Bmw Of North America V. Gore: A Misplaced Guide For Punitive Damage Awards, Michelle J. Carey

This casenote examines the Supreme Court's landmark ruling in BMW v. Gore, in which the Court struck down a jury award of punitive damages as being unreasonably large in violation of substantive due process. This Note traces the history of challenges to punitive damage awards through Supreme Court cases, including BMW v. Gore. It then analyzes BMW v. Gore, particularly the Court's misguided attempt at providing a guide for punitive damage awards and the dismal implications from the Court's actions. It concludes that the better approach for the Court to have taken would have been to focus on procedural due …

Non-Visualization Of Lung Markings Below Hemidiaphragm In Subtle Subpulmonic Effusion: An Old Sign Resuscitated, Y A. Husen, T R. Khalid, Z A. Khan, M Y. Sheikh

To assess the lack of visibility of vascular markings under the hemidiaphragm on a frontal chest radiograph as a sign of pleural effusion, fifteen patients were collected showing this sign. Pleural effusion was diagnosed by ultrasound, comparison with previous or subsequent chest x-ray or computed tomography. Patients in the study group exhibited this sign in the absence of the classical signs of pleural effusion. In the control group, lack of visibility of blood vessels was observed in only 4.2% cases. Modulation Of The Rat Potassium Channel Kv1.5, Daniel Benjamin Saal

1. Kv1.5 is a delayed rectifier-type potassium channel. We have examined the localization of the channel protein using a polyclonal antibody against Kv1.5. This channel is expressed in numerous regions of the brain, primarily in glial cells. Its expression is particularly intense in the endfoot processes which abut the microvasculature of the brain. It is also expressed in the cell bodies and cellular processes in the pituitary.2. The roles of juvenile hormone III (JH III) on phase changes and pheromone production were examined in laboratory-reared gregarious desert locust, Schistocerca gregaria (Forskal). The hormone was applied to 5th instar nymphs and newly emerged adult locusts. Generally, the 5th instar nymphs exhibited a higher sensitivity to hormone treatments than the adults. Hormone applications inhibited pheromone production (as measured by the amounts of phenylacetonitrile released). In addition, JH III had a significant effect on the external colouration and absorbance ratios of the haemolymph pigments. This article reviews the development of poor relief laws from 1790 to 1820. The scope of the article will survey the laws affecting the poor people developed by the states as they joined the union and by the federal government. The author also sketches out common themes that developed through the legislation during this time period Moreover, the articles tracks the influence of English poor laws and early legislative experiences in this area of the law.

Toward Fairness In Compensation Of Management And Labor: Compensation Ratios, A Proposal For Disclosure, James A. Cotton

This article will discuss the general history of executive compensation and the concept of "excessive compensation" as it has developed in corporate America. The article advocates a change in current SEC disclosure requirements which are set out in Appendix A of this article. The development of ratios as a tool of financial analysis is discussed to establish the legitimacy of their use. The author then offers an example of a stockholder proposal to make use of compensation ratios.

Much of the research on age-related differences in the ability to inhibit irrelevant information in a given task has been on the study of younger and older adults. Only a minimal amount of research has focused on the developmental differences in children and young adults. Accordingly, the purpose of this paper is to examine whether age-related differences exist between children and young adults in processes consistent with inhibition.

In 1980, the railroad industry was deregulated due to poor industry performance as well as an ideological shift. The newly developed contestable market theory provided the political justification for deregulating what was previously perceived as a natural monopoly. The theme of this study is the examination of whether contestable market conditions exist in the U.S. surface transportation industry which are sufficient to justify giving up direct governmental involvement in the railroad industry. The main generic market structures that play an important role in the regulatory discussion are introduced and implications for regulatory intervention in the case of railroads are drawn. …

The achievement of self sufficiency in food production is a major objective of governments throughout the world. Insects are one of the major constraints that limit the production of food crops. To mitigate losses due to insects. insect resistant cultivars are sought as a major tactic in the development of integrated pest management strategies. The integration of insect resistant cultivars with other pest management tactics contributes to crop pest management strategies that are environmentally and economically acceptable. The Association Of Hla-Drb Genes And The Shared Epitope With Rheumatoid Arthritis In Pakistan, K Hameed, S Bowman, E Kondeatis, R Vaughan, T Gibson

The association of particular HLA-DR alleles and the shared epitope with rheumatoid arthritis (RA) is now well established. The strength of these links varies between races. Furthermore, the proposition that the presence of the shared epitope is indicative of severe disease has been more difficult to sustain in non-Europeans. This study examines the frequency of HLA-DR and HLA-DRB1 amongst Pakistanis for the first time. Using the polymerase chain reaction (PCR) and sequence-specific oligonucleotide probes (PCR-SSOP) and primers (PCR-SSP), HLA-DR phenotype and genotype frequencies were ascertained in 86 RA hospital out-patients and 79 healthy controls matched for age, gender and ethnicity. …
