Standard Form Contracts, Avery W. Katz Jan 1997

Standard Form Contracts, Avery W. Katz

Faculty Scholarship

Among legal commentators, standard form contracts have long been received with distrust, and the rules governing their interpretation have engendered considerable controversy. While economic analysis has little to say regarding the libertarian objection to standard form contracts or their relationship to personal autonomy, it can help evaluate their effects on efficiency and the distribution of the gains from trade. From such a perspective, standard forms should be analyzed like any other productive input, comparable to design, marketing, and technical support. Whether their use raises any special regulatory or policy concerns, therefore, depends on their implications for the standard litany of …

Indemnity Of Legal Fees, Avery W. Katz Jan 1997

Indemnity Of Legal Fees, Avery W. Katz

Faculty Scholarship

This article surveys the effects of legal fee shifting on a variety of decisions arising before and during the litigation process. Section 2 provides a brief survey of the practical situations in which legal fee shifting does and does not arise. Section 3 analyzes the effects of indemnification on the incentives to expend resources in litigated cases. Section 4 examines how indemnification influences the decisions to bring and to defend against suit, and Section 5 assesses its effects on the choice between settlement and trial. Section 6 addresses the interaction between the allocation of legal fees and the parties' incentives …

Contract Formation And Interpretation, Avery W. Katz Jan 1997

Contract Formation And Interpretation, Avery W. Katz

Faculty Scholarship

Much research in law and economics, following Coase's insight that the effects of a legal rule depend on the ability of those whom it governs to bargain around it, has undertaken to explain how substantive entitlements such as property rights influence the bargaining process. Perhaps more important than any substantive rights or duties in this regard, however, is the extensive body of contract doctrine that governs the procedural mechanics of exchange. The formal rules of contract formation, by attaching consequences to the various acts and omissions that bargainers can choose from in a negotiation, affect the parties' incentives to make …

Student Attitudes Toward Individuals With Disabilities: Inclusive Versus Traditional Classrooms In Elementary School, Heather Young Jan 1997

Student Attitudes Toward Individuals With Disabilities: Inclusive Versus Traditional Classrooms In Elementary School, Heather Young

Theses

In recent years, many schools have begun to include students with disabilities in general education classrooms. Studies on "inclusion," have shown several positive effects for students with and without disabilities. This study examines the self-reported attitudes of 185 elementary school students in inclusive and traditional classrooms, as measured by the Scale of Children's Attitudes Toward Exceptionalities (SCATE). Self-reported attitudes and experiences of general education teachers were also assessed using a survey developed by the researcher. Although statistically significant relationships were found on the SCATE, these were not logical or conclusive. Results of the teacher surveys indicate that teachers of inclusive …

Integrated Queries To Existing Bibliographic And Structured Databases, Ee Peng Lim, Ying Lu Jan 1997

Integrated Queries To Existing Bibliographic And Structured Databases, Ee Peng Lim, Ying Lu

Research Collection School Of Computing and Information Systems

It is widely accepted that future digital library applications have to be built upon different kinds of database servers to draw upon different forms of data, including bibliographic, text, multimedia, and structured data. In this paper, the problem of integrating existing public bibliographic databases and structured databases which reside at different locations in the network is addressed. Although bibliographic data is semistructured, its attribute set is often determined by an international standard known as MARC. To unify bibliographic and structured data, the well-known SQL was extended to model bibliographic related attributes and queries. In particular, a new data type was …

Small Miracles: Propagation Efforts Using Plants In The Family Hamamelidaceae, Martha Sasser Joiner Jan 1997

Small Miracles: Propagation Efforts Using Plants In The Family Hamamelidaceae, Martha Sasser Joiner

College of Graduate Studies: Theses & Dissertations (1964–2006)

Attempts were made to propagate five species in the family Hamamelidaceae by softwood cuttings or seeds. Local populations of witch-hazel Hamamelis virginiana L. and sweetgum Liquidambar styraciflua L. supplied cuttings and seeds of these native American species. Cultivated plants of dwarf witch-alder Fothergilla gardenii Murray were used initially for cuttings. Later, three native populations of this species were located and cuttings were obtained from them. Also, for seed propagation studies, seeds of F. gardenii were obtained from the North Carolina Botanical Garden and seeds were obtained from cultivated plants of two Asian species, winter hazel Corylopsis sinensis Hemsley and Chinese …

Bar Coding And The Construction Industry In Georgia And Alabama, Herbert Marion Barber Jr. Jan 1997

Bar Coding And The Construction Industry In Georgia And Alabama, Herbert Marion Barber Jr.

College of Graduate Studies: Theses & Dissertations (1964–2006)

Effective construction project management relies on data that can be processed into information (Bernold, 1990). Therefore, information on the construction project plays a key role in construction project management (Abudayyeh, 1991). Consequently, information management on the construction project is vital to the success of the construction project (Rasdorf, 1990). Bar coding is one option that can be used in the construction industry as an effective means of managing information (Stukhart, 1987).

The retail and manufacturing industries have used bar coding technology for several years to manage information (Bell, 1988) although the use of bar coding technology to manage information in …

Study Of The Barriers To The Implementation Of Computerised Information Systems In The National Health Service, Gloria Lankshear Jan 1997

Study Of The Barriers To The Implementation Of Computerised Information Systems In The National Health Service, Gloria Lankshear

Plymouth Business School Theses

In order for computerised information systems (CIS) to be utilised to their full potential they must first be successfully implemented. The acquisition and implementation process continues to be an area which is reported by the media to present problems for both public and private sector organisations (Keen, 1994; Collins, 1996). The process was originally considered to be a technical process only, but more recently there has been acknowledgement that there are human implications. The process of acquisition and implementation of CIS in the NHS has, therefore, been studied in order to identify the barriers which might be present. The research …

Personal Variables And Critical Incident Stress Among Correctional Officers, Robin L. Sanabria Jan 1997

Personal Variables And Critical Incident Stress Among Correctional Officers, Robin L. Sanabria

All-Inclusive List of Electronic Theses and Dissertations

The purpose of this study was to examine whether personal variables including age, gender, length of correctional work experience, years ofEducation, and work locus of control predict levels of critical incident stress among correctional officers. Fifty-two federal correctional officers completed: (a) the Impact of Event Scale-Revised (Weiss & Marmar, 1997) to measure critical incident stress, (b) the Work Locus Control Scale (Spector, 1988) to measure work locus of control, and (c) a demographic questionnaire. The instruments were distributed at the work place, and completion was encouraged during duty hours. Correlation and multiple regression analyses were conducted. The personal variables tested, …

The Location And Restructuring Of The Uk Defence Industry: The Case Of The South West, Timothy Neil Williams Jan 1997

The Location And Restructuring Of The Uk Defence Industry: The Case Of The South West, Timothy Neil Williams

Plymouth Business School Theses

The objective of this thesis is to determine the factors influencing the location of the defence industry in the UK and assess the impact of recent changes at the regional level. Such changes include cuts in defence expenditure and a re-evaluation of the methods of military procurement. The thesis begins with a descriptive analysis of defence markets and an explanation of the way in which the post-war UK defence sector has been supported by a relatively large and stable defence equipment budget. A review of the relevant literature suggests that defence markets are characterised by a number of unique features. …

Growth And Performance Of Small And Medium Sized Enterprises In Rural Peripheral Locations, Matthew John Gorton

Plymouth Business School Theses

Since the 1970s the number of small firms in the UK has risen, but at temporally and spatially uneven rates. These trends have heightened interest in the role of local economies in shaping small firm growth and performance. This thesis considers the growth and performance of small and medium sized enterprises (SMEs) based in rural peripheral locations in the UK. In measuring this, quantitative survey work was undertaken in rural core as well as rural peripheral localities, with the former acting as a benchmark for comparison. lJtilising returns from standardised postal questiormaires both the performance of the agricultural and non-agricultural …

The Effects Of Applied Technology Instruction On Mathematics Achievement And Career Interests Of Urban Seventh-Grade Students, Eric M. Fischer Jan 1997

The Effects Of Applied Technology Instruction On Mathematics Achievement And Career Interests Of Urban Seventh-Grade Students, Eric M. Fischer

Theses and Dissertations in Urban Services - Urban Education

The present study has been implemented to provide insight as to how, given limited resources, Technology Education curricula might be developed to best support the unique goals of an urban middle school aerospace magnet program. It was hypothesized that applied academic strategies, including interdisciplinary hands-on aerospace and computer-assisted instructional activities, would affect larger gains in mathematics achievement and would enhance career-interest development of urban seventh-grade students to a greater degree than would non-participation in such instruction. A randomized subjects, pretest-posttest control group design was used to assess treatment effects upon 71 urban seventh-grade students. Dependent variables were measured using the …

Coping Processes Used By Mothers Of Triplets, Susan Mullen Kaplan Jan 1997

Coping Processes Used By Mothers Of Triplets, Susan Mullen Kaplan

Health Services Research Dissertations

The purpose of the study was to identify and describe the coping processes used by mothers of triplets. Using a descriptive design, interpersonal comparisons of 92 mothers of triplets attending a national meeting of families of higher order multiples were made. Variables, in addition to sociodemographic characteristics, included coping processes, levels of depression, perceived availability of social support, and current stress levels. Coping processes were measured using the Ways of Coping Questionnaire (Folkman & Lazarus, 1988), derived from their cognitive-phenomenological theory of stress and coping. Level of depression was measured using the Zung Self-rating Depression Scale (Zung, 1965). Perceived availability …

A sample of 153 Black and 114 White college students were divided into high- and low-socioeconomic status based on demographic information. Acceptance of biracial individuals was measured by 2 modified versions of the Social Distance Scale (SDS1 and SDS2) developed by Bogardus (1928), a shortened version of the Scale To Measure Attitudes Toward Defined Groups (AS) developed by Grice (1934), and a measure of Perceived Commonality (PC) developed by Feather (1980). The Marlowe-Crowne (1960) Social Desirability …

Analysis Of Repeated Measures Data Under Circular Covariance, Andrew Montgomery Hartley Jan 1997

Analysis Of Repeated Measures Data Under Circular Covariance, Andrew Montgomery Hartley

Mathematics & Statistics Theses & Dissertations

Circular covariance is important in modelling phenomena in epidemiological, communications and numerous physical contexts. We introduce and develop a variety of methods which make it a more versatile tool. First, we present two classes of estimators for use in the presence of missing observations. Using simulations, we show that the mean squared errors of the estimators of one of these classes are smaller than those of the Maximum Likelihood (ML) estimators under certain conditions. Next, we propose and discuss a parsimonious, autoregressive type of circular covariance structure which involves only two parameters. We specify ML and other types of estimators …

Of Pandas, People, And The First Amendment: The Constitutionality Of Teaching Intelligent Design In The Public Schools, Jay D. Wexler Jan 1997

Of Pandas, People, And The First Amendment: The Constitutionality Of Teaching Intelligent Design In The Public Schools, Jay D. Wexler

Faculty Scholarship

Despite the Supreme Court's 1987 decision in Edwards v. Aguillard, striking down Arkansas' statute requiring equal time for the teaching of creationism and evolution, the debate over whether some form of creationism should be taught in public schools has recently enjoyed a resurgence. In this note, Jay Wexler applies the Supreme Court's Establishment Clause to a new variant of creationism that posits the existence of an intelligent designer as an alternative to evolution. Wexler argues that teaching intelligent design theory in the public schools violates the Establishment Clause. After explaining that the Supreme Court has always applied the Establishment Clause …

Legislative Inaction On The Information Superhighway: Bargaining In The Shadow Of Copyright Law, Maureen A. O'Rourke Jan 1997

Legislative Inaction On The Information Superhighway: Bargaining In The Shadow Of Copyright Law, Maureen A. O'Rourke

Faculty Scholarship

As a practical matter, the development of law in the form of enacted legislation often does not keep pace with societal change. At first glance, this fact seems somewhat disturbing since the law, according to some philosophies, should reflect social consensus. However, this is neither remarkable nor cause for concern. The law's processes are deliberative, involving time-consuming public testimony and debate. Thus, the law often plays "catch-up" with social change. This reactive rather than pro-active decision-making is generally desirable as the law is likely to change to reflect well-considered social judgments rather than passing social fancies. This column briefly examines …

Review Of Why Things Bite Back: Technology And The Revenge Of Unintended Consequences By Edward Tenner, Jay D. Wexler Jan 1997

Review Of Why Things Bite Back: Technology And The Revenge Of Unintended Consequences By Edward Tenner, Jay D. Wexler

Faculty Scholarship

Historian of science Edward Tenner begins his book with a typical example of what he sees as the irony of modern life in a technological society. With the advent of electronic mail and inter-office networking, one would expect that the amount of paper used in offices would markedly decline, but in fact, notes Tenner, paper recycling bins are more full than ever before. People do indeed communicate through e-mail, but since they mistrust the permanence of electronic transmissions, they also back them up with an ever increasing amount of paper communication. In his typically amusing way, Tenner notes that when …
