Statutory Findings And Insider Trading Regulation, Steve Thel

Insider trading has presented some of the most unsettled and contentious issues of corporate law. These issues have been particularly difficult because often it has not even been clear whether the law forbids those who possess material nonpublic information to trade securities. Even as commentators have debated whether insider trading ought to be forbidden, the courts have disagreed on the more basic question of when and whether such trading is, in fact, forbidden.

Public choice offers an analysis of the Constitution that is broadly consonant with an important aspect of the Framers' own approach. The Framers' values were those largely of the Scottish enlightenment: they believed in progress of civilization-the accumulation of wealth and knowledge. In order to create a structure of society that would accomplish these ends, they relied on another Enlightenment axiom, namely that man is an object of natural science. By understanding the predictable manner in which individuals are likely to behave in given situations, the Framers could shape a constitution that would channel their behavior to meet their Enlightenment …

Conservation biology is a multidisciplinary subject of recent origins. Analysis of cited monographs from the journal Conservation Biology resulted in a list of 47 monographs which were heavily cited for this discipline. Over half of these were from related disciplines such as ecology, genetics, evolution, population biology, statistics, and natural resource management.

The purpose of this thesis is to explore the plastic image of water as the metaphor for specific human emotions. Given its fluid nature, water itself does not have its own particular form of existence. However, influenced by the external environment, water creates various forms that suggest specific human emotion. These forms are created by forces of nature. I intend to create sculpture of the motion of water that evokes human emotion. The format for the idea is sculpture that consists of structural, repetitive and organized modules. I don't like prisoners. Nobody pretends to like them, but every once in a while, one of these people is right. And a society is judged by how it treats the least among it, not the best. I'm not worried about how presidents of banks and chairmen of the board and of country clubs are treated, or star quarterbacks, or other prima donnas. Symbolic Statues And Real Laws: The Pathologies Of The Antiterrorism And Effective Death Penalty Act And The Prison Litigation Reform Act, Mark Tushnet, Larry Yackle

Criminals are not popular. No politician in recent memory has lost an election for being too tough on crime. In 1996, the Republican Congress and the Democratic President collaborated on two major statutes affecting the legal protections available to criminals. The Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA) modifies the habeas corpus statute in a number of ways, affecting the disposition of federal post-conviction challenges to all criminal convictions, not just those resulting in death sentences. The Prison Litigation Reform Act (PLRA) addresses lawsuits filed by prisoners challenging the conditions of their confinement. The PLRA covers both suits …

This thesis investigates the influence Henri Bergson's philosophy had on Vladimir Nabokov's writing. Bergson's major concerns, as espoused in Time and Free Will, Creative Evolution, and Matter and Memory, are recognized in Pale Fire, The Defense, and King, Queen, Knave, as well as in the various reworkings of the novelist's autobiography, Speak, Memory. These texts illustrate a shared concern with issues about time and space, aesthetic experience, instinct and analysis, and the importance of memory. At the heart of all of these matters rests a common concern for both writers--the primacy of lived experience and the necessity of free will. …

The goal of this research is to show how to solve a velocity estimation problem using a neural network connected to an array of sensors. Motivated by biological studies involving insect vision, the neural network utilized is a member of a class of shunting neural networks. When an object moves across the face of the sensor array, the neural network's pulse response is first temporally located using classical M-ary detection techniques. Both the deterministic and stochastic cases are considered. International competition among metrology laboratories, as well as their customers, has intensified the incentive to seek either accreditation to ISO Guide 25 or ISO 9000 quality system registration for the laboratory. The debate continues as to which is more beneficial to the laboratory and its customers once the decision is made to pursue one or the other. This study addresses the advantages and limitations of each, and how best to prepare for complying with ISO standards. The 4-H shooting sports program provides a dynamic way to involve hard-to-reach youth as demonstrated through long term programming and summative evaluation results. Four-H shooting sports is an under-used hook for involving youth in 4-H. Involvement in shooting sports can provide the skills that lead to many other 4-H opportunities, in many cases, changing the lives of youth in positive ways and opening doors to vocational or avocational opportunities. Four-H shooting sports is truly an activity for a lifetime. The 4-H shooting sports program has the potential to attract a new audience of 4-H members and adult volunteers.
