Supporting Student Teachers In An Urban, Multicultural Setting, Brian White Jan 1997

Supporting Student Teachers In An Urban, Multicultural Setting, Brian White

Peer Reviewed Articles

There is nothing unusual or startling about Grand Rapids Central High School, an urban school like hundreds of others across the country. But like most preservice teachers, the students in our teacher education program at Grand Valley State University have had very little experience in urban schools, and many find the prospect of student teaching at Central frightening indeed.

Learning, Working, Managing, Sharing: The New Paradigm Of The Learning Organization, Barry Sugarman Jan 1997

Learning, Working, Managing, Sharing: The New Paradigm Of The Learning Organization, Barry Sugarman

Journal of Pedagogy, Pluralism, and Practice

This essay examines the idea of the "Learning Organization" and some implications of its challenge to the long-dominant "Bureaucratic" paradigm. The central thesis of the L.O. paradigm holds (1) that a key success factor for any organization in the age of global competition is its ability to innovate continuously, appropriately, and faster than its rivals., and (2) that that can only happen through releasing the untapped capabilities of all its employees. Hence the key to successful organizations lies not in the areas of better control by managers but in the areas of better learning by all workers (including managers) -- …

Women's Early Recollections And Body Image, Melinda Karen Stoops

All-Inclusive List of Electronic Theses and Dissertations

This study examined whether there were significant differences in the manifest content of spontaneous and primed early recollections of women who have a positive body image and women who have a negative body image. The Manaster-Perryman Manifest Content Early Recollection Scoring Manual was used to score the early memories of participants. Participants in this study consisted of 94 women. Scores on the Body Shape Questionnaire were utilized to classify women into body image groups. Thirty-nine women were identified as having a positive body image; 55 women were identified as having a negative body image. Results indicated no significant differences between …

“Mechanical Arts And Merchandise” Canadian Public Administration In The New Economy, Harry W. Arthurs Jan 1997

“Mechanical Arts And Merchandise” Canadian Public Administration In The New Economy, Harry W. Arthurs

Articles & Book Chapters

The "New Economy", with its attendant trends and consequences, presents a number of distinct chal- lenges to Canadian public administration. The key features of the New Economy - changes in technol- ogy and the social organization of work, globalization and regional economic integration, and shifts in the boundary between the state and civil society - de- mand a reconsideration of the ways in which we have previously thought about bureaucracy, government, and the role of the interventionist state. These changes in our political economy have profoundly destabilized Canadian public administration and require us to find new ways to cope with …

The Invisible Barbecue, Eben Moglen Jan 1997

The Invisible Barbecue, Eben Moglen

Faculty Scholarship

Past legislation subsidizing the development of infrastructural technology has borne the mark of political corruption. The subject matter of the Telecommunications Act of 1996 falls within the same category of legislation that has fallen prey to this process in the past. In an effort to discern whether such forces are at work today, Professor Moglen undertakes a critical examination of the metaphors that pervade the current scholarly discourse on the subject of telecommunications law. Terms such as "Superhighway," "Broadcasting," and "Market for Eyeballs" reveal a great deal about the implicit assumptions at work behind the current scholarship and legislation, and …

The International City Hypothesis: An Approach To The Recent History Of U.S. Cities, Carl Abbott Jan 1997

The International City Hypothesis: An Approach To The Recent History Of U.S. Cities, Carl Abbott

Urban Studies and Planning Faculty Publications and Presentations

Differentiates between the concepts of world cities and international cities, asserting that study of international cities offers greater opportunities for research and analysis of major urban regions of the latter 20th century. The world city model emphasizes hierarchy and status based on influence and power. The international city model emphasizes numerous indicators that demonstrate a broader range of international connections, including foreign tourists, new immigration, sister-city affiliations, and multinational corporation offices. They may function as production centers, gateway cities, or transactional cities. At present, statistical data are thin, and the topic invites research by urban historians.

Islam, Law And Custom: Redefining Muslim Women's Rights, Azizah Y. Al-Hibri Jan 1997

Islam, Law And Custom: Redefining Muslim Women's Rights, Azizah Y. Al-Hibri

Law Faculty Publications

In discussing personal status codes, the article focuses on three specific issues: the right of a woman to contract her own marriage, the duty of the wife to obey her husband, and the right of the wife to initiate divorce. There are several good reasons for focusing on these issues. Foremost among them is the fact that they have been and continue to be of great concern to Muslim women. Another reason is that despite their diverse subject matter, these three issues are based on the same jurisprudential foundation. Hence, our discussion and critical analysis of that foundation will have …

"Just Say Never?" Poison Pills, Deadhand Pills, And Shareholder-Adopted Bylaws: An Essay For Warren Buffett, Jeffrey N. Gordon Jan 1997

"Just Say Never?" Poison Pills, Deadhand Pills, And Shareholder-Adopted Bylaws: An Essay For Warren Buffett, Jeffrey N. Gordon

Faculty Scholarship

My topic is Buffett on mergers and acquisitions and how his sage advice on the importance of shareholder choice should be taken to heart by the Delaware Supreme Court, which will soon face far-reaching questions on the distribution of power between shareholders and the board of directors. Recent judicial decisions in other jurisdictions: (i) have declared that a board can maintain a poison pill in the face of a premium hostile bid, the power to "just say no;" (ii) have validated the board's adoption of a so-called "deadhand pill," a poison pill that can be redeemed only by continuing directors; …

Presidential Rulemaking, Peter L. Strauss Jan 1997

Presidential Rulemaking, Peter L. Strauss

One of the prominent issues during the 1992 presidential campaign was abortion, in particular the federal government's role in financing counseling activities that might promote it. In the Bush Administration, the Department of Health and Human Services had adopted a controversial regulation to withhold federal funds from any family planning or other medical service that included counseling about abortion in its activities; the Clinton campaign promised to rescind that regulation if Clinton were elected President. Shortly after his election, in a prominent White House ceremony, President Clinton announced that he had directed the rescission of the prior rule and the …

Copyright, Common Law, And Sui Generis Protection Of Databases In The United States And Abroad, Jane C. Ginsburg Jan 1997

Copyright, Common Law, And Sui Generis Protection Of Databases In The United States And Abroad, Jane C. Ginsburg

Faculty Scholarship

What protection remains for compilations of information, particularly digital databases, since the United States Supreme Court swept away "sweat copyright" in its 1991 Feist decision? "Thin" copyright protection is still available, but it covers only the original contributions (if any) that the compiler brings to the public domain information. Moreover, Feist makes clear that padding the compilation with original added value will not flesh out the skeletal figure beneath: the information, stripped of selection, arrangement, or other copyrightable frills, remains free for the taking.

If copyright is unavailing, contract is appearing more promising, as mass-market, "shrinkwrap" and "click-on" licenses gain …

Authors And Users In Copyright, Jane C. Ginsburg Jan 1997

Authors And Users In Copyright, Jane C. Ginsburg

Faculty Scholarship

It has become fashionable, among some thinkers and activists in copyright and related fields, to disparage or to deplore copyright protection. For one drawn to copyright both for its intellectual fascination and its inspiring goals of fostering creativity and protecting authorship, I am distressed to learn that I am among the defenders of a fallen faith, that authors' rights are misguided (if not pernicious) impediments to technological progress, and, worst of all, that copyright blocks freedom of thought and speech in cyberspace. Digital agendas notwithstanding, some of this derogatory discourse is not new; infringers have long found eloquent, if somewhat …

On A Quest For Reason: A New Look At Surreptitious Search Warrants, Paul V. Konovalov Jan 1997

On A Quest For Reason: A New Look At Surreptitious Search Warrants, Paul V. Konovalov

UC Law Journal

Surreptitious search warrants, which authorize investigating agents to enter one's property and observe the interior without seizing any evidence or providing notice to the owner or occupant of the searched property, have recently been the subject of increased attention by the courts. During the last decade, both the Ninth Circuit and the Second Circuit have upheld as constitutional the use of surreptitious search warrants where agents have provided post-search notice to the targets of the search. The two Circuits have fundamentally disagreed, however, about the underlying legal justification for the notice requirement. In particular, the Ninth Circuit has explained that …

Identifying The Role Of Social Norms In Mediation: A Multiple Model Approach, Ellen A. Waldman Jan 1997

Identifying The Role Of Social Norms In Mediation: A Multiple Model Approach, Ellen A. Waldman

UC Law Journal

Mediation plays an ever-increasing role in a variety of dispute contexts. Once primarily limited to labor or neighborhood conflicts, the mediation process is currently being used to resolve environmental, personal injury, securities, and bioethics disputes. This movement into new areas has sparked modifications and innovations in traditional mediation practice. In this Article, Professor Waldman argues that changes in mediation practice require a revamping of mediation theory. She argues that mediation encompasses three separate, but related, procedural models that can be distinguished by their divergent treatment of social norms. She terms these models "norm-generating," "norm-educating," and "normadvocating."

In the norm-generating model, …
