Experimental Models Of Mycobacterial Replication And Killing In Macrophages, Pairote Laochumroonvorapong

This thesis investigates how human mononuclear phagocytes regulate the growth of mycobacteria. Previous studies carried out in our laboratory suggested that cell turnover [apoptosis and necrosis] within a granuloma may contribute to the control of mycobacterial infection. The experiments described here demonstrated that both apoptosis [Fas-mediated] and necrosis [perforin-induced] of infected human monocytes do not affect the survival of intracellular mycobacteria in an in vitro infection model. To determine the role of apoptosis and necrosis on mycobacterial infection in vivo, perforin gene-disrupted mice and Fas receptor-defective mice were experimentally infected with mycobacteria. State Environmental Standard-Setting: Is There A "Race" And Is It "To The Bottom"?, Kirsten H. Engel

Federal intervention in environmental standard-setting is often justified as necessary to prevent states from engaging in a welfare-reducing "race-to-the-bottom" spurred by interstate competition for industry. Traditionally, scholars base the "race-to-the-bottom" assumption upon game theoretic models such as the classic Prisoner's Dilemma. Applying a neoclassical economic approach, however, some legal scholars have recently argued that interstate competition is conducive to efficiency and thus that there is no "race-to-the-bottom." Local governments can play an important role in protecting surface water resources through their compliance with federal and state regulations and through their own land use planning and management practices. Despite 30 years of water quality initiatives in the Lake Erie basin, nonpoint source runoff from urban and urbanizing lands remains a problem. Loss of riparian corridor integrity is increasing as urban areas in the Lake Erie basin experience areal growth. The use and management of land, predominantly a local responsibility, directly affects surface water resources. Despite the failure of the 104th Congress to override President Clinton's veto and enact the Common Sense Product Liability Legal Reform Act, there is little doubt that such an Act will be passed by the 105th Congress. Uniform national laws concerning product liability are necessary, can be enacted consistent with Congressional authority, and should be enacted at the earliest possible time. A balanced Act, recognizing the need to protect injured consumers while providing necessary protection to product manufacturers and distributors, can be drafted. Such an Act could include provisions that abolish the consumer expectancy test for design defect litigation, reject …

Accomodating Vulnerabilities To Environmental Tobacco Smoke: A Prism For Understanding The Ada, Wendy E. Parmet, Mark A. Gottlieb, Richard A. Daynard

This Article explores the use of the ADA to challenge smoking policies and the fears and questions that such a use raises. We argue that a careful appreciation of the ADA's application to ETS-related claims should temper the worries of both those who see such claims as trivializing the ADA and those who worry that such claims may impose enormous burdens on American businesses. Rather, we suggest that the ADA in this instance, as in others, provides a limited but critical vehicle for ensuring that individuals with disabilities may fully participate in public life. This Article addresses physician-assisted suicide and the medical treatment of pain and suffering. Part II discusses various medical misconceptions about the treatment of pain and how modern medicine fails to fulfill this aspect of its palliative care role. Part III reviews how the law currently circumscribes the patient and doctor's ability to make medical decisions when the patient is terminally ill. As will be shown, the law is clearer and more respectful of good medical practice than most medical practitioners currently believe. Employees who receive health benefits through ERISA self-insured plans need protection when self-insured plans fail. Because of the breadth of ERISA preemption, states have been unable to assess ERISA self-insured plans for contribution to state insurance guaranty funds, and thus have been unable to include those employees in the protection of those funds. Further, attempts at federal reform to protect these employees have failed to garner support. However, under the recent Travelers, United Wire, and Safeco decisions, it may be possible for states to assess ERISA self-insured funds and their participants through a combination of hospital use surcharges and taxes …

United States V. Mcdougald: The Anathema To 18 U.S.C § 1956 And National Efforts Against Money Laundering, Mathew Paulose Jr.

This Comment argues that the Sixth Circuit should overrule McDougald. Part I discusses the purpose, process, and problems of the crime generally known as money laundering. Part I also discusses national efforts against money laundering, and in particular, the United States' efforts through Section 1956 of the Money Laundering Control Act. Part I concludes by discussing the Salinas-Citibank Affair and the probable prosecution of Citibank for money laundering violations. In a time of public scrutiny of higher education, there is good reason - both for the survival of the campus and the survival of the community around it -- for institutions to promote outreach. Yet even within those institutions with formal structures -- mission statements, faculty handbooks, and presidential leadership that support community service -- the practical considerations -- work assignments, evaluation mechanisms and institutional rewards -- present real challenges. INTRODUCTION: Over the past several decades, environmental advocates have expended enormous effort attempting to pass laws that protect air, water, land and species.' But even the best written laws will not be effective unless they are implemented. At the federal level, most modern environmental statutes include enforcement mechanisms that allow for the active involvement of the public. The most common of these are provisions authorizing citizen suits and public comments on proposed agency actions.
