The investigation and measurement of administrative efficiency is an issue of great concern for health care policy decision makers and has important implications for the efficiency of the overall health care sector itself as well as for the cost containment efforts and the restructuring of the health care system.

Easing The Delivery Of Adoption Reform In Nebraska: L.B. 712, Susan Kubert Sapp

Nebraska Law Review

This article examines the history of unwed fathers’ rights in adoption as set forth by the United States Supreme Court and the Nebraska Supreme Court. It also identifies and discusses the changes L.B. 712 made in Nebraska law and how those changes improved the validity of Nebraska adoptions. Finally, this article analyzes United States Supreme Court and Nebraska Supreme Court decisions reached after L.B. 712 went into effect in September 1995. Ultimately, this article concludes that L.B. 712 and its related provisions can withstand both a due process and equal protection challenge under the reasoning and analysis employed by the …

It is unchanging black letter law that a contract of insurance is a transfer of risk. The insurer collects premiums from a group and pools them to cover the losses and the operating costs of the insurer. Individuals fund the operation of a system that achieves a social good in an effective and efficient manner. The perfect operation of the system can be thwarted by free riders in two ways. First, when individuals who have chosen not to participate in the group attempt to transfer risk for a loss that already has occurred, the prevalence of the risk is altered …

Fairman L. Denlinger DO, 1953 attended PCOM after serving in the U.S. Army as a Medical Corpsman during World War 2. After graduating in a class that was almost entirely ex-servicemen, Denlinger worked as an obstetrician and pediatrician in rural Lancaster County, Pennsylvania before returning to PCOM as a faculty member and became the first full-time chairman of the OB/GYN program. In the interview, Denlinger discusses attending PCOM under the G.I. Bill, the development of OB/GYN as an osteopathic specialty and as a clinical program at PCOM.

Nicholas Pedano Do, 1961 became chief surgical resident at PCO after graduating, and then a clinical instructor in surgery, and director of PCOM's surgical resident training program. During the interview, Pedano recounts his clinical experience at the 48th Street clinic and the North Center Hospital, the surgical program at PCOM. In addition, Dr. Pedano discusses the College's administration and leadership, the Musculo-Skeletal Institute, and the sale of the City Avenue Hospital's impact on alumni relations.

Oliver C. Bullock D.O., 1978 was one of the first generation of PCOM students to do clinical placement at the City Avenue Hospital. After graduating, Bullock went on to work in neighborhood clinics in Philadelphia and served as Medical Director of PCOM's Cambria Health Care Center before becoming Director for PCOM's six neighborhood clinics. Topics discussed in this interview include Bullock's experience as an African-American student at PCOM and the College's practices concerning outreach and recruitment of minority students, and the provision of community health services in North and West Philadelphia.

How Will We Regulate Genetic Enhancement, Maxwell J. Mehlman

Faculty Publications

Genetic enhancement technologies present difficult and novel regulatory issues, including the problem of measuring and comparing risks and benefits and dealing with the impact of these technologies on social values. This Article describes and evaluates the potential approaches that may be taken to regulate these technologies. The author concludes that a variety of approaches will be necessary, involving self-regulation, government restrictions on access and use, licensing, and a national lottery.

Constitutional Aspects Of Physician-Assisted Suicide After Lee V. Oregon, Simon Canick

On November 8, 1994, Oregon voters narrowly passed the highly controversial Death with Dignity Act (Measure 16), which marked the first time that physician-assisted suicide was explicitly legalized anywhere in the world. In Lee v. Oregon, a group of physicians, several terminally ill persons, a residential care facility, and individual operators of residential care facilities sought to enjoin enforcement of the new law, claiming various constitutional infirmities. The U.S. District Court for the District of Oregon enjoined enforcement of the law, acknowledging that it raised important constitutional issues including possible violations of the Equal Protection and Due Process Clauses of …

Civil rights fee-shifting statutes were designed to enable plaintiffs to attract competent attorneys to litigate and ultimately vindicate violations of federal civil rights laws. In the years following the enactment of the Attorneys' Fees Awards Act of 1976, the Supreme Court has decided a number of cases that would seem to affect attorney compensation in civil rights cases. In a series of interviews with civil rights practitioners, Professor Julie Davies has explored the effects of some key decisions as well as other factors that influence the viability of civil rights practice.
