Voicing Differences, Margaret E. Montoya Jan 1997

Voicing Differences, Margaret E. Montoya

Clinical Law Review

Jane Aiken and Kimberly O'Leary undertake the difficult work of developing specific approaches and techniques for taking account of characteristics such as race/ethnicity, gender, dis/ability, and sexual identity in clinical pedagogy. Carolyn Grose uses outsider narratives and popular culture to challenge the "pre-understanding" of students, and to assist them to accept client stories as true and valid. Focusing on the professional value of striving to promote justice, fairness, and morality identified in the MacCrate Report, Professor Aiken exhorts us to promote justice by unmasking privilege, the invisible package of unearned assets- about which I (we? or you?) was "meant" to …

A Study Of The Lichens At Rocky Branch Nature Preserve, Clark County, Illinois, Eric B. Grunder Jan 1997

A Study Of The Lichens At Rocky Branch Nature Preserve, Clark County, Illinois, Eric B. Grunder

Masters Theses

In 1971, a graduate student at Eastern Illinois University, James E. Wiedman, studied the lichen flora of Rocky Branch Nature Preserve, Clark County, Illinois. During his study he collected, identified, and recorded a total of 64 lichen species. Since 1971, Rocky Branch Nature Preserve has experienced a dramatic increase in use by people and a concomittant decline in the quality of lichen habitats. In order to assess the decline of suitable lichen habitats and the reduction of lichen species a second study of the lichens at Rocky Branch Nature Preserve was undertaken. As part of this study, ten habitat sites …

Migration, Identity & The Colonial Encounter, Tayyab Mahmud Jan 1997

Migration, Identity & The Colonial Encounter, Tayyab Mahmud

Faculty Articles

The immigrant puts at issue assumptions of inviolability of borders, territoriality of sovereignty, and exclusivity of citizenship - fundamental characteristics of the modern state. The immigrant calls into question cultural homogeneity, linguistic commonality, shared history, and security of identity - the key ideologies of the nation. This article explores these issues by locating them in spatial and temporal sites removed from the common foci of current immigration debates. Using three stories of migration from colonial and postcolonial South Asia, the first part of the article demonstrates that within the general context of empire and imperialism, the determinants and processes of …

Centering The Immigrant In The Inter/National Imagination, Robert S. Chang, Keith Aoki Jan 1997

Centering The Immigrant In The Inter/National Imagination, Robert S. Chang, Keith Aoki

Faculty Articles

In this Article, Professors Chang and Aoki examine the relationship between the immigrant and the nation in the complicated racial terrain known as the United States. Special attention is paid to the border which contains and configures the local, the national and the international. They criticize the contradictory impulse that has led to borders becoming increasingly porous to the flows of information, goods and capital while simultaneously constricting when it comes to the movement of certain persons, particularly those of Asian and Latinalo ancestry. The authors examine Monterey Park, California, as one site where there has been a large influx …

Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve Jan 1997

Making International Refugee Law Relevant Again: A Proposal For Collectivized And Solution-Oriented Protection, James C. Hathaway, R. Alexander Neve

Articles

International refugee law is in crisis. Even as armed conflict and human rights abuse continue to force individuals and groups to flee their home countries, many governments are withdrawing from the legal duty to provide refugees with the protection they require. While governments proclaim a willingness to assist refugees as a matter of political discretion or humanitarian goodwill, they appear committed to a pattern of defensive strategies designed to avoid international legal responsibility toward involuntary migrants. Some see this shift away from a legal paradigm of refugee protection as a source for enhanced operational flexibility in the face of changed …

Effect Of Wind And Tidal Advection On Distribution Patterns Of Rock Crab Cancer Irroratus Megalopae In Block Island Sound, Rhode Island, Michael Clancy, J. Stanley Cobb Jan 1997

Effect Of Wind And Tidal Advection On Distribution Patterns Of Rock Crab Cancer Irroratus Megalopae In Block Island Sound, Rhode Island, Michael Clancy, J. Stanley Cobb

Biological Sciences Faculty Publications

The planktonic period of benthic marine invertebrates can significantly affect distribution patterns of benthic juveniles. In this paper we address the relationship between advection and the subsequent abundance of planktonic megalopae of the rock crab Cancer irroratus in Block Island Sound, Rhode Island (USA), over an 8 yr period. At small scales (several meters distance with samples taken simultaneously), megalopae were found to be similarly distributed; at larger temporal (tens of minutes) and spatial scales (hundreds of meters) megalopae were very patchy, which indicates a complex, highly variable pattern of abundance typical of planktonic systems. Using the receptor-mode trajectory capability …

"Toward The Reformulation Of International Refugee Law" Research Report 1992-1997, James C. Hathaway

Other Publications

Discussions of the crisis in international refugee protection are frequently characterized by rhetorical excess, in which some ascribe all problems to malevolent states, while others are equally insistent that fraudulent asylum-seekers are solely to blame. This study was based, in contrast, on a recognition of the real systemic difficulties that jeopardize the viability of refugee protection. Its purpose was to devise a principled yet pragmatic way to reconcile state interests to the continued importance of access to asylum for those who need it.

The essence of our thesis is that the withdrawal of states from their legal responsibility to protect …

The Evolution Of Landscapes And Lineages In Pitcher Plants And Their Moths., Margaret Ellen Oard Jan 1997

The Evolution Of Landscapes And Lineages In Pitcher Plants And Their Moths., Margaret Ellen Oard

LSU Historical Dissertations and Theses

Pitcher plants and pitcher plant moths exhibit two prominent themes in the long evolutionary history between plants and insects. These themes are carnivory and herbivory. In pitcher plants, the leaf has been modified into an elegant pitfall trap enabling these plants to subsist at both the producer and consumer trophic levels. Of the numerous insect species intimately associated with pitcher plants, pitcher plant moths are the only inquilines which have evolved the capacity to disrupt both the carnivore and photosynthetic functions of the host plant. The carnivorous habit, considered an adaptation for nutrient deficient environments, has contributed to species radiations …

An Analysis Of Population Dispersal And Concentration In The United States, 1790-1990: The Frontier, Long Waves, And The Manufacturing Connection., Samuel Mark Otterstrom Jan 1997

An Analysis Of Population Dispersal And Concentration In The United States, 1790-1990: The Frontier, Long Waves, And The Manufacturing Connection., Samuel Mark Otterstrom

LSU Historical Dissertations and Theses

The United States has undergone massive changes in its population geography since 1790. A major component of these population shifts has been the rapid movement of the frontier westward. This dispersal of population through migration from relatively high densities along the eastern seaboard to the sparsely populated west was followed by concentration across most of the country after the general "closure" of the frontier. The rates of settlement growth and population concentration trends were not steady, but cyclical in nature, and they varied among the different regions of the country. This variation leads to a comparison of these phenomena with …

Seafloor Morphology, Geologic Framework, And Sedimentary Processes Of A Sand-Rich Shelf Offshore Alabama And Northwest Florida: Northeastern Gulf Of Mexico., Randolph Alexander Mcbride Jan 1997

Seafloor Morphology, Geologic Framework, And Sedimentary Processes Of A Sand-Rich Shelf Offshore Alabama And Northwest Florida: Northeastern Gulf Of Mexico., Randolph Alexander Mcbride

LSU Historical Dissertations and Theses

Late-Pleistocene and Holocene geology of the northeastern Gulf of Mexico shelf offshore Alabama and northwest Florida was investigated using 38 vibracores, 47 radiocarbon dates, foraminiferal and macrofauna assemblages, and bathymetry data. The morphologic and stratigraphic signatures of the last rise of eustatic sea level was examined along a passive continental margin. Major shelf features include shore-oblique sand ridges, mid-shelf linear shoals, and shelf-edge deltas. Surficial shelf sediments consist of $>$90% sand, $<$2.7% mud, and $<$2% granules and fine in a westerly direction from a medium to fine sand. The sharp boundary that demarcates these two sand types (Apalachicola and Mobile subprovinces) was identified for the first time in this study. Six facies and two erosional surfaces characterize shelf stratigraphy. Facies 1 is a Pleistocene soil horizon. This facies is truncated by a major erosional unconformity (Type 1 sequence boundary) created by subaerial exposure during the last sea level lowstand and the bay ravinement process during the ensuing transgression. Fine-grained estuarine deposits (Facies 2, 3, or 4 (lower transgressive systems tract)) overlie the unconformity. Facies 3 and 4 are truncated by a shoreface ravinement diastem (flooding surface) and overlain by a marine shell-bed (Facies 5; lower shoreface). Facies 5 grades into Facies 6, a quartz sand with marine foraminifera. Facies 5 and 6 comprise the upper transgressive systems tract (up to 5.5 m thick). Compared to a eustatic sea level curve, mollusk dates from estuarine shell beds show a time-transgressive trend, whereas marine shell beds are time-averaged. Transgressive and post-transgressive processes (strong cold fronts, tropical cyclones) concentrate marine mollusks above the shoreface ravinement diastem. Consequently, linear shoals are not in-situ or degraded barriers because marine species dominate the foraminiferal and molluscan assemblages, and deposits lie above shoreface ravinement diastem. Although shelf morphology is similar to modern barrier island geomorphology, shelf morphostratigraphy (linear shoals) is related to transgressive and post-transgressive processes. Shoal form and orientation are dictated by underlying transgressive topography (escarpments) that was cut into the Pleistocene substrate during the Holocene transgression. During transgression, erosional shoreface retreat produced a trailing sand sheet that draped the transgressive topography.

Selected Factors Influencing Academic Success Of First-Year Students In Seventh-Day Adventist Secondary Schools In Rwanda, Salomon Maniraguha Jan 1997

Selected Factors Influencing Academic Success Of First-Year Students In Seventh-Day Adventist Secondary Schools In Rwanda, Salomon Maniraguha

Dissertations

Problem. Seventh-day Adventist secondary schools recruit students through a severe entrance examination. However, after 9 months of schooling, more than 20% fail without possibility of repeating the grade or pursuing studies in less academically challenging schools. They are pushed out without means of coping with real life. This situation has multiple negative impacts on families who sell all their belongings in order to send their children to school where they can be prepared for a better life. It is for the interest of the Rwandese to learn which factors may contribute to maintaining these students in school.

Method. Data were …
