Part II presents a survey of current law regarding coverage of HDC-ABMT for breast cancer. Part III explores the merits and limits of judicial and legislative determinations of whether a particular treatment is covered under an insurance policy. Every Category Of Provider: Hindsight Is 20/20 Vision, Melanie K. Curtice

Seattle University Law Review

This Comment contends that if the "Every Category of Provider" statute had been properly limited, as intended and not as interpreted, it would not have met its ultimate fate of ERISA preemption. In order to show how this public interest legislation could remain in effect and provide at least minimal statutory support for consumer choice, an overview of Washington state health care reform, ERISA preemption, and the federal district court decision preempting the statute is necessary. In Part I, this Comment provides a brief history of the "Every Category of Provider" statute and the Bulletin. Part II contains a summary …

However, urban families were more likely to believe they should turn to their clergy for emotional support.

Edith Wharton's "Secret Sensitiveness" The Decoration Of Houses, And Her Fiction, Suzanne W. Jones Jan 1997

Edith Wharton's "Secret Sensitiveness" The Decoration Of Houses, And Her Fiction, Suzanne W. Jones

English Faculty Publications

Surely one of the reasons that Edith Wharton lived most of her life in France was that she greatly admired the way the French "instinctively applies to living the same rules that they applies to artistic creation." Wharton believed that the French had an eye for beauty, or what she called "the seeing eye," in contrast to Americans whose sight had been dimmed by the puritanism of their Anglo-Saxon heritage. However, in her last and unfinished novel, The Buccaneers (1938), Wharton suggests through her American protagonist's relationship with her European governess, Laura Testvalley, that the art of seeing can be …

Leadership In Teams At Owen And Minor, Inc., Jay Carroll

Honors Theses

In this paper, we researched concepts directly linked with the idea of leadership as it relates to teams. As a result of our initial reactions to leadership in teams at Owens & Minor, we decided to explore the relationship between teams and organizational culture, communication, motivation and empowerment. However, we did not limit ourselves only to these concepts. We selected the above leadership and team concepts based on a review of research that explored issues associated with the use of teams in organizations. With direction provided by our supervisors and other members of the Jepson faculty, we narrowed the plethora of …

The Personal Responsibility And Work Opportunity Act Of 1996: Poison Pills For Legal Immigrants, Meredith Barton, Deborah M. Chandler Jan 1997

The Personal Responsibility And Work Opportunity Act Of 1996: Poison Pills For Legal Immigrants, Meredith Barton, Deborah M. Chandler

Richmond Journal of Law and the Public Interest

Former president Ronald Reagan's vision of America as this shining city ended Thursday, August 23, 1996, when President Bill Clinton signed his name to the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA, considered the most farreaching welfare reform package in history. Although the Congressional Budget Office (CBO) estimates that the federal government will save over $57 billion between fiscal year 1997 and fiscal year 2002, this welfare reform package profoundly impacts immigrants, particularly legal immigrants. Overall 44% of federal savings (approximately $23.8 billion) stems from denying public assistance benefits to legal immigrants. This new welfare legislation directly …

Virginia As A Model For Other State Welfare - Plans Virginia's Welfare Reform: Current Law And Effects, Laura Piper

Richmond Journal of Law and the Public Interest

In 1995, Virginia became the first state to submit a comprehensive statewide welfare reform plan to the federal government. The crusade for a more effective Virginia welfare system was led by Governor George Allen. The federal government granted Virginia numerous waivers from federal regulations enabling Virginia to implement the Virginia Independence Plan ("VIP") and the Virginia Initiative for Employment not Welfare ("VIEW") component.According to the Virginia Department of Health and Human Resource's 1996 annual report, because of VIP and VIEW the number of welfare recipients decreased, employment rates increased and taxpayers saved 24 million dollars. Doma: An Unconstitutional Establishment Of Fundamentalist Christianity, James M. Donovan Jan 1997

Doma: An Unconstitutional Establishment Of Fundamentalist Christianity, James M. Donovan

Michigan Journal of Gender & Law

According to the text of the Act, DOMA's purposes are "to define and protect the institution of marriage," where marriage is defined to exclude same-sex partners. To be constitutionally valid under the Establishment Clause, this notion that heterosexual marriages require "protection" from gay and lesbian persons must spring from a secular and not religious source. This Article posits that DOMA has crossed this forbidden line between the secular and the religious. DOMA, motivated and supported by fundamentalist Christian ideology, and lacking any genuine secular goals or justifications, betrays the Establishment Clause of the U.S. Constitution.

Legislative Approaches To Reducing The Hegemony Of The Priestly Model Of Medicine, Nancy K. Kubasek Jan 1997

Legislative Approaches To Reducing The Hegemony Of The Priestly Model Of Medicine, Nancy K. Kubasek

Michigan Journal of Gender & Law

This Article presents the case that the legal culture in many ways undergirds the priestly model's hegemony over the therapeutic relationship between a woman and her doctor. To the extent that law provides this fundamental support, it legitimizes the mistreatment of women, especially with respect to their reproductive health. The implications are that the movement toward a more just legal culture necessitates the extirpation of this support.
