expansion of new reliable, user friendly inexpensive systems provides a signal that the revolution is about to begin. This …

Current College And University Serious Student Problems: A Study Of Attitudes And Perceptions Of Chief Student Affairs Officers And Student Leaders At Research I Universities., Melanie Jeanne Cook

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of this study was to analyze the attitudes and perceptions of chief student affairs officers and student leaders at Research I universities of serious student problems and the impact on the design and implementation of student services programs, policies, and procedures. Separate questionnaires were sent to chief student affairs officers and elected student leaders at Research I universities. These questionnaires asked the respective groups to identify current serious student problems on their campus. For comparative purposes, chief student affairs officers were also asked to identify serious student problems in the past and next five years. In addition, they …

Male Adolescent Sex Offenders: The Relationship Between Early Victimization And Subsequent Offense Patterns., Mark Steven Metz Jan 1997

Male Adolescent Sex Offenders: The Relationship Between Early Victimization And Subsequent Offense Patterns., Mark Steven Metz

Graduate Theses, Dissertations, and Problem Reports (ETD)

Twenty-three (23) incarcerated male adolescent sex offenders participated in structured interviews about their experiences as both victims and perpetrators of sexual assault. Data were analyzed for indications that some perpetrators use their offenses to reenact their victimization experiences in an effort to achieve mastery over their own sexual traumata. Data were also evaluated for evidence of differential victimization histories by molesters and rapists. Significant relationships were found between victimization and offense experiences, including the selection by offenders of victims who were the same race as the perpetrators against them, the recurrence in offenses of two types of sexual activity--simulated intercourse …

Stimulus Control Of Human Punished Behavior: Testing For Generalization., Jennifer Marie O'Donnell Jan 1997

Stimulus Control Of Human Punished Behavior: Testing For Generalization., Jennifer Marie O'Donnell

Graduate Theses, Dissertations, and Problem Reports (ETD)

Punishment may decrease the rate of unpunished behavior (i.e., punishment effects may generalize). Only a few studies with animals (e.g., Honig & Slivka, 1964) have investigated the stimulus generalization of punishment effects, or how they vary systematically with physical properties of stimuli. In a recent study with humans (O'Donnell & Crosbie, in press), each response in the presence of one horizontal line was punished, and generalization of punishment was tested in the presence of nine other lines that differed only in length. Generalization gradients were not obtained, most likely because the punisher became the discriminative stimulus for punishment conditions, thus …

Perimenopause: A Phenomenological Study Of Women And Health Care Providers In Rural Areas., Patricia Ann Kraft Jan 1997

Perimenopause: A Phenomenological Study Of Women And Health Care Providers In Rural Areas., Patricia Ann Kraft

Graduate Theses, Dissertations, and Problem Reports (ETD)

Using a four step phenomenological approach for inquiry, the researcher explored and interpreted data obtained from the lived experiences of sixteen perimenopausal women and eight health care providers living in rural areas. A purposive sampling technique was utilized. Participation was on a voluntary basis. Data collection procedures included a face-to-face semi-structured taped interview and completion of a demographic questionnaire. Following analysis of the data, twenty-two common essences were identified from intuiting of the interview data. These essences were classified into six major themes which integrated all the realities of the participants. The findings of the study revealed six major themes …

Decentralized Estimation For Large Scale Interconnected Systems., Noureddine Bekhouche Jan 1997

Decentralized Estimation For Large Scale Interconnected Systems., Noureddine Bekhouche

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation deals with the design of decentralized estimators for large scale interconnected systems. The systems are composed of several subsystems interconnected together. At each subsystem level a filter is designed to estimate local and/or interface variables. Kalman filtering and H{dollar}\\infty{dollar} filtering tools are used to derive decentralized estimators based on two different approaches namely, direct and indirect methods. A power system application is used to illustrate the proposed algorithms. In each method the decentralized filter design requires a subsystem model (local model) and a set of measurements. In the direct method additional measurements are needed for decentralization. In the …

Secondary Arts Teachers' Perceptions Of Integrated Arts, Jeanette Giroud Jan 1997

Secondary Arts Teachers' Perceptions Of Integrated Arts, Jeanette Giroud

Theses: Doctorates and Masters

During the 1980s, research in the arts by Project Zero and Arts Propel revealed that in American schooling the areas of artistic intelligence and artistic education had been neglected. Gardner (1989) proposed a theory of multiple intelligences, suggesting that in addition to the linguistic and logical-mathematical forms, there are a number of distinct forms of intelligence that each individual may possess in varying degrees. The concept of multiple intelligences as opposed to "talent" in an art form offers the opportunity to view arts education in a new light. The original purpose of Arts Propel was to assess artistic potential in …

Sagebrush (Artemisia Tridentata) Restoration In Altered Sage Grouse (Centrocercus Urophasianus) Habitat Of The Yakima Training Center In Central Washington, Margaret Ann Pounds Jan 1997

Sagebrush (Artemisia Tridentata) Restoration In Altered Sage Grouse (Centrocercus Urophasianus) Habitat Of The Yakima Training Center In Central Washington, Margaret Ann Pounds

All Master's Theses

The restoration of sagebrush at the Yakima Training Center was studied because it was determined that military training was altering the condition of sage grouse habitat, potentially having a negative impact on the sage grouse population of the installation. The management of sage grouse and its habitat on YTC are a priority for the U.S. Army. The objectives of this study were to identify the issues relevant to sage grouse and the restoration of its habitat on the training facility, to investigate sagebrush restoration techniques, and to make management recommendations based upon this study. Results of this study indicate that …

A second chapter (Ch. 2) is concerned with lead and its effects. A synopsis of past and present studies that show the interaction between lead and molluscs is given in Chapter 3, then two experimental chapters follow. The first experimental chapter (Ch. 4) is …

An Assessment Of Perceptions Of Career Services Providing Job Search And Survival Skills Training, Brett D. Hobby Jan 1997

An Assessment Of Perceptions Of Career Services Providing Job Search And Survival Skills Training, Brett D. Hobby

College of Graduate Studies: Theses & Dissertations (1964–2006)

The area of Career Services on college and university campuses is ever-changing. The boom of technology makes it easier for students to find and examine job openings via the Internet and to put their resume on line. These advancements are good as they help Career Services office's expand their job search services and provide the most current technology available to students while continuing to offer the traditional job search services. According to McBride and Muffin (1991), the main focus of Career Services has always been on helping students develop effective job search skills to obtain an interview and hopefully a …
