Ergonomie Participative, Mode De Gestion Et Performance En Prévention Des Accidents Du Travail : Le Cas De La Société Des Alcools Du Québec, Marie-Claire Carpentier-Roy, Jean-François Chanlat, Paul Lanoie, Louis Patry

Resolving Conflicting Laws And Policy In Integrated Delivery Systems Development, Anthony D. Shaffer, Peter A. Pavarini Jan 1997

Resolving Conflicting Laws And Policy In Integrated Delivery Systems Development, Anthony D. Shaffer, Peter A. Pavarini

Journal of Law and Health

Health care legal advisors are often called on to rationalize and synthesize these conflicting laws and policies while assisting clients to meet current market demands in developing competitive integrated delivery systems ("IDS"). This article explores the myriad of laws and regulations that affect integrated delivery systems development and proposes a practical approach for reconciling conflicting laws and policies. Some legal practitioners may recognize the proposed method as the process they already follow. For others, the suggestions in this article will hopefully challenge them to see conflicts of law and policy as opportunities to engage in creative thinking.

Tis Better To Give Than To Receive: Charitable Donations Of Medical Malpractice Punitive Damages, Nicholas M. Miller Jan 1997

Tis Better To Give Than To Receive: Charitable Donations Of Medical Malpractice Punitive Damages, Nicholas M. Miller

Journal of Law and Health

The purpose of this Note is not to answer the question of how excessive medical malpractice and punitive damage awards are. Many highly respected scholars on different sides of the issue have spent large portions of their careers trying to resolve that issue without finding a common ground. This author does not boldly claim to provide an answer in this limited forum. This Note does, however, address a possible source of public frustration with the state of medical malpractice and punitive damages: the lack of a principled basis for the awards that juries give to the victims. The perception among …

Malpractice And Other Legal Issues Preventing The Development Of Telemedicine , Christopher Caryl Jan 1997

Malpractice And Other Legal Issues Preventing The Development Of Telemedicine , Christopher Caryl

Journal of Law and Health

Even though most Americans have not heard of telemedicine, the federal government is already actively involved in "developing a national telemedicine strategy." This note attempts to accomplish the following: demonstrate the urgent need of rural communities to gain access to adequate health care; clarify how telemedicine can provide enhanced health care to rural communities; and analyze the legal obstacles that have prevented, thus far, the most beneficial utilization of telemedicine. In particular, this note will examine how malpractice claims arising from telemedicine consultations might be resolved. An important issue to recognize at the outset, and one that consistently reappears throughout …

The Grief Of God: Images Of The Suffering Jesus In Late Medieval England, Ellen M. Ross Jan 1997

The Grief Of God: Images Of The Suffering Jesus In Late Medieval England, Ellen M. Ross

Religion Faculty Works

Graphic portrayals of the suffering Jesus Christ pervade late medieval English art, literature, drama, and theology. These images have been interpreted as signs of a new emphasis on the humanity of Jesus. To others they indicate a fascination with a terrifying God of vengeance and a morbid obsession with death. In The Grief of God, however, Ellen Ross offers a different understanding of the purpose of this imagery and its meaning to the people of the time. Analyzing a wide range of textual and pictorial evidence, the author finds that the bleeding flesh of the wounded Savior manifests divine presence; …

Amazight Identity In The Post Colonial Moroccan State: A Case Study In Ethnicity, Morag E. Boyd Jan 1997

Amazight Identity In The Post Colonial Moroccan State: A Case Study In Ethnicity, Morag E. Boyd

Honors Papers

This study will demonstrate that the Amazight are a distinct ethnic group in Morocco, despite the common interpretation in scholarly and everyday discourse that they are merely groups of people speaking one of the Amazight language and not representing a distinct cultural entity. The study will go on to examine the ramifications of this ethnic identity and the heritage of the historical and tribal roots of the Amazight in light of nationalism, state building, ethnicity, and cultural marginalization.

Science Fiction: Rhetoric, Authenticity, Textuality And The Museum Of Jurassic Technology, Jeremiah Dyehouse Jan 1997

Science Fiction: Rhetoric, Authenticity, Textuality And The Museum Of Jurassic Technology, Jeremiah Dyehouse

Honors Papers

About two years ago I became interested in museums as rhetorical entities. I took a course at the Allen Memorial Art Museum where I got a sense of how arguments are created through the techniques of visual display, the socalled "informatics" of museum exhibition. In an art museum, however, these informatics are always bound into a relationship with the aura of the art object as artifact. In the context of a cult of art (an art museum?), the physical fact of an art object's existence can never be rhetorically negotiated. Even if nothing else is fixed, its physical presence acts …

Affirmative Action, A Look At South Africa And The United States: A Question Of Pigmentation Or Leveling The Playing Field, Lundy Langston

Journal Publications

Affirmative action is one of the most divisive issues in the United States today.' Proponents of affirmative action argue that the United States has not come far enough in leveling the playing field. They argue that affirmative action programs are needed as much today-if not more-than when the balancing policies initially took effect. Opponents of affirmative action argue that race-based decision-making is undemocratic and discriminates against the majoritarian members in United States society. As we prepare to exit the twentieth century, we are confronted with the need to resolve the affirmative action dilemma. Do we eliminate affirmative-action programs altogether and …

Tax Exemption Issues Facing Academic Health Centers In The Managed Care Environment, Darryll K. Jones Jan 1997

Tax Exemption Issues Facing Academic Health Centers In The Managed Care Environment, Darryll K. Jones

Journal Publications

A variation on an old adage states, "things aren't like they used to be and never were." The applicability of tax law to higher education is a subject to which the modified adage is apt. If there was ever a time when tax law was generally inapplicable to higher education, when higher education administrators and counsel could ignore the maddening and glorious detail of tax law, it is certainly not now and one would be hard pressed to prove that such a time ever existed. Indeed, many of modem tax law's prohibitions and allowances were motivated by or refined as …

This article explores the past and present role of NGOs in international governance. Part One reviews the history of NGO involvement, focusing on the period between 1775 and 1949. It catalogs the pros and cons of an active NGO role, discusses various functions that NGOs fulfill, and lists ten techniques of NGO participation. Part Two also considers a hypothesis that NGO involvement is cyclical.

Development And Validation Of Decisional Balance And Processes Of Change Inventories For Heavy, Episodic Drinking, Jason Edward Maddock Jan 1997

Development And Validation Of Decisional Balance And Processes Of Change Inventories For Heavy, Episodic Drinking, Jason Edward Maddock

Open Access Master's Theses

The transtheoretical model of behavior change indicates that people who successfully change problem behaviors move through a series of stages of readiness to change. This model has been successfully applied to a wide range of health-related behaviors, but only limited work has been devoted to adapting this model to the cessation of heavy episodic drinking. The goals of the study were to develop measures of two of the key constructs of the model: a decisional balance inventory measuring the pros and cons of alcohol consumption and a processes of change instrument assessing techniques used to change heavy drinking behavior.

An Exploratory Analysis Of The Relationship Of Leaders’ Gender To Multiple Aspects Of Organizational Functioning In Community Coalitions, Ilene Klein

Open Access Master's Theses

This study explored the relationship of leaders' gender to multiple aspects of organizational functioning. It focused on perceptions of leadership style (the extent to which leaders were task focused and interpersonally focused), social climate of the groups (inclusion/cohesion of the group and the task focus of the group), and specific characteristics of the group members (member satisfaction with the group and member commitment to the group).

Data were collected from members of 32 substance abuse prevention task forces across the state of Rhode Island, (N = 180). The independent variable of leaders' gender in this study was defined as a …
