Res Judicata Effect Of Bankruptcy Court Judgments: The Procedural And Constitutional Concerns, The, George A. Martinez

Missouri Law Review

Should a bankruptcy court's judgment bar further litigation of claims arising out of the series of events at issue in the bankruptcy proceeding based on the doctrine of res judicata? Or should res judicata apply only where the subsequent action would constitute a core,' as opposed to non-core, but related proceeding? These questions raise important procedural and constitutional issues about which the courts of appeals are currently split. In 1984, Congress responded to Northern Pipeline by enacting 28 U.S.C. § 157, which authorizes bankruptcy judges to hear all core proceedings arising under the bankruptcy code. The 1984 Act provides that …

State Of Tampa Bay 1996, J.O.R. Johansson Jan 1997

State Of Tampa Bay 1996, J.O.R. Johansson

Reports

The amount of phytoplankton present in Tampa Bay waters can be estimated from measurements of the green plant pigment chlorophyll-a. Phytoplankton is one of several major forms of plants that exist in Tampa Bay and most other estuaries. Other major plant types are submerged seagrass, macro-algae and benthic micro-algae. The different plants can be viewed as being in competition with each other for required resources, such as light and nutrients. Studies conducted in urbanized estuaries have shown that excessive loading of nitrogen generally is accompanied by an increase of phytoplankton and macro-algae, including epiphytic and drift macro-algae, and by a …

Mimosa 1997, Jacksonville State University

JSU Yearbooks

The JSU Yearbook Collection spans the years from 1926 to the present. The publication began in 1926 as the Teacola (some volumes spelled "Teacoala") and continued under this title through 1933. The yearbook appears to have ceased printing after that year; the student newspaper took the name Teacola (later changed to the Collegian and finally the Chanticleer) and began publication in 1934. The yearbook started up again in 1947 under the name Mimosa. The Library holds all volume years that were printed: 1926-1933, 1947-1950, 1952-present.

Environmental Risk Factors And Cancer In The Charleston Heart Study, Vicki Bishop Benard Jan 1997

Environmental Risk Factors And Cancer In The Charleston Heart Study, Vicki Bishop Benard

MUSC Theses and Dissertations

Existing research suggests that a variety of environmental factors play an important role in cancer mortality. The association between some of these factors and cancer mortality was examined using data from the Charleston Heart Study, a thirty-five year prospective cohort. Baseline measurements for tobacco use, place of residence, occupation, education, water supply and physical activity were made in 1960/63 on 2,283 participants. The vital status of the cohort was ascertained through 1994, and the underlying cause of death as determined by the nosologist was used to define cancer mortality. There were 294 cancer deaths identified over the 35-year period. Statistical …

Cysteine From Feather Meal And Sulfur Amino Acid Requirements For Growing Steers, Mark Klemesrud, Terry J. Klopfenstein Jan 1997

Cysteine From Feather Meal And Sulfur Amino Acid Requirements For Growing Steers, Mark Klemesrud, Terry J. Klopfenstein

Nebraska Beef Cattle Reports

Ninety individually fed steers were used to determine how cysteine from feather meal could replace dietary methionine in meeting their requirements for sulfur amino acids. Treatment proteins included blood meal, blood meal plus incremental levels of feather meal or blood meal plus incremental levels of rumen-protected methionine. Addition of sulfur amino acids to blood meal from feather meal or rumen-protected methionine improved average daily gain (P < .05). Rumen-protected methionine elicited a greater gain response than feather meal (P < .05). Feather meal can provide some of the sulfur amino acids lacking in blood meal. However, additional methionine may further improve performance.

Effect Of Rumensin And Feed Intake Variation On Ruminal Ph, Rob Cooper, Terry J. Klopfenstein, Rick Stock, Cal Parrott, Dan Herold Jan 1997

Effect Of Rumensin And Feed Intake Variation On Ruminal Ph, Rob Cooper, Terry J. Klopfenstein, Rick Stock, Cal Parrott, Dan Herold

Nebraska Beef Cattle Reports

Six ruminally-fistulated steers were used to evaluate the effect of Rumensin and feed intake variation on ruminal pH. Steers were adapted to a 92.5 percent concentrate diet and then subjected to three levels of intake variation: ad libitum, intake variation of 2 lb/day, and intake variation of 4 lb/day. Feed intakes and ruminal pH were monitored continuously throughout the entire trial. Results indicate that Rumensin reduced acidosis by elevating average ruminal pH and decreasing are of ruminal pH below 5.6. In addition, Rumensin stabilized rate of intake and daily ruminal pH fluctuation at the high level of intake variation.
