Crime control through law enforcement is generally considered to be a two-part process of appre­hending and incapacitating or rehabilitating the guilty, and deterring the innocent from crime by the threat of punishment. The analysis presented here shows that the protection of the innocent from harass­ment-detention, arrest, punishment, and other intrusions by the criminal justice system-is important in deterring crime. Specifically, the analysis shows that deterrence from crime is weakened and then lost for a rational individual who holds the majority attitude toward risk, if the levels of rightful punishment and wrongful harassment are increased, as in a war on crime, …

Black Cowboys In The American West: A Historiographical Review, David Goldstein-Shirley

Ethnic Studies Review

Few subjects in the ethnic experience of the United States are as fraught with mythology and misinformation as black cowboys. Although absent from most classic history texts of the American West, black cowboys probably constituted about a quarter of the working cowboys in the nineteenth century, although q uantitative data to establish a number are lacking. This essay reviews the historiography of black cowboys published during the last half-century, noting how much of it is marred either by glossing over the presence of black cowboys or by credulously repeating estimates of their numbers established by earlier work. Physician-Assisted Suicide: Rights And Risks To Vulnerable Communities, Benjamin C. Zipursky

In this Introduction, the author discusses the recent Supreme Court decisions Washington v. Glucksberg and Vacco v. Quill. On one hand, several panel contributors hold the position that one should have the right to control one’s own death, which is rooted in autonomy, liberty, and equality. Scholarly voices on the other side of the debate, including four panel members, believe that the legalization of physician-assisted suicide would create intolerable risks, particularly to those in the community who are the most vulnerable: the poor, the elderly, and the mentally and physically disabled.

This Note demonstrates that the federal regulations regarding human subject research must provide more specific guidelines that emphasize the process of obtaining informed consent from persons with mental illnesses. Part I discusses schizophrenia as a case example of mental illness that requires more stringent informed consent standards in human subject research. Part II describes the legal foundations of informed consent to human experimentation and the current federal regulations for human subject research. Part III examines the inadequacy of current federal regulations for mentally ill research subjects and proposes revisions to ensure that mentally ill persons provide adequate informed consent to …

Rediscovering The State Constitutional Right To Happiness And Safety, Joseph R. Grodin

UC Law Constitutional Quarterly

More than half of the state constitutions declare the right of persons "to pursue and obtain happiness and safety," or some variation on that language, but lawyers and judges seldom think to invoke those provisions in asserting or considering state constitutional claims. Professor Grodin, formerly a Justice of the California Supreme Court, explores the roots of such language in classical and Enlightenment philosophy. He then examines judicial opinions which have drawn upon the language and considers the way in which it might inform modem constitutional doctrine.

The primary goal of this dissertation was to develop and pilot test interactive, multimedia courseware which would facilitate learning the abstract structures, operations, and concepts associated with graph and network data structures in Computer Science. Learning objectives and prerequisites are presented in an introduction section of the courseware and a variety of learning activities are provided including tutorials, animated demonstrations, interactive laboratory sessions, and self-tests. Courseware development incorporated principles and practices from software engineering, instructional design, and cognitive learning theories. Development Of A Muslim Religiosity Scale, Abdulaziz Abdurrahman Albelaikhi

The main focus of the study was the construction of a new scale for measuring religiosity among Muslims. Two other existing scales were also used. Utilizing 169 (108 male, 61 female) Saudi Arabian Muslim college students, an exploratory Principal Components Analysis (PCA) was employed on a set of questionnaire items intended to measure Islamic religiosity. Six components were extracted, which represented the religious dimensions of practice, societal value of religion, belief in central tenets, personal need for religion, reliance on practical guidance, and unquestioning acceptance.

Predictions regarding multidimensionality of Muslim religiosity were generally supported. However, the PCA-based scales developed in …

Electrophysiological Effects Of Lysoplasmenylcholine On Rabbit Ventricular Myocytes, Ray Caldwell

Myocardial ischemia activates a phospholipase A2 that targets plasmalogen phospholipids and liberates 1-0-alkenyl-Iysoplasmenylcholine (LPLC) in preference to 1-0- acyl-Iysophosphatidylcholine (LPC). Although LPC is a pro arrhythmic ischemic metabolite, the effect of LPLC on cardiac electrophysiology is unknown. At the lowest doses investigated, LPLC induced spontaneous contractions in otherwise quiescent rabbit ventricular myocytes significantly faster than LPC. Spontaneous contractions developed with median times of 16.4 (n = 64), 27.4 (n = 36), and >60 min (n = 25) during exposure to 5, 2.5, and 1 JlM LPLC compared with 38.0 (n = 48) and >60 min (n = 29) for 5 …

The purpose of this thesis was to examine the critical thinking skills six Year 7 students used and developed while working on an Multimedia Information System, Encarta. The students' verbal interactions were recorded on audio tapes as they worked cooperatively in their groups. These interactions were transcribed and a content analysis technique was used to identify and calculate critical thinking indicator ratios. The content analysis was supported by field notes and students' word processed responses. Green Bottom Wildlife Management Area (GBWMA), Cabell County, West Virginia, is a wetlands system adjacent to the Ohio River composed of wetlands varying in age from 4 to 60 years. This system is annually flooded by the Ohio River, yet insect communities remain unique to each vegetation type or microhabitat. Nine vegetative communities from two wetlands were sampled and compared using chi-square analysis to determine if the insect communities were unique. A total of 34,975 specimens, representing 23 families, were collected over ten sample intervals. Chi-square analysis on seven families common to all sites indicated that each vegetative community yielded …

Grazed pastures represent a source of potential nonpoint pollution. In comparison to other nonpoint sources (e.g., row-cropped lands), relatively little information exists regarding possible magnitudes of pollution from grazed pasture; how that pollution is affected by weather, soil, management and other variables; and how the pollution can be minimized. In the summer of 1996,1 participated in archaeological excavations at Mainistir Chiarain, a small monastic site located on the island of Inis Mor in County Galway, Ireland. The purpose of the excavations was to determine the age and function of the structure on, the south side of the site. The information gathered will be used to develop a better idea of how people lived within the religious community on the island in the Middle Ages. The surface structure, Building A was dated to the sixteenth or early seventeenth century based on pottery analysis. Further excavation led to the discovery of …

Recent evidence suggests that the frontal lobe plays an intimate role in the meditation of prospective memory (Shallice & Burgess, 1991; Cockburn, 1995). However, there is a paucity of studies linking damage to the frontal lobe to reduced efficacy of prospective memory. The present study attempts to examine three types of participants who differ in frontal lobe functioning and their relative levels of successful prospective memory. The participants consist of younger adults, older adults (55 and over) and individuals with frontal lobe damage determined by a CAT scan or MRI.
