Fatigue : Investigation Of A Human Factor For Aviation Curricula, Thomas R. Weitzel

This descriptive study investigated the perceived problem of human fatigue as an operational consideration within the U.S. air carrier industry and the status of fatigue as content within U.S. aviation education/training curricula. An instrument was developed and expert-validated for self-completion by the following three groups (each with its sample size): (a) aviation higher education, represented by a mailing to 50 individuals; (b) air carrier training/management, represented by a mailing to 50 individuals; and (c) a professional training group of 58 general aviation flight instructors, with administration by the researcher during scheduled company meetings. Language acquisition is a complex process that typically developing children seem to accomplish naturally at an early age. From the babbling of an infant to the multi-syllabic utterances of a toddler, language development occurs due the child's exposure and interaction to the sounds present in his or her environment. In an environment when two languages are spoken, a child has the opportunity to acquire two languages. In a case study conducted, an experimental exposure of an eight-year old male to the Tagalog language occurred. To investigate the importance of high dose vitamin A in the immune response and regulatory function of T helper (Th) cells to influenza A viral pneumonia, BALB/c mice were fed a high dose vitamin A diet (250,000 IU/kg diet) or a control diet (4,000 IU/kg diet) and then were intranasally inoculated with influenza A virus under light anesthesia at 7 weeks of age. Identification, Localization, And Characterization Of Sodium/Hydrogen Exchanger Isoforms 1 And 3 In The Gerbil Cochlea, Brian R. Bond

Mongolian gerbils were used in an investigation into the expression of cochlear sodium/hydrogen (NHE) exchanger isoforms 1,2,3 and 4. NHE 1-4 gene products were identified in the gerbil inner ear by reverse-transcription polymerase chain reaction (RT-PCR). The distribution of NHE-1 and 3 subsequently was mapped in the adult gerbil inner ear using isoform-specific polyclonal antibodies generated against rat antigens. Changes in the cellular expression level of NHE-1 protein in response to treatment with dexamethasone or NH4 CI-induced acidification were then assessed by semiquantitative immunohistochemical analysis. Since the 1980s, tort damages for pain and suffering have excited hue and cry. Twenty-three states currently place statutory limitations on tort damages for pain and suffering: seven states cap damages in general tort cases; an additional sixteen states limit awards solely in medical malpractice cases. Several states also have provisions limiting damages in other, very specific types of tort cases. While some statutes have been invalidated on state constitutional grounds, others have survived judicial scrutiny. At the federal level, both the House of Representatives and the Senate have passed tort-reform bills. Although no compromise legislation has been enacted, this …

Lawyers help ameliorate a particular instance of what the author calls the problem of interest--the partiality problem. For he believes that it falls to law professors to imbue in their students an understanding of the important role that lawyers play in society, if for no other reason than they will need some emotional armament from the slings and arrows of incessant lawyer jokes and worse. The ordinary course of business defense to the bankruptcy trustee's preference avoiding power has been controversial since its enactment in 1978. Burdened with a cryptic legislative history concerning its underlying goals, this preference exception has gone through multiple reinterpretations at the hands of Congress and the U.S. Supreme Court. Lifesaving Legislation: But Will The Washington Stalking Law Survive Constitutional Scrutiny?, Jennifer A. Hueter

In 1992, the Washington Legislature responded to public demand for a law that would allow criminal prosecution of stalkers by enacting Washington Revised Code section 9AA6.1 10. This stalking legislation makes it a crime to harass or repeatedly follow another person. This law may infringe an individual's right to speak and move freely and, because the law may unconstitutionally limit protected conduct, a defendant may successfully challenge this statute's constitutionality in the future. This Comment examines the potential constitutional challenges to the stalking law and suggests revisions to the current language in the statute.

The Res Judicata Effect Of Bankruptcy Court Judgments: The Procedural And Constitutional Concerns, George A. Martinez

This article seeks to resolve the conflict in the circuits and argues that bankruptcy court judgments should not bar the assertion of non-core claims because to do so violates the basic principles of res judicata and threatens to undermine fundamental Article III values or create judicial inefficiencies in an effort to preserve such values.

Part II of the article provides the relevant Article III background, and identifies the key Article III cases: Northern Pipeline Construction Company v. Differences in male and female self-reported interest and ability in occupations were examined. The researcher studied participants' interest and ability scores on 7 occupational categories of the Campbell Interest and Skill Survey : influencing, analyzing, producing, adventuring, organizing, helping, and creating. Thirty-nine subjects, age 17 to 23, completed the 320 item survey. The sample included 26 female and 13 male subjects. The survey utilized a 6 point response format requiring the subject to determine to what degree they share the interest or ability mentioned. This honours project examined the biochemical and haematological changes induced by exercise in the showjumping horse to determine whether a relationship exists between these values and performance. To complete this study 7 geldings and 1 stallion who were considered competition fit by their trainers were subjected to 2 forms of exercise. The first phase of this study involved an incremental exercise test performed at the Byford City Council horse training facility. The horses were cantered/galloped around a 1300m all weather training track at velocities of 6, 8, 10, and 12 m/sec for a duration of 2 minutes for each workload. …
