Constitutional Tragedy In Dying: Responses To Some Common Arguments Against The Constitutional Right To Die, James E. Flemming

The author first explains that he will argue for the constitutional right to die, including the right of terminally ill persons to physician-assisted suicide. It would be a constitutional tragedy otherwise because it would entail that the Constitutional sanctions a horrible form of tyranny and that the Constitution allows citizens to author their own tragic endings. In the final part of the essay, the author responds to some common arguments against the constitutional right to physician-assisted suicide. While there may be some merits to the opposition arguments, none provides a good constitutional argument against recognizing a right to die. In …

Rethinking The Supreme Court's Hands-Off Approach To Questions Of Religious Practice And Belief, Samuel J. Levine

Part I of this Article discusses Supreme Court cases prior to 1981, in which the Court first expressed its hands-off approach to deciding questions of religious practice and belief. This Part suggests that in these decisions, as a result of a proper concern for religious autonomy, the Court already began the process of expanding the principle of judicial non-interference, at the cost of sacrificing effective adjudication of important constitutional issues. Part II of this Article critiques the Court's approach in Free Exercise Clause cases, identifying different problems that have arisen as a result of the Court's approach. This Part argues …

This Note demonstrates the need for federal telemedicine legislation that provides uniform confidentiality protection for all telemedicine patients. Part I details the use of telemedicine and outlines the link between telemedicine and privacy issues. Part II discusses current federal and state privacy law, emphasizing the laws that protect medical information. Part III argues that federal telemedicine legislation is necessary to safeguard the confidentiality of patients' medical records and proposes a uniform law that protects the privacy of telemedicine patients in every state. Environmental law is becoming ever more centralized. In the United States, state and local pollution laws have been eclipsed by federal regulation. In the European Community, and to a lesser degree under the North American Free Trade Agreement (NAFTA), national controls have been supplemented by regional regulation. And the growing importance of treaties regulating particular aspects of the global environment has reinforced calls for more general regimes of international environmental regulation.
One inevitably given justification for this centralizing trend is that pollution is a transboundary phenomenon. Air and water pollution, and to a lesser extent groundwater contamination, can cross political …

Summary form only as given. Two analytical techniques which evaluate capital acquisitions in healthcare are the method of generating system moments and Monte Carlo simulation. Generating system moments enables the user to determine an estimate of the expected cost from a user-supplied function. Furthermore, the user can determine, from a variance component analysis, the sensitivity of the user-supplied function to marginal changes in the random variables by expanding the function about its mean using the Taylor series expansion to the second order. Calculating the magnitude of partial derivatives of each random variable with respect to the user-supplied function indicates the …

Concerns And Perceptions Of Parents Of Children And Adolescents With Attention-Deficit-Hyperactivity Disorder, Stephen Gerard Viola

The study investigated the concerns and perceptions of parents of children and adolescents with Attention-Deficit-Hyperactivity-Disorder (ADHD). Parental concerns regarding behaviors, skill deficits, and settings were identified as well as the helpfulness of interventions and professionals. The Parent Perception Opinionnaire for Parents of Children and Adolescents with ADHD was constructed. Data were collected from 112 members of a parent support group. The data were summarized according to ages 8 and less (primary), ages 9 through 11 (intermediate) and ages 12 through 17 (secondary). The highest ranked concerns of parents were symptoms of inattention, distractibility and hyperactivity. Regarding skills deficits, highest concerns …

The focus of this study wag to determine if women who report and women who do not report sexual harassment could be differentially described by a subset of the following variables: age, marital status, feminist ideology, frequency of behavior, perceived offensiveness, perceived outcomes, normative expectations. This study was based on a model for reporting sexual harassment by Brooks and Perot (1991) and extended the original test of this model by adding two variables, normative expectations and perceived outcomes, which were not tested by Brooks and Perot. This study examined whether there were significant differences in the manifest content of spontaneous and primed early recollections of women who have a positive body image and women who have a negative body image. The Manaster-Perryman Manifest Content Early Recollection Scoring Manual was used to score the early memories of participants. Participants in this study consisted of 94 women. Scores on the Body Shape Questionnaire were utilized to classify women into body image groups. Thirty-nine women were identified as having a positive body image; 55 women were identified as having a negative body image. Results indicated no significant differences between …

The present paper introduces the P system as a scheme for organizing Pavlovian procedures in an orderly and comprehensive manner. The system is defined by three temporal variables and three restrictions on their possible values. It can be used to define all standard temporal variables—namely, stimulus duration, interstimulus interval, trace interval, and intertrial interval—as well as variables C and T of scalar expectancy theory. The system also permits the definition of new independent variables through combinations of the basic temporal parameters. We exemplify this possibility by defining two ratios of temporal intervals. It is widely recognized that the bacteria sequestered in a biofilm on a medical implant are much more resistant to antibiotics than their planktonic counterparts. Recent studies have shown that application of antibiotic along with low power ultrasound significantly increases the killing of planktonic bacteria by the antibiotic. Herein is reported a similar application of antibiotic and ultrasound to sessile bacteria in biofilms of Pseudomonas aeruginosa on a polyethylene substrate. Biofilm viability was measured after exposure to 12 μg/ml gentamicin sulfate and 10 mW/cm2 ultrasound at frequencies of 70 kHz, 500 kHz, 2.25 MHz, and 10 MHz. The results …

Survey respondents were asked to provide knowledge responses to public events and names that occurred as long ago as the 1930s and as recently as the 1980s. Respondents made errors that reflect the use of semantic and lexical memory systems, and reconstructive processes based on a semantic theme. Errors, as well as correct responses, are affected by whether the events originally occurred during the transition phase (early teens to mid-twenties). Responses indicate that events that occur during the transition phase are remembered better than events that occur during other life phases (in contradiction to the differential sampling hypothesis), but that …

This study provided an historical examination of experiences of Eastern Washington University African-American Athletes, as well as their Coaches, and Athletic Directors. The interviewees all attended Eastern during the 60's and 70's. Three African-American players, four coaches who coached them, and three Athletic Director's were interviewed in the study. This study examines how African-American athletes at Eastern were influenced by other African-American athletes or leaders from the 60's through the early 70's. The study also investigates whether or not the Cheney Community was directly affected by these changes that occurred in the 60's through the early 70's. This study shows …

Prestonsburg Community College (PCC) and Big Sandy Area Development District (BSADD) have joined forces to offer service learning and volunteer opportunities in order to address unmet community needs of the Big Sandy region. Our program, "CONNECTIONS: Empowering Communities in Appalachia," facilitates community service opportunities in Senior Citizen Centers, Family Resource Centers, Youth Service Centers, Elementary and Secondary Schools, and many other community organizations. PCC and BSADD embrace service learning and volunteerism as powerful and meaningful approaches to education and community development. In the Winter 1997 issue of the Alaska Justice Forum, a certified interpreter for the federal and California court systems corrects misunderstandings about the nature of language interpretation in legal proceedings, observing that accurately interpreting to and from English in proceedings requires a language proficiency often misunderstood by participants in the court proceedings, and that lack of proficient interpretation can give rise to errors which threaten the integrity of the justice process. Early Growth In Weight Of Kemp's Ridley Sea Turtles (Lepidochelys Kempii) In Captivity, Charles W. Caillouet Jr., Clark T. Fontaine, Theodore D. Williams, Sharon A. Manzella-Tirpak

Growth in individual weight (w, kg) of Kemp’s ridley sea turtles (Lepidochelys kempii) in captivity was described for 15 year-classes (1978-1992) of turtles between ages (t) 0.17 to 1.22 yr, using In linear regression: Inw = lnc + dt1/2, where Inc is the intercept and d is the slope (growth rate index). There was significant (P < 0.001) heterogeneity in d among year-classes, with slowest growth (d = 3.798) exhibited by the 1983 year-class and fastest growth (d = 6.929) by the 1985 year-class, but there was no significant trend in d (P = 0.307) over year-classes. The variance of residuals from regression, s2reg, ranged from 0.2032 for the 1978 year-class to 0.0075 for the 1992 year-class, and showed a significant (P = 0.0001) logarithmic decrease over the year-classes. This decline in variation among individuals was probably due to a a …
