"Supervisor" Hostile Environment Sexual Harassment Claims, Liability Insurance, And The Trend Towards Negligence, Amanda D. Smith Oct 1997

"Supervisor" Hostile Environment Sexual Harassment Claims, Liability Insurance, And The Trend Towards Negligence, Amanda D. Smith

University of Michigan Journal of Law Reform

A lack of settled standards for determining liability in supervisor hostile environment sexual harassment lawsuits combined with similar uncertainty in the context of employer liability insurance coverage has resulted in increased litigation in this area. This Note argues that the current predominant standard in the employer liability context, which is based on negligence principle should be rejected in favor of an apparent authority standard, which more appropriately strikes a balance between encouraging employers to identify harassing behaviors and exonerating them from liability when they do so and take appropriate remedial action. It further argues that in order to develop effective …

An Ice Shelf Mechanism For Heinrich Layer Production, Christina L. Hulbe Oct 1997

An Ice Shelf Mechanism For Heinrich Layer Production, Christina L. Hulbe

Geology Faculty Publications and Presentations

The effect of an ice shelf in the Labrador Sea on ice-rafted sediment delivery to the glacial North Atlantic is investigated using a finite element numerical model of ice shelf flow. Discharge into the shelf from Hudson Strait creates a thick central core, extending downstream into the shelf, that is flanked by relatively thin ice. Melting at the base of the deep keel would produce cool, fresh water which would rise to refreeze along the keel's flanks. Debris deposited by melting deep central ice could create the Heinrich layers observed in the Labrador Sea while the debris-rich ice protected by …

Wolf Warriors And Turtle Kings: Native American Law Before The Blue Coats, Rennard Strickland Oct 1997

Wolf Warriors And Turtle Kings: Native American Law Before The Blue Coats, Rennard Strickland

Washington Law Review

One of the great myths of the white invention of the Indian was that there was no law among Native Americans before the white man except for a single Indian "primitive" legal system of blood revenge, uniform across the North American continent. This is not so. Law existed among Native Peoples long before white contact. Quite simply, the Indians had law. Before white contact, Native America nourished a rich and diverse system of law-a system of law that varied dramatically from people to people.
