Tort Reform In The Wake Of United States V. Lopez, Patrick Hoopes Jan 1997

Tort Reform In The Wake Of United States V. Lopez, Patrick Hoopes

UC Law Constitutional Quarterly

This Note discusses the extent to which federal tort reform measures would be constitutionally valid in light of the Supreme Court's decision in United States v. Lopez, which invalidated a federal statute criminalizing guns in schools. The Lopez Court, recognizing that the federal government was one of enumerated powers, held that the Commerce Clause granted Congress the power to regulate only those activities which had a substantial effect on interstate commerce. Specifically, this Note examines the constitutionality of a current proposal to limit punitive damage awards in nearly all tort actions. The heavy financial burden runaway juries impose on the …

Engineering Perfect Offspring: Devaluing Children And Childhood, Wendy Anton Fitzgerald Jan 1997

Engineering Perfect Offspring: Devaluing Children And Childhood, Wendy Anton Fitzgerald

UC Law Constitutional Quarterly

In this Essay, Professor Fitzgerald observes that the law and practice governing medical treatment decisions for seriously ill and disabled newborn children requires physicians and parents to compare such children with an unstated norm. She discerhs that our jurisprudence informs that unstated norm with an exclusive model of legal personhood, that of the autonomous individual, an independent and self-sufficient adult. Parents and physicians may conclude, then, that a seriously ill or disabled newborn child who cannot eventually become an autonomous adult should not receive life-saving or life-prolonging treatment. Professor Fitzgerald suggests that this treatment paradigm parallels a cultural resurgence of …

Random Number Generators For Parallel Computers, Paul D. Coddington Jan 1997

Random Number Generators For Parallel Computers, Paul D. Coddington

Northeast Parallel Architecture Center

Random number generators are used in many applications, from slot machines to simulations of nuclear reactors. For many computational science applications, such as Monte Carlo simulation, it is crucial that the generators have good randomness properties. This is particularly true for large-scale simulations done on high-performance parallel computers. Good random number generators are hard to find, and many widely-used techniques have been shown to be inadequate. Finding high-quality, efficient algorithms for random number generation on parallel computers is even more difficult. Here we present a review of the most commonly-used random number generators for parallel computers, and evaluate each generator …

Java For Parallel Computing And As A General Language For Scientific And Engineering Simulation And Modeling, Geoffrey C. Fox, Wojtek Furmanski Jan 1997

Java For Parallel Computing And As A General Language For Scientific And Engineering Simulation And Modeling, Geoffrey C. Fox, Wojtek Furmanski

Northeast Parallel Architecture Center

We discuss the role of Java and Web technologies for general simulation. We classify the classes of concurrency typical in problems and analyze separately the role of Java in user interfaces, coarse grain software integration, and detailed computational kernels. We conclude that Java could become a major language for computational science, as it potentially offers good performance, excellent user interfaces, and the advantages of object-oriented structure.

ADA Transactions

This item is part of the Transactions of the ADA, a serial publication of the annual activities of the ADA House of Delegates (HOD)/Board of Trustees (BOT). It is from the Transactions section, one of three subtitles that make up the full publication. Generally, the ADA Transactions are published in multiple volumes throughout the year. Pages from the Annual Reports and the Transactions are numbered consecutively (e.g. Annual Reports volume ends pg. 500 and Transactions volume starts at pg. 501). NOTE: All three subtitles are collectively known as the Transactions of the ADA or, alternatively, the ADA Transactions. Transactions refers …

Public Transportation For The Elderly: A Neighborhood-Area Fixed-Route Alternative, Richard James Burke Jan 1997

Public Transportation For The Elderly: A Neighborhood-Area Fixed-Route Alternative, Richard James Burke

Dissertations and Theses

As the elderly population of the United States grows in coming decades, providing personal mobility will be increasingly challenging. The dispersed suburban residential pattern of most metropolitan areas ensures that the personal automobile will continue to be the dominant mode of transportation. Those who voluntarily or involuntarily stop driving will encounter serious constraints in meeting their transportation needs.

Conventional public transit in most cities is tailored to the needs of urban commuters, and is, at best, barely adequate for elderly riders. Supplemental demand-response or subscription "special-needs" services are often inconvenient, sometimes unreliable, and inefficient. Eligibility criteria restrict many non-disabled elderly …

This paper describes an ongoing effort supported by ARPA PCRC (Parallel Compiler Runtime Consortium) project. In particular, we discuss the design and implementation of an HPF compilation system based on PCRC runtime. The approaches to issues such as directive analysis and communication detection are discussed in detail. The discussion includes fragments of code generated by the compiler.

A Comparison Of Optimization Heuristics For The Data Mapping Problem, Nikos Chrisochoides, Nashat Mansour, Geoffrey C. Fox Jan 1997

A Comparison Of Optimization Heuristics For The Data Mapping Problem, Nikos Chrisochoides, Nashat Mansour, Geoffrey C. Fox

Northeast Parallel Architecture Center

In this paper we compare the performance of six heuristics with suboptimal solutions for the data distribution of two dimensional meshes that are used for the numerical solution of Partial Differential Equations (PDEs) on multicomputers. The data mapping heuristics are evaluated with respect to seven criteria covering load balancing, interprocessor communication, flexibility and ease of use for a class of single-phase iterative PDE solvers. Our evaluation suggests that the simple and fast block distribution heuristic can be as effective as the other five complex and computational expensive algorithms.

Evaluation Of High Performance Fortran Through Application Kernels, Hon W. Yau, Geoffrey C. Fox, Ken Hawick Jan 1997

Evaluation Of High Performance Fortran Through Application Kernels, Hon W. Yau, Geoffrey C. Fox, Ken Hawick

Northeast Parallel Architecture Center

Since the definition of the High Performance Fortran (HPF) standard, we have been maintaining a suite of application kernel codes with the aim of using them to evaluate the available compilers. This paper presents the results and conclusions from this study, for sixteen codes, on compilers from IBM, DEC, and the Portland Group Inc. (PGI), and on three machines: a DEC Alphafarm, an IBM SP-2, and a Cray T3D. From this, we hope to show the prospective HPF user that scalable performance is possible with modest effort, yet also where the current weaknesses lay.

Northeast Parallel Architecture Center

Geographical and logical growth of the World-Wide Web is accompanied by a fast technological development. Web can be successfully used as a platform for implementation of diverse applications. Distributed and collaborative systems are among the most challenging Web applications. TANGO is an integration platform which enables implementation of Web-based collaborative environments. The system provides means for fast integration of Web- and non-Web-applications into one multi-user collaborative systems. In this paper we describe the functional model, requirements, system design and certain implementation issues of the TANGO system.

A Senone Based Confidence Measure For Speech Recognition, Z. Bergen, W. Ward Jan 1997

A Senone Based Confidence Measure For Speech Recognition, Z. Bergen, W. Ward

Space Dynamics Laboratory Publications

This paper describes three experiments in using frame level observation probabilities as the basis for word confidence annotation in an HMM speech recognition system. One experiment is at the word level, one uses word classes, and the other uses phone classes. In each experiment we categorize hypotheses into correct and incorrect categories by aligning a best recognition hypothesis with the known transcript. The confidence of error prediction for each class is a measure of the resolvability between the correct and incorrect histograms.

The Charter And Anglophone Legal Theory, Part I, Richard F. Devlin Frsc Jan 1997

The Charter And Anglophone Legal Theory, Part I, Richard F. Devlin Frsc

Articles, Book Chapters, & Popular Press

The Canadian Charter of Rights and Freedoms has generated not only new terrain over which discursive positions are mobilized, but it has catalysed theoretical reflection about law, society, state, and the self. Examining the implications of the Charter for Anglophone legal theory, the author conducts both a qualitative and quantitative survey of jurisprudential work on the Charter and concludes that the Charter's impact on legal theory has been significant. The Charter has prompted expansion of the range of interdisciplinary influences, contextualized theoretical reflection, and made jurisprudence more engaged with and relevant to Canadian social life. The Charter also has facilitated …
