A Clinical Textbook?, John B. Mitchell
A Clinical Textbook?, John B. Mitchell
Seattle University Law Review
A clinical perspective (i.e., centered on practicing attorneys and clients) should be embedded throughout the law school curriculum. Do you need a clinical textbook to impart this clinical perspective? No. There are a number of other alternatives. Many professors are creating their own problems and exercises. Also, standard texts have increasingly begun to include problems and exercises which you can use. And there are companion or supplementary materials--casefiles, exercises, and even novels which professors can assign to add a lawyering perspective to a doctrinal course.

Method To Correct The Voxel Size In Press Localized Nmr Stereoscopy, Diana M. Lindquist, Roger M. Hawk, Richard A. Komoroski
Journal of the Arkansas Academy of Science
Two techniques commonly used on human magnetic resonance spectroscopy systems to obtain spectra from localized volumes in the brain are point resolved spectroscopy (PRESS) and stimulated echo acquisition mode (STEAM) spectroscopy. PRESS gives a signal twice as large as that obtained with STEAM, but suffers from longer minimum echo times. While STEAM must be used to detect species with short spin-spin relaxation times, PRESS can be used for species with longer relaxation times to give a spectrum with a better signal to noise ratio. Only STEAM was provided for the GE Omega 4.7 T small animal imager used in this …
First Records For The Blackmask Racer (Coluber Constrictor Latrunculus) In Eastern Arkansas, Stanley E. Trauth
First Records For The Blackmask Racer (Coluber Constrictor Latrunculus) In Eastern Arkansas, Stanley E. Trauth
Journal of the Arkansas Academy of Science
The presence of the blackmask racer (Coluber constrictor latrunculus) in eastern Arkansas was first demonstrated by examination of a series of color slides of live specimens now preserved and deposited in the Arkansas State University Museum of herpetology. Adult color pattern is of paramount importance in the definition of subspecies of C. constrictor, and this is especially true for C. c. latrunculus. This subspecies is characterized by a conspicuous black stripe that extends from the postnasal, through the eye and onto the temporals or anterior dorsal scales. The dorsum is slate gray, and the venter is a pale grayish blue. …
Hydrogeological And Hydrochemical Connection Between The Decatur City Spring And Crystal Lake, Benton County, Arkansas, Demetra O. Salisbury, Ralph K. Davis
Hydrogeological And Hydrochemical Connection Between The Decatur City Spring And Crystal Lake, Benton County, Arkansas, Demetra O. Salisbury, Ralph K. Davis
Journal of the Arkansas Academy of Science
Arkansas is ranked nationally in the production of broilers, laying hens, turkey, swine and beef cattle. These animals produce large volumes of waste, which are spread on pasture land as a method of disposal, as well as a source of fertilizer, resulting in nonpoint source contamination of surface water and ground water. One area of concern includes the Decatur City Spring, which provides municipal water for the city of Decatur. A total of eight sites in the surrounding area were monitored routinely for water quality parameters, including pH, specific conductance, and nitrate-nitrogen. Water temperature and spring and lake stage were …

The Effects Of 50 Beat Per Minute Music To Decrease Anxiety And Lower Heart Rates In A Select Group Of College Students, Laura E. Burnell
Theses
The purpose of this study was to assess the affect of experimenter chosen 50 beat per minute music composed especially for stress and anxiety reduction on a select group of college students, and to examine its usefulness in promoting relaxation. The rationale for the study was based on research done in the area of using music to promote relaxation, and on the composer's claims that this music has been effective on a variety of populations for such purposes. Thirty subjects comprised of 17 males and 13 females ranging in age from 18 to 25 years participated in the study. This …

Using Gis To Assess The Relationship Between Land Use And Water Quality At A Watershed Level, Xinhao Wang, Zhi-Yong Yin
Using Gis To Assess The Relationship Between Land Use And Water Quality At A Watershed Level, Xinhao Wang, Zhi-Yong Yin
Environmental and Ocean Sciences: Faculty Scholarship
Daily water quality data from six U.S. Geological Survey (USGS) monitoring stations along the Great Miami River and digital land use/land cover and elevation data for the same watershed were analyzed. The validity of using electrolytic conductivity as a water quality indicator was examined by correlating conductivity with 199 other water quality variables, 60 of which were significantly correlated with conductivity. Positive correlations existed between conductivity and dissolved materials. Negative correlations existed between conductivity and insoluble or suspended materials. Conductivity was also found negatively correlated with stream discharge, and so were most water quality variables that were positively correlated with …

Morality And Change: Family Unity And Paternal Authority Among Kipsigis And Abaluyia Elders And Students., Carolyn P. Edwards
Morality And Change: Family Unity And Paternal Authority Among Kipsigis And Abaluyia Elders And Students., Carolyn P. Edwards
Department of Psychology: Faculty Publications
The responses to moral judgment dilemmas by 25 Kenyan from two rural tribal communities were analyzed for their assertions regarding two salient issues of morality: parental authority and family unit. The two tribal communities were the Kipsigis and Abaluyia, both from Western Kenya men, and the sample contained 14 elders/community leaders, and 11 secondary school students. The moral judgment interviews were originally collected in 1972 -1973 by trained University of Nairobi students, in order to test the cross-cultural validity of Lawrence Kohlberg’s cognitive-structuralist theory of moral development. For this study, the interviews were reanalyzed for their thematic content. The analysis …

Leadership And The Breast Cancer Movement, Amy Silverstein
Leadership And The Breast Cancer Movement, Amy Silverstein
Honors Theses
The breast cancer movement stays away from power struggles and superiority complexes. These women figured out that in order to stay organized and in control, every woman needed to feel included. The nature of the issue of the movement helps as well. Since most of these women fought the disease either themselves or with others, they understand how important a supportive environment contributes to a person's well-being. This support flows into the movement and contributes to the sense of togetherness. Some women are more prone to leadership than others, but that does not mean that they are somehow superior. Their …

Creating Complex Monsters: Joint Operating Agreements And The Logical Invalidity Of Treasury Regulation 1.502-1(B), Darryll K. Jones
Journal Publications
This article questions the validity of Regulations section 1.502-1(b) and its resulting insistence upon virtual mergers. It argues that the regulation is invalid as having no basis in section 502, the statute under which it was codified. This article argues, instead, that the regulation is a logically incorrect amalgamation of two distinct judicial tax doctrines by which tax exemption may be or could have been gained vicariously: (1) the integral part doctrine which allows one organization to achieve tax exemption on the basis of another organization's charitable activities, and (2) the now-discarded destination of income doctrine under which tax exemption …

Refracting The Spectrum Of Clean Water Act Standing In Light Of Lujan V. Defenders Of Wildlife, Karl S. Coplan
Elisabeth Haub School of Law Faculty Publications
First, this article will review the impetus and purposes for the Clean Water Act of 1972, including its citizen suit provision, particularly as these purposes relate to the elimination of specific harm or causation requirements in enforcement actions under its provisions. Second, this article will briefly review the basic elements of Article III standing requirements as enunciated by the Supreme Court, and the development of Supreme Court standing doctrine in environmental cases leading up to and including the Defenders of Wildlife decision. Then the article will survey the various approaches courts have taken in applying Article III standing doctrine to …

Suprachiasmatic Nucleus Neurons Are Glucose Sensitive, Adam C. Hall, Roselle M. Hoffmaster, Edra L. Stern, Mary E. Harrington, David Bickar
Chemistry: Faculty Publications
The suprachiasmatic nucleus (SCN) in the hypothalamus serves as the pacemaker for mammalian circadian rhythms. In a hamster brain slice preparation, the authors were able to record spontaneous activity from SCN cells for up to 4 days in vitro and verify a self-sustained rhythm in firing. The phase of this rhythm was altered by the concentration of glucose in the bathing medium, with time of peak firing advanced for a 20 mM glucose condition and slightly delayed for a 5 mM glucose condition, relative to 10 mM. The advancing effect of 20 mM glucose and the delaying effect of 5 …
The Silences Of The Restatement Of The Law Governing Lawyers: Lawyering As Only Adversary Practice, Carrie Menkel-Meadow
The Silences Of The Restatement Of The Law Governing Lawyers: Lawyering As Only Adversary Practice, Carrie Menkel-Meadow
Georgetown Law Faculty Publications and Other Works
The attempt to "restate" the law governing lawyers is a noble effort. The drafts, to date, have presented a heroic gathering, in one place, of case law and competing formulations of a variety of the professional disciplinary codes. The drafters have attempted to settle some difficult and often contentious issues regarding lawyer responsibilities to clients, to courts, to third parties, and to themselves. At the same time, this Restatement suffers from the temporal flaws of all its sisters and brothers - in its efforts to "restate" the law it looks backward, not forward, and thus will provide little guidance, at …

Interview: Cindi Katz. Creating Safe Space And The Materiality Of The Margins, Cindi Katz
Publications and Research
Cindi Katz, associate professor and chair of the environmental psychology program at the Graduate School of the City University of New York, visited the University of Kentucky in February of 1996 to deliver the keynote address at the 5 1/2 Annual Geography Graduate Student Conference. In her address, entitled "Power, Space and Terror: Social Reproduction and the Public Environment," Professor Katz discussed how changes jn urban built environments, particularly the privatization of urban public space, negatively affected New York City children. Privatization, she argued, not only serves a 'child hating' mentality prevalent in our society, but fosters, among other things, …
