The Clear View Of The Cathedral: The Dominance Of Property Rules, Richard A. Epstein Jan 1997

The Clear View Of The Cathedral: The Dominance Of Property Rules, Richard A. Epstein

Faculty Articles

It is one thing to articulate a distinction; it is another to determine how it should be used. Although their work was pathbreaking in many ways, Calabresi and Melamed nonetheless failed to address systematically the challenge of deciding whether legal protection via a property or a liability rule should be conferred to holders of particular sorts of assets, or why. It is to that question that I shall address myself here. I shall lay out my cards clearly at the beginning. In a world in which transaction costs were zero, where all disputes could be costlessly resolved, the choice between …

Employment Law: Courts And Contracts, Richard A. Epstein Jan 1997

Employment Law: Courts And Contracts, Richard A. Epstein

Faculty Articles

There are clearly deep divisions of opinion in New Zealand on the relationship between the courts and the Employment Contracts Act 1991 (ECA). These address both substantive and jurisdictional issues. Thus, the central dispute concerns the way courts should interpret the various provisions of the Act. The second concerns the question of whether a specialized court should have primary responsibility over administering and interpreting the Act. Clearly, the two questions are related, for the choice of tribunal is likely to have some systematic effects on the manner of interpretation. But as a foreigner, I plan to avoid these specific controversies …

Inadequate Product Warnings And Causation, Mark A. Geistfeld Jan 1997

Inadequate Product Warnings And Causation, Mark A. Geistfeld

Faculty Articles

The market failure that provides an economic justification for imposing tort liability on product sellers for design and manufacturing defects also justifies tort liability for inadequate warnings. In general, the liability standards proposed in the most recent draft of the Restatement (Third) of Torts: Products Liability have the potential to remedy this market failure, although this purpose is not furthered by the Draft's requirement that plaintiffs prove that an adequate warning would have prevented the injury. Unless courts presume causation (as most currently do), sellers will not have sufficient incentive to warn about unavoidable product risks. Moreover, there is no …

The Lawyer Of Belmont, Kenji Yoshino Jan 1997

The Lawyer Of Belmont, Kenji Yoshino

Faculty Articles

Why is Portia such a crucial and overdetermined character for so many commentators, and for so many legal commentators in particular? Why has so much ink been spilled, with such vehemence and even vitriol, over what is in the end a fictive character in a play written in the late sixteenth century? My answer first invokes the framework outlined in Michael Walzer's Spheres of Justice. . . . I then argue that this framework, when applied to The Merchant of Venice, explains our obsession with Portia. . . . Third, I argue that while we view Portia's virtuosity in defining …

Toward A Theology Of Youth Ministry And Its Praxis In The Local Church, Luis Fernando Ortiz Jan 1997

Toward A Theology Of Youth Ministry And Its Praxis In The Local Church, Luis Fernando Ortiz

Doctor of Ministry Projects

Problem

In many Seventh-day Adventist churches in North America patterns of non involvement among the youth were observed. Young people were attending church on Sabbath, but almost none of them were leaders. The objective of this dissertation was to identify biblical principles for the development of a youth ministry in which leaders build responsible servant leaders and encourage young people to grow, learn, and use their gifts in Christian ministry.

Method

The Scriptures were searched for a biblical background for youth work and principles for successful youth involvement. The word “youth” was analyzed in the Old and New Testaments together …

Akhnai, Daniel J.H. Greenwood Jan 1997

Akhnai, Daniel J.H. Greenwood

Hofstra Law Faculty Scholarship

In the Talmudic story of the Oven of Akhnai, Rabbi Eliezer - symbol of unchanging law and original intent - decides a disputed issue of law, supporting his claim with all the arguments in the world and then with miracles including a voice from the Author proclaiming his interpretation correct. Nonetheless, his interpretation is rejected.

The Akhnai story is a complicated commentary on the problems of democracy and justice, with insights into the majoritarian (and counter-majoritarian) difficulties, the status of ancient law, and the meaning of originalist interpretation. I draw out lessons for those who seek to create a single …

Moderating Effects Of Tolerance For Ambiguity And Risktaking Propensity On The Role Conflict-Perceived Performance Relationship: Evidence From Singapore Entrepreneurs, Hai Yap Teoh, See Liang Foo Jan 1997

Moderating Effects Of Tolerance For Ambiguity And Risktaking Propensity On The Role Conflict-Perceived Performance Relationship: Evidence From Singapore Entrepreneurs, Hai Yap Teoh, See Liang Foo

Research Collection School Of Accountancy

This study investigates the effects of tolerance for ambiguity and risktaking propensity in mediating the relationships between role conflict and perceived performance among 70 entrepreneurs in small and medium-sized businesses in Singapore. Entrepreneurial activity has been widely recognized as a major factor driving Singapore's economic development. Further insights therefore can be gained by this study, which addresses the above issues from the perspective of Singaporean entrepreneurs. As founders of their enterprises, entrepreneurs are often involved with many aspects of activities that create a high potential for conflict, having to play multiple roles, coping with competing and conflicting demands, and overcoming …

Demythifying Multicultural Education: Social Semiotics As A Tool Of Critical Pedagogy, Stephanie Urso Spina Jan 1997

Demythifying Multicultural Education: Social Semiotics As A Tool Of Critical Pedagogy, Stephanie Urso Spina

Publications and Research

This article discusses the assumptions and curricular implications of a social semiotic approach to education. Semiotics refers to the meaning we make with language as well as other objects. events, and actions. Social semiotics emphasizes the social, cultural, historic, and political contexts that shape that meaning. A social semiotic approach to education can help teachers and teacher educators to deconstruct the reproduction of class, politicize the ideology of colonialism, and overcome the inequities they engender. By providing a way to challenge selectively reproduced cultural politics, social semiotics provides a way to reconstruct and democratize schools and society.

On The Dynamic Behaviour Of A Thermoviscoelastic Body In Frictional Contact With A Rigid Obstacle, Kenneth Kuttler, K. T. Andrews, M. Shillor Jan 1997

On The Dynamic Behaviour Of A Thermoviscoelastic Body In Frictional Contact With A Rigid Obstacle, Kenneth Kuttler, K. T. Andrews, M. Shillor

Faculty Publications

We consider the dynamic behaviour of a thermoviscoelastic body which may come into frictional contact with a rigid obstacle. The frictional contact is modelled by general contact and friction laws which include as special cases the power law normal compliance condition and the corresponding generalization of Coulomb's law of dry friction. The stress-strain constitutive relation is assumed to be of Kelvin-Voigt type and the frictional heat generation on the contact surface is taken into account. In this setting we establish the existence of a solution to a weak version of the energy-elasticity system which consists of a parabolic equation coupled …

Parish Nursing: A Resource And An Opportunity, Janice W. Swing Jan 1997

Parish Nursing: A Resource And An Opportunity, Janice W. Swing

Master's Projects

Do you know people in the community who do not understand their health needs? Are you aware of people who do not have access to health services? Parish nursing draws on the strengths of people in a congregation to promote physical, mental, and spiritual health for the congregation and its local community. Hospital nurses may want to use parish nurses as a valuable resource for discharge planning. Community nurses may also need the support of parish nurses for clients. Additionally, for experienced nurses who belong to a faith community, serving as a parish nurse satisfies a need for something new. …
