Vegetative Filter Strip Removal Of Metals In Runoff From Poultry Litter-Amended Fescuegrass Plots, Dwayne R. Edwards, P. A. Moore Jr., Tommy C. Daniel, Puneet Srivastava, D. J. Nichols Jan 1997

Vegetative Filter Strip Removal Of Metals In Runoff From Poultry Litter-Amended Fescuegrass Plots, Dwayne R. Edwards, P. A. Moore Jr., Tommy C. Daniel, Puneet Srivastava, D. J. Nichols

Biosystems and Agricultural Engineering Faculty Publications

Runoff from land areas amended with poultry (Gallus gallus domesticus) manure can contain elevated concentrations of metals such as Cu, Fe, and Zn. Vegetative filter strips (VFS) can reduce runoff concentrations of animal manure components, but reported studies have typically focused on nutrients and solids rather than metals. This experiment assessed the impact of VFS length (0 to 12 m) on concentrations and mass losses of Cu, Fe, K, Na, Ni, and Zn in runoff from fescuegrass (Festuca arundinacea Schreb.) plots (1.5 m wide × 6 and 12 m long) treated with poultry litter. The runoff was produced from simulated …

Forms Of Redress For Design Piracy: How Victims Can Use Existing Copyright Law, Peter K. Schalestock Jan 1997

Forms Of Redress For Design Piracy: How Victims Can Use Existing Copyright Law, Peter K. Schalestock

Seattle University Law Review

Part I of this Comment explores the nature and scope of design piracy in the fashion industry. It also discusses the impact of modem technology on pirates and their victims. Part II reviews the existing intellectual property legal framework, emphasizing copyright law and its application to clothing design. Part III discusses the exclusion of clothing design from copyright protection and reviews cases that have addressed that issue. Finally, Part IV suggests ways that designers might obtain greater protection. The alternatives explored are (1) the proper application of existing law to find separable protectable design elements, and (2) congressional action to …

Reproductive Control In South Africa, Carol E. Kaufman Jan 1997

Reproductive Control In South Africa, Carol E. Kaufman

Poverty, Gender, and Youth

The controversial state-sponsored family planning program officially began in South Africa in 1974. Although the government did not implement the program on a racial basis, the program was widely believed to be linked with white fears of growing black numbers, and was attacked by detractors as a program of social and political control. In spite of the hostile environment, black women’s use of services steadily increased. Using historical and anthropological evidence, this paper delineates the links between the social and political context of racial domination and individual fertility behavior. It argues that the quantitative ‘success’ of the family planning program …

Transition To Adulthood Of Female Factory Workers: Some Evidence From Bangladesh, Sajeda Amin, Ian Diamond, Ruchira Tabassum Naved, Margaret Newby Jan 1997

Transition To Adulthood Of Female Factory Workers: Some Evidence From Bangladesh, Sajeda Amin, Ian Diamond, Ruchira Tabassum Naved, Margaret Newby

Poverty, Gender, and Youth

The rapidly expanding sector of garment manufacturing for export is unusual for Bangladesh in that it employs young, unmarried women in large numbers. This paper examines data from a study on garment workers in Bangladesh to explore the implications of work for the early socialization of young women. For the first time young women are given an alternative to lives where they move directly from childhood into adulthood through early marriage and childbearing. Work creates a period of transition as contrasted with the abrupt assumption of adult roles at very young ages that marriage and childbearing mandate. It is argued …

Appellate Review Of Scientific Evidence Under Daubert And Joiner, David L. Faigman Jan 1997

Appellate Review Of Scientific Evidence Under Daubert And Joiner, David L. Faigman

UC Law Journal

In what he describes as a "premortem" on Joiner v. General Electric Co., a case before the Supreme Court at the time he is writing, Professor Faigman considers what role appellate courts should have in the evaluation of the admissibility of scientific expert testimony. Unclouded by the conclusions of the Court, Professor Faigman argues that appellate courts should share the active gatekeeping role that the Court created for district courts in Daubert v. Merrell Dow Pharmaceuticals, Inc.

Professor Faigman describes the lower courts' opinions in Joiner, noting that the Eleventh Circuit adopted a somewhat murky heightened standard of appellate review …

Applying A Strict Discovery Rule To Art Stolen In The Past, Tarquin Preziosi Jan 1997

Applying A Strict Discovery Rule To Art Stolen In The Past, Tarquin Preziosi

UC Law Journal

There is a great deal of un-recovered stolen art, and a great deal of confusion within and among jurisdictions as to when the applicable statute of limitations for stolen art begins to run. Holistic legal reform in this area is long overdue. Recent proposals, responding to current practices in the art world, call for the adoption of an art theft registry to help effectuate the return of stolen art and provide efficiency in the marketplace. However, a great number of objects fall outside the effective scope of these proposals: art that was stolen in the past, and those artworks which …

Avoiding The Tragedy Of Frankenstein: The Application Of The Right Of Publicity To The Use Of Digitally Reproduced Actors In Film, Erin Giacoppo Jan 1997

Avoiding The Tragedy Of Frankenstein: The Application Of The Right Of Publicity To The Use Of Digitally Reproduced Actors In Film, Erin Giacoppo

UC Law Journal

Technology now exists which will allow computer artists to digitally replicate living actors and digitally resurrect deceased actors. California's right of publicity statute, California Civil Code section 3344, arguably protects a living actor from replication in a commercial or film without his consent. Although California's post mortem right of publicity statute, California Civil Code section 990, prohibits the use of a digitally resurrected actor in an advertisement without the permission of the actor's estate, section 990 is inadequate to protect a deceased actor from unauthorized use in a film. Because unauthorized digital resurrection presents an opportunity for abuse, the author …

Identifying The Role Of Social Norms In Mediation: A Multiple Model Approach, Ellen A. Waldman Jan 1997

Identifying The Role Of Social Norms In Mediation: A Multiple Model Approach, Ellen A. Waldman

UC Law Journal

Mediation plays an ever-increasing role in a variety of dispute contexts. Once primarily limited to labor or neighborhood conflicts, the mediation process is currently being used to resolve environmental, personal injury, securities, and bioethics disputes. This movement into new areas has sparked modifications and innovations in traditional mediation practice. In this Article, Professor Waldman argues that changes in mediation practice require a revamping of mediation theory. She argues that mediation encompasses three separate, but related, procedural models that can be distinguished by their divergent treatment of social norms. She terms these models "norm-generating," "norm-educating," and "normadvocating."

In the norm-generating model, …

Effects Of Red Imported Fire Ants On Recruitment Of White-Tailed Deer Fawns, Craig R. Allen, Stephen Demarais, R. Scott Lutz Jan 1997

Effects Of Red Imported Fire Ants On Recruitment Of White-Tailed Deer Fawns, Craig R. Allen, Stephen Demarais, R. Scott Lutz

Nebraska Cooperative Fish and Wildlife Research Unit: Staff Publications

We investigated the effect of red imported fire ants (RIFA; Solenopsis invicta) on an index of whitetailed deer (Odocoileus virginianus) fawn recruitment (doe:fawn ratio) on 10 200-ha plots in the Texas Coastal Prairie during 1991-93. Five of the plots received treatments of the fire ant bait AMDRO© (Am. Cyanamid Co., Wayne, N.].) during April and October 1991 and May 1992 to reduce RIFA populations. The remaining 5 plots served as untreated comparison areas. Populations of RIFA were reduced (P < 0.10) on treated study areas during deer fawning periods in 1991-92. Fawn recruitment was higher on treated areas during 1991 (P = 0.037) and 1992 (P = 0.069), with recruitment about twice as high on treated areas. In 1993, after 1 year of RIFA reinfestation, fawn recruitment did not differ between treated and untreated plots (P = 0.443). We conclude that high density RIFA infestations reduced white-tailed deer fawn recruitment.

Effect Of Red Imported Fire Ant Envenomization On Neonatal American Alligators, Craig R. Allen, Kenneth G. Rice, Daniel P. Wojcik, H. Franklin Percival Jan 1997

Effect Of Red Imported Fire Ant Envenomization On Neonatal American Alligators, Craig R. Allen, Kenneth G. Rice, Daniel P. Wojcik, H. Franklin Percival

Nebraska Cooperative Fish and Wildlife Research Unit: Staff Publications

Alligator populations in the southeastern United States have substantially recovered since the late 1960s when they were placed on the federal Endangered Species List (Joanen and McNease, 1987). In Florida, both early age class and adult animals currently are harvested for commercial and recreational purposes (Hines and Abercrombie, 1987). In addition, the alligator is ecologically important as a keystone species and as an indicator of wetland health (Mazzotti and Brandt, 1994). Recently, the nonnative ant Solenopsis invicta (the red imported fire ant) has surfaced as a potential threat to alligator populations. Solenopsis invicta is a relatively new (approx. 65 yr) …

Oxytetracycline Marking Efficacy For Yellow Perch Fingerlings And Temporal Assays Of Tissue Residues, Eric G. Unkenholz, Michael L. Brown, Kevin L. Pope Jan 1997

Oxytetracycline Marking Efficacy For Yellow Perch Fingerlings And Temporal Assays Of Tissue Residues, Eric G. Unkenholz, Michael L. Brown, Kevin L. Pope

Nebraska Cooperative Fish and Wildlife Research Unit: Staff Publications

Differentiating between hatchery and naturally reproduced fishes is difficult because of the lack of appropriate marking techniques. Chemical immersion techniques can be a practical method for mass marking juvenile fishes. The objectives of this study were to determine the concentration of oxytetracycline (OTC) hydrochloride needed to effectively mark age-0 yellow perch Perca flavescens to observe the retention lime of the mark, and to measure the persistence of OTC in body tissues. Fish were immersed in 309, 534, and 748 mg OTC/L for 12 h. Initial fish collections were made weekly, and monthly collections began 1 month postmarking for tissue and …

Divergent Effects Of Job Control On Coping With Work Stressors: The Key Role Of Self-Efficacy, John Schaubroeck, Deryl E. Merritt Jan 1997

Divergent Effects Of Job Control On Coping With Work Stressors: The Key Role Of Self-Efficacy, John Schaubroeck, Deryl E. Merritt

Department of Management: Faculty Publications

This study identifies job self-efficacy as a moderating variable that may determine whether job control contributes positively or negative to coping with work stressors. Data from two samples (health professionals and an occupationally diverse group) demonstrated similar interactions between demands, control, and self-efficacy predicting blood pressure. These results may reconcile the previous inconsistent and largely method-bound support for Karasek's job demands-control model and suggest that efforts to improve job self-efficacy may be as important to reducing the cardiovascular consequences of job stress as efforts to enhance control.
